5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to the powers and duties and election of the board of
8	8	directors of the West Travis County Municipal Utility District No.
9	9	3.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subchapter B, Chapter 8440, Special District
12	12	Local Laws Code, is amended by adding Section 8440.052 to read as
13	13	follows:
14	14	Sec. 8440.052. ELECTION DATE. The district shall hold an
15	15	election to elect the appropriate number of directors on the
16	16	uniform election date prescribed by Section 41.001, Election Code,
17	17	in November of each even-numbered year.
18	18	SECTION 2. Section 8440.101, Special District Local Laws
19	19	Code, is amended to read as follows:
20	20	Sec. 8440.101. GENERAL [MUNICIPAL UTILITY DISTRICT] POWERS
21	21	AND DUTIES. (a) The district has the rights, powers, privileges,
22	22	functions, and duties:
23	23	(1) provided by general law applicable to a municipal
24	24	utility district created under Section 59, Article XVI, Texas
25	25	Constitution, including Chapters 49, 50, and 54, Water Code;
26	26	(2) relating to a road district or road utility
27	27	district created under Section 52, Article III, Texas Constitution;
28	28	and
29	29	(3) relating to the provision of potable and
30	30	nonpotable water to the residents and businesses of Travis and Hays
31	31	Counties, including the construction, acquisition, operation, and
32	32	maintenance of a supply and distribution facility or system [,
33	33	applicable to a municipal utility district created under Section
34	34	59, Article XVI, Texas Constitution].
35	35	(b) Notwithstanding Subsection (a), the district may not
36	36	construct, acquire, operate, or maintain a toll road.
37	37	SECTION 3. (a) The legal notice of the intention to
38	38	introduce this Act, setting forth the general substance of this
39	39	Act, has been published as provided by law, and the notice and a
40	40	copy of this Act have been furnished to all persons, agencies,
41	41	officials, or entities to which they are required to be furnished
42	42	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
43	43	Government Code.
44	44	(b) The governor, one of the required recipients, has
45	45	submitted the notice and Act to the Texas Commission on
46	46	Environmental Quality.
47	47	(c) The Texas Commission on Environmental Quality has filed
48	48	its recommendations relating to this Act with the governor, the
49	49	lieutenant governor, and the speaker of the house of
50	50	representatives within the required time.
51	51	(d) All requirements of the constitution and laws of this
52	52	state and the rules and procedures of the legislature with respect
53	53	to the notice, introduction, and passage of this Act are fulfilled
54	54	and accomplished.
55	55	SECTION 4. This Act takes effect immediately if it receives
56	56	a vote of two-thirds of all the members elected to each house, as
57	57	provided by Section 39, Article III, Texas Constitution. If this
58	58	Act does not receive the vote necessary for immediate effect, this
59	59	Act takes effect September 1, 2017.
