511 relating to the 32nd Judicial District Juvenile Board.
612 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
713 SECTION 1. Sections 152.0821(a) and (b), Human Resources
814 Code, are amended to read as follows:
915 (a) Fisher County is included in the 32nd Judicial District
1016 Juvenile Board [Fisher, Mitchell, and Nolan counties juvenile
1117 board. The juvenile board is composed of:
1218 [(1) a county judge from Fisher, Mitchell, or Nolan
1319 County elected by a majority vote of the county judges from those
1420 counties;
1521 [(2) the 32nd Judicial District judge or the judge of
1622 the county court at law in Nolan County who is selected by agreement
1723 between those two judges;
1824 [(3) one person appointed by the Nolan County
1925 Commissioners Court;
2026 [(4) subject to Subsection (f), the city manager of
2127 Sweetwater or another person appointed by the Sweetwater City
2228 Commission;
2329 [(5) subject to Subsection (g), the superintendent of
2430 the Sweetwater Independent School District or another person
2531 appointed by the board of trustees of the Sweetwater Independent
2632 School District;
2733 [(6) one person appointed by the Mitchell County
2834 Commissioners Court;
2935 [(7) one person appointed by the Fisher County
3036 Commissioners Court;
3137 [(8) the county attorney of Fisher, Mitchell, or Nolan
3238 County selected by a majority vote of the county judges of those
3339 counties; and
3440 [(9) one person selected by majority vote of the
3541 county judges of Fisher, Mitchell, and Nolan counties, subject to
3642 confirmation by a vote of the commissioners courts of each of those
3743 counties].
3844 (b) Section 152.1831 applies to the 32nd Judicial District
3945 Juvenile Board. [The chairman of the board is the county judge
4046 appointed under Subsection (a)(1). The chairman presides at
4147 meetings scheduled by the board.]
4248 SECTION 2. Sections 152.1741(a) and (b), Human Resources
4349 Code, are amended to read as follows:
4450 (a) Mitchell County is included in the 32nd Judicial
4551 District Juvenile Board [Fisher, Mitchell, and Nolan counties
4652 juvenile board. The juvenile board is composed of:
4753 [(1) a county judge from Fisher, Mitchell, or Nolan
4854 County elected by a majority vote of the county judges from those
4955 counties;
5056 [(2) the 32nd Judicial District judge or the judge of
5157 the county court at law in Nolan County who is selected by agreement
5258 between those two judges;
5359 [(3) one person appointed by the Nolan County
5460 Commissioners Court;
5561 [(4) subject to Subsection (f), the city manager of
5662 Sweetwater or another person appointed by the Sweetwater City
5763 Commission;
5864 [(5) subject to Subsection (g), the superintendent of
5965 the Sweetwater Independent School District or another person
6066 appointed by the board of trustees of the Sweetwater Independent
6167 School District;
6268 [(6) one person appointed by the Mitchell County
6369 Commissioners Court;
6470 [(7) one person appointed by the Fisher County
6571 Commissioners Court;
6672 [(8) the county attorney of Fisher, Mitchell, or Nolan
6773 County selected by majority vote of the county judges of those
6874 counties; and
6975 [(9) one person selected by majority vote of the
7076 county judges of Fisher, Mitchell, and Nolan counties, subject to
7177 confirmation by a vote of the commissioners courts of each of those
7278 counties].
7379 (b) Section 152.1831 applies to the 32nd Judicial District
7480 Juvenile Board. [The chairman of the board is the county judge
7581 appointed under Subsection (a)(1). The chairman presides at
7682 meetings scheduled by the board.]
7783 SECTION 3. Section 152.1831, Human Resources Code, is
7884 amended by amending Subsections (a), (b), (c), (d), and (g) and
7985 adding Subsection (h) to read as follows:
8086 (a) Nolan County is included in the 32nd Judicial District
8187 Juvenile Board [Fisher, Mitchell, and Nolan counties juvenile
8288 board]. The juvenile board is composed of the county judges,
8389 statutory county judges, and district judges in Fisher, Mitchell,
8490 and Nolan Counties[:
8591 [(1) a county judge from Fisher, Mitchell, or Nolan
8692 County elected by a majority vote of the county judges from those
8793 counties;
8894 [(2) the 32nd Judicial District judge or the judge of
8995 the county court at law in Nolan County who is selected by agreement
9096 between those two judges;
9197 [(3) one person appointed by the Nolan County
9298 Commissioners Court;
9399 [(4) subject to Subsection (f), the city manager of
94100 Sweetwater or another person appointed by the Sweetwater City
95101 Commission;
96102 [(5) subject to Subsection (g), the superintendent of
97103 the Sweetwater Independent School District or another person
98104 appointed by the board of trustees of the Sweetwater Independent
99105 School District;
100106 [(6) one person appointed by the Mitchell County
101107 Commissioners Court;
102108 [(7) one person appointed by the Fisher County
103109 Commissioners Court;
104110 [(8) the county attorney of Fisher, Mitchell, or Nolan
105111 County selected by a majority vote of the county judges of those
106112 counties; and
107113 [(9) one person selected by majority vote of the
108114 county judges of Fisher, Mitchell, and Nolan counties, subject to
109115 confirmation by a vote of the commissioners courts of each of those
110116 counties].
111117 (b) The juvenile board shall elect one of the members as
112118 chairman [of the board is the county judge appointed under
113119 Subsection (a)(1). The chairman presides at meetings scheduled by
114120 the board].
115121 (c) The commissioners courts of the counties may pay the
116122 members of the juvenile board an annual supplemental compensation
117123 from the general fund or any other available fund of the counties.
118124 [The appointed members serve without compensation. Each member
119125 serves a two-year term.]
120126 (d) The juvenile board shall hold regular meetings on dates
121127 set by the board and special meetings at the call of the chairman.
122128 [The Nolan County Commissioners Court, the Sweetwater City
123129 Commission, and the board of trustees of the Sweetwater Independent
124130 School District may agree to provide the funds for the salaries of
125131 the personnel assigned to Nolan County and the other expenses the
126132 board chairman certifies as necessary to provide adequate juvenile
127133 services to Nolan County. The commissioners court, city council,
128134 and board of trustees shall each provide one-third of the funds.]
129135 (g) The juvenile board shall designate the treasurer or
130136 auditor of Fisher County, Mitchell County, or Nolan County to serve
131137 as the board's fiscal officer. [The board member appointed by the
132138 Sweetwater Independent School District under Subsection (a)(5) may
133139 be appointed only if that school district agrees to provide funds
134140 for the salaries of the personnel assigned to Nolan County and other
135141 expenses the board chairman certifies as necessary to provide
136142 adequate juvenile services to Nolan County as provided by
137143 Subsection (d).]
138144 (h) The juvenile board shall appoint an advisory council
139145 composed of one person from each county.
140146 SECTION 4. The following provisions of the Human Resources
141147 Code are repealed:
142148 (1) Sections 152.0821(c), (d), (e), (f), and (g);
143149 (2) Sections 152.1741(c), (d), (e), (f), and (g); and
144150 (3) Section 152.1831(f).
145151 SECTION 5. This Act takes effect October 1, 2017.
