8	6		AN ACT
9	7		relating to the creation of the River Ranch Municipal Utility
10		-	District of Liberty County and the Riverside Municipal Utility
11	8		District of Liberty County; granting a limited power of eminent
12	9		domain; providing authority to issue bonds; providing authority to
13	10		impose assessments, fees, or taxes.
14	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	12		SECTION 1. Subtitle F, Title 6, Special District Local Laws
16	13		Code, is amended by adding Chapter 7991 to read as follows:
17	14		CHAPTER 7991. RIVER RANCH MUNICIPAL UTILITY DISTRICT OF LIBERTY
18	15		COUNTY
19	16		SUBCHAPTER A. GENERAL PROVISIONS
20	17		Sec. 7991.001. DEFINITIONS. In this chapter:
21	18		(1) "Board" means the district's board of directors.
22	19		(2) "Commission" means the Texas Commission on
23	20		Environmental Quality.
24	21		(3) "Director" means a board member.
25	22		(4) "District" means the River Ranch Municipal Utility
26	23		District of Liberty County.
27	24		Sec. 7991.002. NATURE OF DISTRICT. The district is a
28	25		municipal utility district created under Section 59, Article XVI,
29	26		Texas Constitution.
30	27		Sec. 7991.003. CONFIRMATION AND DIRECTORS' ELECTION
31	28		REQUIRED. The temporary directors shall hold an election to
32	29		confirm the creation of the district and to elect five permanent
33	30		directors as provided by Section 49.102, Water Code.
34	31		Sec. 7991.004. CONSENT OF MUNICIPALITY REQUIRED. The
35	32		temporary directors may not hold an election under Section 7991.003
36	33		until each municipality in whose corporate limits or
37	34		extraterritorial jurisdiction the district is located has
38	35		consented by ordinance or resolution to the creation of the
39	36		district and to the inclusion of land in the district.
40	37		Sec. 7991.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
41	38		The district is created to serve a public purpose and benefit.
42	39		(b) The district is created to accomplish the purposes of:
43	40		(1) a municipal utility district as provided by
44	41		general law and Section 59, Article XVI, Texas Constitution; and
45	42		(2) Section 52, Article III, Texas Constitution, that
46	43		relate to the construction, acquisition, or improvement of
47	44		macadamized, graveled, or paved roads or improvements, including
48	45		storm drainage, in aid of those roads.
49	46		Sec. 7991.006. INITIAL DISTRICT TERRITORY. (a) The
50	47		district is initially composed of the territory described by
51	48		Section 2 of the Act enacting this chapter.
52	49		(b) The boundaries and field notes contained in Section 2 of
53	50		the Act enacting this chapter form a closure. A mistake made in the
54	51		field notes or in copying the field notes in the legislative process
55	52		does not affect the district's:
56	53		(1) organization, existence, or validity;
57	54		(2) right to issue any type of bond for the purposes
58	55		for which the district is created or to pay the principal of and
59	56		interest on a bond;
60	57		(3) right to impose a tax; or
61	58		(4) legality or operation.
62	59		SUBCHAPTER B. BOARD OF DIRECTORS
63	60		Sec. 7991.051. GOVERNING BODY; TERMS. (a) The district is
64	61		governed by a board of five elected directors.
65	62		(b) Except as provided by Section 7991.052, directors serve
66	63		staggered four-year terms.
67	64		Sec. 7991.052. TEMPORARY DIRECTORS. (a) The temporary
68	65		board consists of:

74	71		(b) Temporary directors serve until the earlier of:
75	72		(1) the date permanent directors are elected under
76	73		Section 7991.003; or
77	74		(2) September 1, 2021.
78	75		(c) If permanent directors have not been elected under
79	76		Section 7991.003 and the terms of the temporary directors have
80	77		expired, successor temporary directors shall be appointed or
81	78		reappointed as provided by Subsection (d) to serve terms that
82	79		expire on the earlier of:
83	80		(1) the date permanent directors are elected under
84	81		Section 7991.003; or
85	82		(2) the fourth anniversary of the date of the
86	83		appointment or reappointment.
87	84		(d) If Subsection (c) applies, the owner or owners of a
88	85		majority of the assessed value of the real property in the district
89	86		may submit a petition to the commission requesting that the
90	87		commission appoint as successor temporary directors the five
91	88		persons named in the petition. The commission shall appoint as
92	89		successor temporary directors the five persons named in the
93	90		petition.
