410 AN ACT
511 relating to the creation of Harris County Improvement District No.
612 25; providing authority to levy an assessment, impose a tax, and
713 issue bonds.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1016 Code, is amended by adding Chapter 3958 to read as follows:
1117 CHAPTER 3958. HARRIS COUNTY IMPROVEMENT DISTRICT NO. 25
1218 SUBCHAPTER A. GENERAL PROVISIONS
1319 Sec. 3958.001. DEFINITIONS. In this chapter:
1420 (1) "Board" means the district's board of directors.
1521 (2) "County" means Harris County.
1622 (3) "Director" means a board member.
1723 (4) "District" means the Harris County Improvement
1824 District No. 25.
1925 Sec. 3958.002. CREATION AND NATURE OF DISTRICT. The
2026 district is a special district created under Section 59, Article
2127 XVI, Texas Constitution.
2228 Sec. 3958.003. PURPOSE; DECLARATION OF INTENT. (a) The
2329 creation of the district is essential to accomplish the purposes of
2430 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
2531 Texas Constitution, and other public purposes stated in this
2632 chapter. By creating the district and in authorizing the county and
2733 other political subdivisions to contract with the district, the
2834 legislature has established a program to accomplish the public
2935 purposes set out in Section 52-a, Article III, Texas Constitution.
3036 (b) The creation of the district is necessary to promote,
3137 develop, encourage, and maintain employment, commerce,
3238 transportation, housing, tourism, recreation, the arts,
3339 entertainment, economic development, safety, and the public
3440 welfare in the district.
3541 (c) This chapter and the creation of the district may not be
3642 interpreted to relieve the county from providing the level of
3743 services provided as of the effective date of the Act enacting this
3844 chapter to the area in the district. The district is created to
3945 supplement and not to supplant county services provided in the
4046 district.
4147 Sec. 3958.004. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. (a)
4248 The district is created to serve a public use and benefit.
4349 (b) All land and other property included in the district
4450 will benefit from the improvements and services to be provided by
4551 the district under powers conferred by Sections 52 and 52-a,
4652 Article III, and Section 59, Article XVI, Texas Constitution, and
4753 other powers granted under this chapter.
4854 (c) The creation of the district is in the public interest
4955 and is essential to further the public purposes of:
5056 (1) developing and diversifying the economy of the
5157 state;
5258 (2) eliminating unemployment and underemployment; and
5359 (3) developing or expanding transportation and
5460 commerce.
5561 (d) The district will:
5662 (1) promote the health, safety, and general welfare of
5763 residents, employers, potential employees, employees, visitors,
5864 and consumers in the district, and of the public;
5965 (2) provide needed funding for the district to
6066 preserve, maintain, and enhance the economic health and vitality of
6167 the district territory as a community and business center;
6268 (3) promote the health, safety, welfare, and enjoyment
6369 of the public by providing pedestrian ways and by landscaping and
6470 developing certain areas in the district, which are necessary for
6571 the restoration, preservation, and enhancement of scenic beauty;
6672 and
6773 (4) provide for water, wastewater, drainage, road, and
6874 recreational facilities for the district.
6975 (e) Pedestrian ways along or across a street, whether at
7076 grade or above or below the surface, and street lighting, street
7177 landscaping, parking, and street art objects are parts of and
7278 necessary components of a street and are considered to be a street
7379 or road improvement.
7480 (f) The district will not act as the agent or
7581 instrumentality of any private interest even though the district
7682 will benefit many private interests as well as the public.
7783 Sec. 3958.005. INITIAL DISTRICT TERRITORY. (a) The
7884 district is initially composed of the territory described by
7985 Section 2 of the Act enacting this chapter.
8086 (b) The boundaries and field notes contained in Section 2 of
8187 the Act enacting this chapter form a closure. A mistake in the
8288 field notes or in copying the field notes in the legislative process
8389 does not affect the district's:
8490 (1) organization, existence, or validity;
8591 (2) right to issue any type of bonds for the purposes
8692 for which the district is created or to pay the principal of and
8793 interest on the bonds;
8894 (3) right to impose or collect an assessment or tax; or
8995 (4) legality or operation.
