4	10		AN ACT
5	11		relating to the 32nd Judicial District Juvenile Board.
6	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	13		SECTION 1. Sections 152.0821(a) and (b), Human Resources
8	14		Code, are amended to read as follows:
9	15		(a) Fisher County is included in the 32nd Judicial District
10	16		Juvenile Board [Fisher, Mitchell, and Nolan counties juvenile
11	17		board. The juvenile board is composed of:
12	18		[(1) a county judge from Fisher, Mitchell, or Nolan
13	19		County elected by a majority vote of the county judges from those
14	20		counties;
15	21		[(2) the 32nd Judicial District judge or the judge of
16	22		the county court at law in Nolan County who is selected by agreement
17	23		between those two judges;
18	24		[(3) one person appointed by the Nolan County
19	25		Commissioners Court;
20	26		[(4) subject to Subsection (f), the city manager of
21	27		Sweetwater or another person appointed by the Sweetwater City
22	28		Commission;
23	29		[(5) subject to Subsection (g), the superintendent of
24	30		the Sweetwater Independent School District or another person
25	31		appointed by the board of trustees of the Sweetwater Independent
26	32		School District;
27	33		[(6) one person appointed by the Mitchell County
28	34		Commissioners Court;
29	35		[(7) one person appointed by the Fisher County
30	36		Commissioners Court;
31	37		[(8) the county attorney of Fisher, Mitchell, or Nolan
32	38		County selected by a majority vote of the county judges of those
33	39		counties; and
34	40		[(9) one person selected by majority vote of the
35	41		county judges of Fisher, Mitchell, and Nolan counties, subject to
36	42		confirmation by a vote of the commissioners courts of each of those
37	43		counties].
38	44		(b) Section 152.1831 applies to the 32nd Judicial District
39	45		Juvenile Board. [The chairman of the board is the county judge
40	46		appointed under Subsection (a)(1). The chairman presides at
41	47		meetings scheduled by the board.]
42	48		SECTION 2. Sections 152.1741(a) and (b), Human Resources
43	49		Code, are amended to read as follows:
44	50		(a) Mitchell County is included in the 32nd Judicial
45	51		District Juvenile Board [Fisher, Mitchell, and Nolan counties
46	52		juvenile board. The juvenile board is composed of:
47	53		[(1) a county judge from Fisher, Mitchell, or Nolan
48	54		County elected by a majority vote of the county judges from those
49	55		counties;
50	56		[(2) the 32nd Judicial District judge or the judge of
51	57		the county court at law in Nolan County who is selected by agreement
52	58		between those two judges;
53	59		[(3) one person appointed by the Nolan County
54	60		Commissioners Court;
55	61		[(4) subject to Subsection (f), the city manager of
56	62		Sweetwater or another person appointed by the Sweetwater City
57	63		Commission;
58	64		[(5) subject to Subsection (g), the superintendent of
59	65		the Sweetwater Independent School District or another person
60	66		appointed by the board of trustees of the Sweetwater Independent
61	67		School District;
62	68		[(6) one person appointed by the Mitchell County
63	69		Commissioners Court;
64	70		[(7) one person appointed by the Fisher County
65	71		Commissioners Court;
66	72		[(8) the county attorney of Fisher, Mitchell, or Nolan
67	73		County selected by majority vote of the county judges of those
68	74		counties; and
69	75		[(9) one person selected by majority vote of the
70	76		county judges of Fisher, Mitchell, and Nolan counties, subject to
71	77		confirmation by a vote of the commissioners courts of each of those
72	78		counties].
73	79		(b) Section 152.1831 applies to the 32nd Judicial District
74	80		Juvenile Board. [The chairman of the board is the county judge
75	81		appointed under Subsection (a)(1). The chairman presides at
76	82		meetings scheduled by the board.]
77	83		SECTION 3. Section 152.1831, Human Resources Code, is
78	84		amended by amending Subsections (a), (b), (c), (d), and (g) and
79	85		adding Subsection (h) to read as follows:
80	86		(a) Nolan County is included in the 32nd Judicial District
81	87		Juvenile Board [Fisher, Mitchell, and Nolan counties juvenile
82	88		board]. The juvenile board is composed of the county judges,
83	89		statutory county judges, and district judges in Fisher, Mitchell,
84	90		and Nolan Counties[:
85	91		[(1) a county judge from Fisher, Mitchell, or Nolan
86	92		County elected by a majority vote of the county judges from those
87	93		counties;
88	94		[(2) the 32nd Judicial District judge or the judge of
89	95		the county court at law in Nolan County who is selected by agreement
90	96		between those two judges;
91	97		[(3) one person appointed by the Nolan County
92	98		Commissioners Court;
93	99		[(4) subject to Subsection (f), the city manager of
94	100		Sweetwater or another person appointed by the Sweetwater City
95	101		Commission;
96	102		[(5) subject to Subsection (g), the superintendent of
97	103		the Sweetwater Independent School District or another person
98	104		appointed by the board of trustees of the Sweetwater Independent
99	105		School District;
100	106		[(6) one person appointed by the Mitchell County
101	107		Commissioners Court;
102	108		[(7) one person appointed by the Fisher County
103	109		Commissioners Court;
104	110		[(8) the county attorney of Fisher, Mitchell, or Nolan
105	111		County selected by a majority vote of the county judges of those
106	112		counties; and
107	113		[(9) one person selected by majority vote of the
108	114		county judges of Fisher, Mitchell, and Nolan counties, subject to
109	115		confirmation by a vote of the commissioners courts of each of those
110	116		counties].
111	117		(b) The juvenile board shall elect one of the members as
112	118		chairman [of the board is the county judge appointed under
113	119		Subsection (a)(1). The chairman presides at meetings scheduled by
114	120		the board].
115	121		(c) The commissioners courts of the counties may pay the
116	122		members of the juvenile board an annual supplemental compensation
117	123		from the general fund or any other available fund of the counties.
118	124		[The appointed members serve without compensation. Each member
119	125		serves a two-year term.]
120	126		(d) The juvenile board shall hold regular meetings on dates
121	127		set by the board and special meetings at the call of the chairman.
122	128		[The Nolan County Commissioners Court, the Sweetwater City
123	129		Commission, and the board of trustees of the Sweetwater Independent
124	130		School District may agree to provide the funds for the salaries of
125	131		the personnel assigned to Nolan County and the other expenses the
126	132		board chairman certifies as necessary to provide adequate juvenile
127	133		services to Nolan County. The commissioners court, city council,
128	134		and board of trustees shall each provide one-third of the funds.]
129	135		(g) The juvenile board shall designate the treasurer or
130	136		auditor of Fisher County, Mitchell County, or Nolan County to serve
131	137		as the board's fiscal officer. [The board member appointed by the
132	138		Sweetwater Independent School District under Subsection (a)(5) may
133	139		be appointed only if that school district agrees to provide funds
134	140		for the salaries of the personnel assigned to Nolan County and other
135	141		expenses the board chairman certifies as necessary to provide
136	142		adequate juvenile services to Nolan County as provided by
137	143		Subsection (d).]
138	144		(h) The juvenile board shall appoint an advisory council
139	145		composed of one person from each county.
140	146		SECTION 4. The following provisions of the Human Resources
141	147		Code are repealed:
142	148		(1) Sections 152.0821(c), (d), (e), (f), and (g);
143	149		(2) Sections 152.1741(c), (d), (e), (f), and (g); and
144	150		(3) Section 152.1831(f).
145	151		SECTION 5. This Act takes effect October 1, 2017.