94	91		SUBCHAPTER C. POWERS AND DUTIES
95	92		Sec. 7991.101. GENERAL POWERS AND DUTIES. The district has
96	93		the powers and duties necessary to accomplish the purposes for
97	94		which the district is created.
98	95		Sec. 7991.102. MUNICIPAL UTILITY DISTRICT POWERS AND
99	96		DUTIES. The district has the powers and duties provided by the
100	97		general law of this state, including Chapters 49 and 54, Water Code,
101	98		applicable to municipal utility districts created under Section 59,
102	99		Article XVI, Texas Constitution.
103	100		Sec. 7991.103. AUTHORITY FOR ROAD PROJECTS. Under Section
104	101		52, Article III, Texas Constitution, the district may design,
105	102		acquire, construct, finance, issue bonds for, improve, and convey
106	103		to this state, a county, or a municipality for operation and
107	104		maintenance macadamized, graveled, or paved roads or improvements,
108	105		including storm drainage, in aid of those roads.
109	106		Sec. 7991.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
110	107		project must meet all applicable construction standards, zoning and
111	108		subdivision requirements, and regulations of each municipality in
112	109		whose corporate limits or extraterritorial jurisdiction the road
113	110		project is located.
114	111		(b) If a road project is not located in the corporate limits
115	112		or extraterritorial jurisdiction of a municipality, the road
116	113		project must meet all applicable construction standards,
117	114		subdivision requirements, and regulations of each county in which
118	115		the road project is located.
119	116		(c) If the state will maintain and operate the road, the
120	117		Texas Transportation Commission must approve the plans and
121	118		specifications of the road project.
122	119		Sec. 7991.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
123	120		OR RESOLUTION. The district shall comply with all applicable
124	121		requirements of any ordinance or resolution that is adopted under
125	122		Section 54.016 or 54.0165, Water Code, and that consents to the
126	123		creation of the district or to the inclusion of land in the
127	124		district.
128	125		Sec. 7991.106. DIVISION OF DISTRICT. (a) The district may
129	126		be divided into two or more new districts only if:
130	127		(1) the district has no outstanding bonded debt;
131	128		(2) the district is not imposing ad valorem taxes; and
132	129		(3) the requirements of Subsection (k) have been met.
133	130		(b) This chapter applies to any new district created by the
134	131		division of the district, and a new district has all the powers and
135	132		duties of the district.
136	133		(c) Any new district created by the division of the district
137	134		may not, at the time the new district is created, contain any land
138		-	outside the area described by Section 2 of the Act ~~enacting~~ this
	135	+	outside the area described by Section 2 of the Act creating this
139	136		chapter.
140	137		(d) The board, on its own motion or on receipt of a petition
141	138		signed by the owner or owners of a majority of the assessed value of
142	139		the real property in the district, may adopt an order dividing the
143	140		district.
144	141		(e) The board may adopt an order dividing the district
145	142		before or after the date the board holds an election under Section
146	143		7991.003 to confirm the creation of the district.
147	144		(f) An order dividing the district shall:
148	145		(1) name each new district;
149	146		(2) include the metes and bounds description of the
150	147		territory of each new district;
151	148		(3) appoint temporary directors for each new district;
152	149		and
153	150		(4) provide for the division of assets and liabilities
154	151		between or among the new districts.
155	152		(g) On or before the 30th day after the date of adoption of
156	153		an order dividing the district, the district shall file the order
157	154		with the commission and record the order in the real property
158	155		records of each county in which the district is located.
159	156		(h) Any new district created by the division of the district
160	157		shall hold a confirmation and directors' election as required by
161	158		Section 7991.003.
162	159		(i) If the creation of the new district is confirmed, the
163	160		new district shall provide the election date and results to the
164	161		commission.
165	162		(j) Any new district created by the division of the district
166	163		must hold an election as required by this chapter to obtain voter
167	164		approval before the district may impose a maintenance tax or issue
168	165		bonds payable wholly or partly from ad valorem taxes.
169	166		(k) If the district is located wholly or partly in the
170	167		corporate limits or the extraterritorial jurisdiction of a
171	168		municipality, the district may not divide under this section unless
172	169		the municipality by resolution or ordinance consents to the
173	170		division of the district. If the district is not located wholly or
174	171		partly in the corporate limits or extraterritorial jurisdiction of
175	172		a municipality, the district may not divide under this section
176	173		unless the commissioners court of each county in which the district
177	174		is wholly or partly located adopts a resolution or order consenting
178	175		to the division of the district.