9096 Sec. 3958.006. APPLICABILITY OF MUNICIPAL MANAGEMENT
9197 DISTRICTS LAW. Except as otherwise provided by this chapter,
9298 Chapter 375, Local Government Code, applies to the district.
9399 Sec. 3958.007. CONSTRUCTION OF CHAPTER. This chapter shall
94100 be liberally construed in conformity with the findings and purposes
95101 stated in this chapter.
96102 SUBCHAPTER B. BOARD OF DIRECTORS
97103 Sec. 3958.051. GOVERNING BODY; TERMS. (a) The district is
98104 governed by a board of five voting directors who serve staggered
99105 terms of four years, with two or three directors' terms expiring
100106 June 1 of each odd-numbered year.
101107 (b) The board by resolution may change the number of voting
102108 directors on the board only if the board determines that the change
103109 is in the best interest of the district. The board may not consist
104110 of fewer than five or more than nine voting directors.
105111 Sec. 3958.052. APPOINTMENT OF VOTING DIRECTORS. The Texas
106112 Commission on Environmental Quality shall appoint voting directors
107113 from persons recommended by the board.
108114 Sec. 3958.053. NONVOTING DIRECTORS. The board may appoint
109115 nonvoting directors to serve at the pleasure of the voting
110116 directors.
111117 Sec. 3958.054. QUORUM. For purposes of determining the
112118 requirements for a quorum of the board, the following are not
113119 counted:
114120 (1) a board position vacant for any reason, including
115121 death, resignation, or disqualification;
116122 (2) a director who is abstaining from participation in
117123 a vote because of a conflict of interest; or
118124 (3) a nonvoting director.
119125 Sec. 3958.055. COMPENSATION. A director is entitled to
120126 receive fees of office and reimbursement for actual expenses as
121127 provided by Section 49.060, Water Code. Sections 375.069 and
122128 375.070, Local Government Code, do not apply to the board.
123129 Sec. 3958.056. INITIAL VOTING DIRECTORS. (a) On or after
124130 the effective date of the Act enacting this chapter, the owner or
125131 owners of a majority of the assessed value of the real property in
126132 the district according to the most recent certified tax appraisal
127133 roll for the county may submit a petition to the Texas Commission on
128134 Environmental Quality requesting that the commission appoint as
129135 initial voting directors the five persons named in the petition.
130136 The commission shall appoint the five persons named in the petition
131137 as initial directors by position.
132138 (b) Of the initial directors, the terms of directors
133139 appointed for positions one through three expire June 1, 2019, and
134140 the terms of directors appointed for positions four and five expire
135141 June 1, 2021.
136142 (c) Section 3958.052 does not apply to this section.
137143 (d) This section expires September 1, 2021.
138144 SUBCHAPTER C. POWERS AND DUTIES
139145 Sec. 3958.101. GENERAL POWERS AND DUTIES. The district has
140146 the powers and duties necessary to accomplish the purposes for
141147 which the district is created.
142148 Sec. 3958.102. IMPROVEMENT PROJECTS AND SERVICES. The
143149 district may provide, design, construct, acquire, improve,
144150 relocate, operate, maintain, or finance an improvement project or
145151 service using any money available to the district, or contract with
146152 a governmental or private entity to provide, design, construct,
147153 acquire, improve, relocate, operate, maintain, or finance an
148154 improvement project or service authorized under this chapter or
149155 Chapter 375, Local Government Code.
150156 Sec. 3958.103. DEVELOPMENT CORPORATION POWERS. The
151157 district, using money available to the district, may exercise the
152158 powers given to a development corporation under Chapter 505, Local
153159 Government Code, including the power to own, operate, acquire,
154160 construct, lease, improve, or maintain a project under that
155161 chapter.
156162 Sec. 3958.104. NONPROFIT CORPORATION. (a) The board by
157163 resolution may authorize the creation of a nonprofit corporation to
158164 assist and act for the district in implementing a project or
159165 providing a service authorized by this chapter.
160166 (b) The nonprofit corporation:
161167 (1) has each power of and is considered to be a local
162168 government corporation created under Subchapter D, Chapter 431,
163169 Transportation Code; and
164170 (2) may implement any project and provide any service
165171 authorized by this chapter.
