410 AN ACT
511 relating to the temporary board of and financing of certain
612 facilities and improvements by the LaSalle Municipal Utility
713 District No. 2; providing authority to impose an assessment.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Sections 8473.052(a) and (b), Special District
1016 Local Laws Code, are amended to read as follows:
1117 (a) The temporary board consists of:
1218 (1) Kevin Bales;
1319 (2) Tol S. Higginbotham IV;
1420 (3) Mark Baldwin;
1521 (4) Brannin Prideaux; and
1622 (5) Chris Synan [On or after the effective date of the
1723 Act enacting this chapter, the owner or owners of a majority of the
1824 assessed value of the real property in the district may submit a
1925 petition to the commission requesting that the commission appoint
2026 as temporary directors the five persons named in the petition. The
2127 commission shall appoint as temporary directors the five persons
2228 named in the petition].
2329 (b) Temporary directors serve until the earlier of:
2430 (1) the date permanent directors are elected under
2531 Section 8473.003; or
2632 (2) the fourth anniversary of the effective date of
2733 their designation [the Act enacting this chapter].
2834 SECTION 2. Chapter 8473, Special District Local Laws Code,
2935 is amended by adding Subchapter F to read as follows:
3036 SUBCHAPTER F. ASSESSMENTS; APPLICABILITY OF ASSESSMENTS
3137 Sec. 8473.251. PETITION REQUIRED FOR FINANCING
3238 IMPROVEMENTS AND RECREATIONAL FACILITIES WITH ASSESSMENTS. (a)
3339 Except as provided by this subchapter, the board may finance the
3440 construction or maintenance of a recreational facility or
3541 improvement with assessments on property under this subchapter only
3642 if:
3743 (1) a written petition requesting that facility or
3844 improvement has been filed with the board; and
3945 (2) the board holds a hearing on the proposed
4046 assessments.
4147 (b) The petition must be signed by the owners of a majority
4248 of the assessed value of real property in the district subject to
4349 assessment according to the most recent certified tax appraisal
4450 roll for the county.
4551 Sec. 8473.252. MISCELLANEOUS DESIGN, CONSTRUCTION, AND
4652 MAINTENANCE. An improvement or recreational facility project may
4753 include the planning, design, construction, improvement, and
4854 maintenance of:
4955 (1) landscaping;
5056 (2) marinas and bridges;
5157 (3) lighting, banners, and signs;
5258 (4) hiking and cycling paths or trails;
5359 (5) sidewalks, pedestrian walkways, skywalks,
5460 crosswalks, or tunnels;
5561 (6) ponds, lakes, recreational facilities, or scenic
5662 areas;
5763 (7) plazas or pedestrian malls;
5864 (8) drainage or navigation improvements; or
5965 (9) solid waste, water, sewer, or power facilities,
6066 including electrical and gas power facilities.
6167 Sec. 8473.253. METHOD OF NOTICE FOR HEARING. The district
6268 shall mail notice of the hearing to each property owner in the
6369 district who will be subject to the assessment at the current
6470 address to be assessed as reflected on the tax rolls. The district
6571 may mail the notice by certified or first class United States mail.
6672 The board shall determine the method of notice.
6773 Sec. 8473.254. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a) An
6874 assessment or a reassessment imposed under this subchapter by the
6975 district, penalties and interest on an assessment or reassessment,
7076 an expense of collection, and reasonable attorney's fees incurred
7177 by the district:
7278 (1) are a first and prior lien against the property
7379 assessed;
7480 (2) are superior to any other lien or claim other than
7581 a lien or claim for county, school district, or municipal ad valorem
7682 taxes; and
7783 (3) are the personal liability of and a charge against
7884 the owners of the property even if the owners are not named in the
7985 assessment proceedings.
8086 (b) The lien is effective from the date of the board's
8187 resolution imposing the assessment until the date the assessment is
8288 paid. The board may enforce the lien in the same manner that the
8389 board may enforce an ad valorem tax lien against real property.
8490 (c) The board may make a correction to or deletion from the
8591 assessment roll that does not increase the amount of assessment of
8692 any parcel of land without providing notice and holding a hearing in
8793 the manner required for additional assessments.
8894 Sec. 8473.255. UTILITY PROPERTY EXEMPT FROM ASSESSMENTS.
8995 The district may not impose an assessment on the property,
9096 including the equipment, rights-of-way, facilities, or
9197 improvements, of:
9298 (1) an electric utility or a power generation company
9399 as defined by Section 31.002, Utilities Code;
94100 (2) a gas utility as defined by Section 101.003 or
95101 121.001, Utilities Code;
96102 (3) a telecommunications provider as defined by
97103 Section 51.002, Utilities Code; or
98104 (4) a person who provides to the public cable
99105 television or advanced telecommunications services.
100106 SECTION 3. Section 2, Chapter 626, Acts of the 83rd
101107 Legislature, Regular Session, 2013, is amended to read as follows:
102108 Sec. 2. The LaSalle Municipal Utility District No. 2

287293 SECTION 4. (a) All governmental and proprietary actions of
288294 the LaSalle Municipal Utility District No. 2 taken before the
289295 effective date of this Act, including the creation of the district,
290296 the consent to create the district granted by the City of San
291297 Marcos, the consent agreement relating to the district and any
292298 amendments to that agreement, and any extension of time in which to
293299 hold a confirmation election for the district, are validated,
294300 ratified, and confirmed in all respects.
295301 (b) This section does not apply to any matter that on the
296302 effective date of this Act:
297303 (1) is involved in litigation if the litigation
298304 ultimately results in the matter being held invalid by a final court
299305 judgment; or
300306 (2) has been held invalid by a final court judgment.
301307 SECTION 5. (a) The legal notice of the intention to
302308 introduce this Act, setting forth the general substance of this
303309 Act, has been published as provided by law, and the notice and a
304310 copy of this Act have been furnished to all persons, agencies,
305311 officials, or entities to which they are required to be furnished
306312 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
307313 Government Code.
308314 (b) The governor, one of the required recipients, has
309315 submitted the notice and Act to the Texas Commission on
310316 Environmental Quality.
311317 (c) The Texas Commission on Environmental Quality has filed
312318 its recommendations relating to this Act with the governor, the
313319 lieutenant governor, and the speaker of the house of
314320 representatives within the required time.
315321 (d) All requirements of the constitution and laws of this
316322 state and the rules and procedures of the legislature with respect
317323 to the notice, introduction, and passage of this Act are fulfilled
318324 and accomplished.
319325 SECTION 6. For purposes of Section 8473.052(b)(2), Special
320326 District Local Laws Code, as amended by this Act, the effective date
321327 of the temporary directors' designation is the effective date of
322328 this Act.
323329 SECTION 7. This Act takes effect immediately if it receives
324330 a vote of two-thirds of all the members elected to each house, as
325331 provided by Section 39, Article III, Texas Constitution. If this
326332 Act does not receive the vote necessary for immediate effect, this
327333 Act takes effect September 1, 2017.