179	176		Sec. 7991.107. LIMITATION ON USE OF EMINENT DOMAIN. The
180	177		district may not exercise the power of eminent domain outside the
181	178		district to acquire a site or easement for:
182	179		(1) a road project authorized by Section 7991.103; or
183	180		(2) a recreational facility as defined by Section
184	181		49.462, Water Code.
185	182		SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
186	183		Sec. 7991.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
187	184		district may issue, without an election, bonds and other
188	185		obligations secured by revenue other than ad valorem taxes.
189	186		(b) The district must hold an election in the manner
190	187		provided by Chapters 49 and 54, Water Code, to obtain voter approval
191	188		before the district may impose an ad valorem tax or issue bonds
192	189		payable from ad valorem taxes.
193	190		(c) The district may not issue bonds payable from ad valorem
194	191		taxes to finance a road project unless the issuance is approved by a
195	192		vote of a two-thirds majority of the district voters voting at an
196	193		election held for that purpose.
197	194		Sec. 7991.152. OPERATION AND MAINTENANCE TAX. (a) If
198	195		authorized at an election held under Section 7991.151, the district
199	196		may impose an operation and maintenance tax on taxable property in
200	197		the district in accordance with Section 49.107, Water Code.
201	198		(b) The board shall determine the tax rate. The rate may not
202	199		exceed the rate approved at the election.
203	200		Sec. 7991.153. CONTRACT TAXES. (a) In accordance with
204	201		Section 49.108, Water Code, the district may impose a tax other than
205	202		an operation and maintenance tax and use the revenue derived from
206	203		the tax to make payments under a contract after the provisions of
207	204		the contract have been approved by a majority of the district voters
208	205		voting at an election held for that purpose.
209	206		(b) A contract approved by the district voters may contain a
210	207		provision stating that the contract may be modified or amended by
211	208		the board without further voter approval.
212	209		Sec. 7991.154. WATER AND SEWER RATES. Notwithstanding any
213	210		other law, the district shall establish the same rates for
214	211		residential and commercial classes of customers for the provision
215	212		of water and sewer services. For purposes of this section, the
216	213		commercial class may not include apartment complexes or other
217	214		multifamily dwellings.
218	215		SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
219	216		Sec. 7991.201. AUTHORITY TO ISSUE BONDS AND OTHER
220	217		OBLIGATIONS. The district may issue bonds or other obligations
221	218		payable wholly or partly from ad valorem taxes, impact fees,
222	219		revenue, contract payments, grants, or other district money, or any
223	220		combination of those sources, to pay for any authorized district
224	221		purpose.
225	222		Sec. 7991.202. TAXES FOR BONDS. At the time the district
226	223		issues bonds payable wholly or partly from ad valorem taxes, the
227	224		board shall provide for the annual imposition of a continuing
228	225		direct ad valorem tax, without limit as to rate or amount, while all
229	226		or part of the bonds are outstanding as required and in the manner
230	227		provided by Sections 54.601 and 54.602, Water Code.
231	228		Sec. 7991.203. BONDS FOR ROAD PROJECTS. At the time of
232	229		issuance, the total principal amount of bonds or other obligations
233	230		issued or incurred to finance road projects and payable from ad
234	231		valorem taxes may not exceed one-fourth of the assessed value of the
235	232		real property in the district.
236	233		SECTION 2. The River Ranch Municipal Utility District of
237	234		Liberty County initially includes all the territory contained in
238	235		the following area:
239		-	Being 6980.02 acres of land situated in the William Bloodgood
240		-	Survey, Abstract 3, the William D. Smith Survey, Abstract 106, the
241		-	H. E. & W. RR. Number 1131 Survey, Abstract 515, the William E.
242		-	Kierstead Survey, Abstract 693, the George Pace Survey, Abstract
243		-	805, the Louis Davis Survey, Abstract 18, the A. P. Blackwell
244		-	Survey, Abstract 782, the Robert Wiseman Survey, Abstract 392, and
245		-	the T. & N. O. RR. Survey, Abstract 383, in Liberty County, Texas,
246		-	and being the residue of that called 7449.781 acres of land as
247		-	recorded in Liberty County Clerk's File Number 2009008952 and being
248		-	more particularly described by metes and bounds as follows;
249		-	BEGINNING, at a found five eighths inch iron rod, marking the most
250		-	northwesterly corner of said called 7450.588 acre tract, the

593		-	CHAPTER 8012. RIVERSIDE MUNICIPAL UTILITY DISTRICT OF LIBERTY
594		-	COUNTY
595		-	SUBCHAPTER A. GENERAL PROVISIONS
596		-	Sec. 8012.001. DEFINITIONS. In this chapter:
597		-	(1) "Board" means the district's board of directors.
