| 7 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 15 | | SECTION 1. The heading to Section 8824.151, Special |
|---|
| 9 | 16 | | District Local Laws Code, is amended to read as follows: |
|---|
| 10 | 17 | | Sec. 8824.151. DISTRICT REVENUE AND FEES. |
|---|
| 11 | 18 | | SECTION 2. Section 8824.151(a), Special District Local Laws |
|---|
| 12 | 19 | | Code, is amended to read as follows: |
|---|
| 13 | 20 | | (a) To accomplish the regulatory goals of the district, pay |
|---|
| 14 | 21 | | the maintenance and operating costs of the district, and [to] pay |
|---|
| 15 | 22 | | any bonds or notes issued by the district, the district may: |
|---|
| 16 | 23 | | (1) impose ad valorem taxes at a rate not to exceed |
|---|
| 17 | 24 | | three cents on each $100 of assessed valuation of taxable property |
|---|
| 18 | 25 | | in the district; [or] |
|---|
| 19 | 26 | | (2) assess production fees as authorized by Section |
|---|
| 20 | 27 | | 36.205, Water Code; |
|---|
| 21 | 28 | | (3) solicit and accept grants from any public or |
|---|
| 22 | 29 | | private source; |
|---|
| 23 | 30 | | (4) assess an export fee on water [reasonable fees |
|---|
| 24 | 31 | | for: |
|---|
| 25 | 32 | | [(A) services provided; |
|---|
| 26 | 33 | | [(B) water withdrawn from each well that is not |
|---|
| 27 | 34 | | exempt from district permitting or regulation; or |
|---|
| 28 | 35 | | [(C) groundwater] exported from the district in |
|---|
| 29 | 36 | | an amount not to exceed 150 percent of the maximum wholesale water |
|---|
| 30 | 37 | | rate charged by the City of Houston; and |
|---|
| 31 | 38 | | (5) assess other fees authorized under Chapter 36, |
|---|
| 32 | 39 | | Water Code. |

| 33 | 40 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 43 | | Act does not receive the vote necessary for immediate effect, this |

| 37 | 44 | | Act takes effect September 1, 2017. |
