77 relating to the powers and duties and election of the board of
88 directors of the West Travis County Municipal Utility District No.
99 3.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 8440, Special District
1212 Local Laws Code, is amended by adding Section 8440.052 to read as
1313 follows:
1414 Sec. 8440.052. ELECTION DATE. The district shall hold an
1515 election to elect the appropriate number of directors on the
1616 uniform election date prescribed by Section 41.001, Election Code,
1717 in November of each even-numbered year.
1818 SECTION 2. Section 8440.101, Special District Local Laws
1919 Code, is amended to read as follows:
2020 Sec. 8440.101. GENERAL [MUNICIPAL UTILITY DISTRICT] POWERS
2121 AND DUTIES. (a) The district has the rights, powers, privileges,
2222 functions, and duties:
2323 (1) provided by general law applicable to a municipal
2424 utility district created under Section 59, Article XVI, Texas
2525 Constitution, including Chapters 49, 50, and 54, Water Code;
2626 (2) relating to a road district or road utility
2727 district created under Section 52, Article III, Texas Constitution;
2828 and
2929 (3) relating to the provision of potable and
3030 nonpotable water to the residents and businesses of Travis and Hays
3131 Counties, including the construction, acquisition, operation, and
3232 maintenance of a supply and distribution facility or system [,
3333 applicable to a municipal utility district created under Section
3434 59, Article XVI, Texas Constitution].
3535 (b) Notwithstanding Subsection (a), the district may not
3636 construct, acquire, operate, or maintain a toll road.
3737 SECTION 3. (a) The legal notice of the intention to
3838 introduce this Act, setting forth the general substance of this
3939 Act, has been published as provided by law, and the notice and a
4040 copy of this Act have been furnished to all persons, agencies,
4141 officials, or entities to which they are required to be furnished
4242 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4343 Government Code.
4444 (b) The governor, one of the required recipients, has
4545 submitted the notice and Act to the Texas Commission on
4646 Environmental Quality.
4747 (c) The Texas Commission on Environmental Quality has filed
4848 its recommendations relating to this Act with the governor, the
4949 lieutenant governor, and the speaker of the house of
5050 representatives within the required time.
5151 (d) All requirements of the constitution and laws of this
5252 state and the rules and procedures of the legislature with respect
5353 to the notice, introduction, and passage of this Act are fulfilled
5454 and accomplished.
5555 SECTION 4. This Act takes effect immediately if it receives
5656 a vote of two-thirds of all the members elected to each house, as
5757 provided by Section 39, Article III, Texas Constitution. If this
5858 Act does not receive the vote necessary for immediate effect, this
5959 Act takes effect September 1, 2017.