598		-	(2) "Commission" means the Texas Commission on
599		-	Environmental Quality.
600		-	(3) "Director" means a board member.
601		-	(4) "District" means the Riverside Municipal Utility
602		-	District of Liberty County.
603		-	Sec. 8012.002. NATURE OF DISTRICT. The district is a
604		-	municipal utility district created under Section 59, Article XVI,
605		-	Texas Constitution.
606		-	Sec. 8012.003. CONFIRMATION AND DIRECTORS' ELECTION
607		-	REQUIRED. The temporary directors shall hold an election to
608		-	confirm the creation of the district and to elect five permanent
609		-	directors as provided by Section 49.102, Water Code.
610		-	Sec. 8012.004. CONSENT OF MUNICIPALITY REQUIRED. The
611		-	temporary directors may not hold an election under Section 8012.003
612		-	until each municipality in whose corporate limits or
613		-	extraterritorial jurisdiction the district is located has
614		-	consented by ordinance or resolution to the creation of the
615		-	district and to the inclusion of land in the district.
616		-	Sec. 8012.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
617		-	The district is created to serve a public purpose and benefit.
618		-	(b) The district is created to accomplish the purposes of:
619		-	(1) a municipal utility district as provided by
620		-	general law and Section 59, Article XVI, Texas Constitution; and
621		-	(2) Section 52, Article III, Texas Constitution, that
622		-	relate to the construction, acquisition, or improvement of
623		-	macadamized, graveled, or paved roads or improvements, including
624		-	storm drainage, in aid of those roads.
625		-	Sec. 8012.006. INITIAL DISTRICT TERRITORY. (a) The
626		-	district is initially composed of the territory described by
627		-	Section 4 of the Act enacting this chapter.
628		-	(b) The boundaries and field notes contained in Section 4 of
629		-	the Act enacting this chapter form a closure. A mistake made in the
630		-	field notes or in copying the field notes in the legislative process
631		-	does not affect the district's:
632		-	(1) organization, existence, or validity;
633		-	(2) right to issue any type of bond for the purposes
634		-	for which the district is created or to pay the principal of and
635		-	interest on a bond;
636		-	(3) right to impose a tax; or
637		-	(4) legality or operation.
638		-	SUBCHAPTER B. BOARD OF DIRECTORS
639		-	Sec. 8012.051. GOVERNING BODY; TERMS. (a) The district is
640		-	governed by a board of five elected directors.
641		-	(b) Except as provided by Section 8012.052, directors serve
642		-	staggered four-year terms.
643		-	Sec. 8012.052. TEMPORARY DIRECTORS. (a) The temporary
644		-	board consists of:
645		-	(1) Will King;
646		-	(2) Micky Redus;
647		-	(3) Jim Smesny;
648		-	(4) Dorothy Badgett; and
649		-	(5) Daniel Walker.
650		-	(b) Temporary directors serve until the earlier of:
651		-	(1) the date permanent directors are elected under
652		-	Section 8012.003; or
653		-	(2) September 1, 2021.
654		-	(c) If permanent directors have not been elected under
655		-	Section 8012.003 and the terms of the temporary directors have
656		-	expired, successor temporary directors shall be appointed or
657		-	reappointed as provided by Subsection (d) to serve terms that
658		-	expire on the earlier of:
659		-	(1) the date permanent directors are elected under
660		-	Section 8012.003; or
661		-	(2) the fourth anniversary of the date of the
662		-	appointment or reappointment.
663		-	(d) If Subsection (c) applies, the owner or owners of a
664		-	majority of the assessed value of the real property in the district
665		-	may submit a petition to the commission requesting that the
666		-	commission appoint as successor temporary directors the five
667		-	persons named in the petition. The commission shall appoint as
668		-	successor temporary directors the five persons named in the
669		-	petition.
670		-	SUBCHAPTER C. POWERS AND DUTIES
671		-	Sec. 8012.101. GENERAL POWERS AND DUTIES. The district has
672		-	the powers and duties necessary to accomplish the purposes for
673		-	which the district is created.
674		-	Sec. 8012.102. MUNICIPAL UTILITY DISTRICT POWERS AND
675		-	DUTIES. The district has the powers and duties provided by the
676		-	general law of this state, including Chapters 49 and 54, Water Code,
677		-	applicable to municipal utility districts created under Section 59,
678		-	Article XVI, Texas Constitution.
679		-	Sec. 8012.103. AUTHORITY FOR ROAD PROJECTS. Under Section
680		-	52, Article III, Texas Constitution, the district may design,
681		-	acquire, construct, finance, issue bonds for, improve, and convey
682		-	to this state, a county, or a municipality for operation and
683		-	maintenance macadamized, graveled, or paved roads or improvements,
684		-	including storm drainage, in aid of those roads.
685		-	Sec. 8012.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
686		-	project must meet all applicable construction standards, zoning and
687		-	subdivision requirements, and regulations of each municipality in
688		-	whose corporate limits or extraterritorial jurisdiction the road
689		-	project is located.
690		-	(b) If a road project is not located in the corporate limits
691		-	or extraterritorial jurisdiction of a municipality, the road
692		-	project must meet all applicable construction standards,
693		-	subdivision requirements, and regulations of each county in which
694		-	the road project is located.
695		-	(c) If the state will maintain and operate the road, the
696		-	Texas Transportation Commission must approve the plans and
697		-	specifications of the road project.
698		-	Sec. 8012.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
699		-	OR RESOLUTION. The district shall comply with all applicable
700		-	requirements of any ordinance or resolution that is adopted under
701		-	Section 54.016 or 54.0165, Water Code, and that consents to the
702		-	creation of the district or to the inclusion of land in the
703		-	district.
704		-	Sec. 8012.106. DIVISION OF DISTRICT. (a) The district may
705		-	be divided into two or more new districts only if:
706		-	(1) the district has no outstanding bonded debt;
707		-	(2) the district is not imposing ad valorem taxes; and
708		-	(3) the requirements of Subsection (k) have been met.
709		-	(b) This chapter applies to any new district created by the
710		-	division of the district, and a new district has all the powers and
711		-	duties of the district.
712		-	(c) Any new district created by the division of the district
713		-	may not, at the time the new district is created, contain any land
714		-	outside the area described by Section 4 of the Act enacting this
715		-	chapter.
716		-	(d) The board, on its own motion or on receipt of a petition
717		-	signed by the owner or owners of a majority of the assessed value of
718		-	the real property in the district, may adopt an order dividing the
719		-	district.
720		-	(e) The board may adopt an order dividing the district
721		-	before or after the date the board holds an election under Section
722		-	8012.003 to confirm the creation of the district.
723		-	(f) An order dividing the district shall:
724		-	(1) name each new district;
725		-	(2) include the metes and bounds description of the
726		-	territory of each new district;
727		-	(3) appoint temporary directors for each new district;
728		-	and
729		-	(4) provide for the division of assets and liabilities
730		-	between or among the new districts.
731		-	(g) On or before the 30th day after the date of adoption of
732		-	an order dividing the district, the district shall file the order
733		-	with the commission and record the order in the real property
734		-	records of each county in which the district is located.
735		-	(h) Any new district created by the division of the district
736		-	shall hold a confirmation and directors' election as required by
737		-	Section 8012.003.
738		-	(i) If the creation of the new district is confirmed, the
739		-	new district shall provide the election date and results to the
740		-	commission.
741		-	(j) Any new district created by the division of the district
742		-	must hold an election as required by this chapter to obtain voter
743		-	approval before the district may impose a maintenance tax or issue
744		-	bonds payable wholly or partly from ad valorem taxes.
745		-	(k) If the district is located wholly or partly in the
746		-	corporate limits or the extraterritorial jurisdiction of a
747		-	municipality, the district may not divide under this section unless
748		-	the municipality by resolution or ordinance consents to the
749		-	division of the district. If the district is not located wholly or
750		-	partly in the corporate limits or extraterritorial jurisdiction of
751		-	a municipality, the district may not divide under this section
752		-	unless the commissioners court of each county in which the district
753		-	is wholly or partly located adopts a resolution or order consenting
754		-	to the division of the district.
755		-	Sec. 8012.107. LIMITATION ON USE OF EMINENT DOMAIN. The
756		-	district may not exercise the power of eminent domain outside the
757		-	district to acquire a site or easement for:
758		-	(1) a road project authorized by Section 8012.103; or
759		-	(2) a recreational facility as defined by Section
760		-	49.462, Water Code.
761		-	SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
762		-	Sec. 8012.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
763		-	district may issue, without an election, bonds and other
764		-	obligations secured by revenue other than ad valorem taxes.
765		-	(b) The district must hold an election in the manner
766		-	provided by Chapters 49 and 54, Water Code, to obtain voter approval
767		-	before the district may impose an ad valorem tax or issue bonds
768		-	payable from ad valorem taxes.
769		-	(c) The district may not issue bonds payable from ad valorem
770		-	taxes to finance a road project unless the issuance is approved by a
771		-	vote of a two-thirds majority of the district voters voting at an
772		-	election held for that purpose.
773		-	Sec. 8012.152. OPERATION AND MAINTENANCE TAX. (a) If
774		-	authorized at an election held under Section 8012.151, the district
775		-	may impose an operation and maintenance tax on taxable property in
776		-	the district in accordance with Section 49.107, Water Code.
777		-	(b) The board shall determine the tax rate. The rate may not
778		-	exceed the rate approved at the election.
779		-	Sec. 8012.153. CONTRACT TAXES. (a) In accordance with
780		-	Section 49.108, Water Code, the district may impose a tax other than
781		-	an operation and maintenance tax and use the revenue derived from
782		-	the tax to make payments under a contract after the provisions of
783		-	the contract have been approved by a majority of the district voters
784		-	voting at an election held for that purpose.
785		-	(b) A contract approved by the district voters may contain a
786		-	provision stating that the contract may be modified or amended by
787		-	the board without further voter approval.
788		-	Sec. 8012.154. WATER AND SEWER RATES. Notwithstanding any
789		-	other law, the district shall establish the same rates for
790		-	residential and commercial classes of customers for the provision
791		-	of water and sewer services. For purposes of this section, the
792		-	commercial class may not include apartment complexes or other
793		-	multifamily dwellings.
794		-	SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
795		-	Sec. 8012.201. AUTHORITY TO ISSUE BONDS AND OTHER
796		-	OBLIGATIONS. The district may issue bonds or other obligations
797		-	payable wholly or partly from ad valorem taxes, impact fees,
798		-	revenue, contract payments, grants, or other district money, or any
799		-	combination of those sources, to pay for any authorized district
800		-	purpose.
801		-	Sec. 8012.202. TAXES FOR BONDS. At the time the district
802		-	issues bonds payable wholly or partly from ad valorem taxes, the
803		-	board shall provide for the annual imposition of a continuing
804		-	direct ad valorem tax, without limit as to rate or amount, while all
805		-	or part of the bonds are outstanding as required and in the manner
806		-	provided by Sections 54.601 and 54.602, Water Code.
807		-	Sec. 8012.203. BONDS FOR ROAD PROJECTS. At the time of
808		-	issuance, the total principal amount of bonds or other obligations
809		-	issued or incurred to finance road projects and payable from ad
810		-	valorem taxes may not exceed one-fourth of the assessed value of the
811		-	real property in the district.
812		-	SECTION 4. The Riverside Municipal Utility District of
813		-	Liberty County initially includes all the territory contained in
814		-	the following area:
815		-	Being 482.631 acres of land out of a called 1454.19 acres, more or
816		-	less, in and out of that certain "called" 1517 acres, in the John A.

948	729		(b) The governor, one of the required recipients, has
949	730		submitted the notice and Act to the Texas Commission on
950	731		Environmental Quality.
951	732		(c) The Texas Commission on Environmental Quality has filed
952	733		its recommendations relating to this Act with the governor, the
953	734		lieutenant governor, and the speaker of the house of
954	735		representatives within the required time.
955	736		(d) All requirements of the constitution and laws of this
956	737		state and the rules and procedures of the legislature with respect
957	738		to the notice, introduction, and passage of this Act are fulfilled
958	739		and accomplished.

973		-	Local Laws Code, as added by Section 3 of this Act, is amended by
974		-	adding Section 8012.107 to read as follows:

977	750		(c) This section is not intended to be an expression of a
978	751		legislative interpretation of the requirements of Section 17(c),

980		-	SECTION 7. This Act takes effect June 1, 2017, if it