166172 (c) The board shall appoint the board of directors of the
167173 nonprofit corporation. The board of directors of the nonprofit
168174 corporation shall serve in the same manner as the board of directors
169175 of a local government corporation created under Subchapter D,
170176 Chapter 431, Transportation Code, except that a board member is not
171177 required to reside in the district.
172178 Sec. 3958.105. AGREEMENTS; GRANTS. (a) As provided by
173179 Chapter 375, Local Government Code, the district may make an
174180 agreement with or accept a gift, grant, or loan from any person.
175181 (b) The implementation of a project is a governmental
176182 function or service for the purposes of Chapter 791, Government
177183 Code.
178184 Sec. 3958.106. LAW ENFORCEMENT SERVICES. To protect the
179185 public interest, the district may contract with a qualified party,
180186 including the county, to provide law enforcement services in the
181187 district for a fee.
182188 Sec. 3958.107. MEMBERSHIP IN CHARITABLE ORGANIZATIONS. The
183189 district may join and pay dues to a charitable or nonprofit
184190 organization that performs a service or provides an activity
185191 consistent with the furtherance of a district purpose.
186192 Sec. 3958.108. ECONOMIC DEVELOPMENT. (a) The district may
187193 engage in activities that accomplish the economic development
188194 purposes of the district.
189195 (b) The district may establish and provide for the
190196 administration of one or more programs to promote state or local
191197 economic development and to stimulate business and commercial
192198 activity in the district, including programs to:
193199 (1) make loans and grants of public money; and
194200 (2) provide district personnel and services.
195201 (c) The district may create economic development programs
196202 and exercise the economic development powers provided to
197203 municipalities by:
198204 (1) Chapter 380, Local Government Code; and
199205 (2) Subchapter A, Chapter 1509, Government Code.
200206 Sec. 3958.109. PARKING FACILITIES. (a) The district may
201207 acquire, lease as lessor or lessee, construct, develop, own,
202208 operate, and maintain parking facilities or a system of parking
203209 facilities, including lots, garages, parking terminals, or other
204210 structures or accommodations for parking motor vehicles off the
205211 streets and related appurtenances.
206212 (b) The district's parking facilities serve the public
207213 purposes of the district and are owned, used, and held for a public
208214 purpose even if leased or operated by a private entity for a term of
209215 years.
210216 (c) The district's parking facilities are part of and
211217 necessary components of a street and are considered to be a street
212218 or road improvement.
213219 (d) The development and operation of the district's parking
214220 facilities may be considered an economic development program.
215221 Sec. 3958.110. ANNEXATION OF LAND. The district may annex
216222 land as provided by Subchapter J, Chapter 49, Water Code.
217223 Sec. 3958.111. NO EMINENT DOMAIN POWER. The district may
218224 not exercise the power of eminent domain.
219225 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS; ASSESSMENTS
220226 Sec. 3958.151. DISBURSEMENTS AND TRANSFERS OF MONEY. The
221227 board by resolution shall establish the number of directors'
222228 signatures and the procedure required for a disbursement or
223229 transfer of district money.
224230 Sec. 3958.152. MONEY USED FOR IMPROVEMENTS OR SERVICES.
225231 The district may acquire, construct, finance, operate, or maintain
226232 any improvement or service authorized under this chapter or Chapter
227233 375, Local Government Code, using any money available to the
228234 district.
229235 Sec. 3958.153. PETITION REQUIRED FOR FINANCING SERVICES AND
230236 IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
231237 service or improvement project with assessments under this chapter
232238 unless a written petition requesting that service or improvement
233239 has been filed with the board.
234240 (b) A petition filed under Subsection (a) must be signed by
235241 the owners of a majority of the assessed value of real property in
236242 the district subject to assessment according to the most recent
237243 certified tax appraisal roll for the county.
238244 Sec. 3958.154. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
239245 The board by resolution may impose and collect an assessment for any
240246 purpose authorized by this chapter in all or part of the district.
241247 (b) An assessment, a reassessment, or an assessment
242248 resulting from an addition to or correction of the assessment roll
243249 by the district, penalties and interest on an assessment or
244250 reassessment, an expense of collection, and reasonable attorney's
245251 fees incurred by the district:
246252 (1) are a first and prior lien against the property
247253 assessed;
248254 (2) are superior to any other lien or claim other than
249255 a lien or claim for county, school district, or municipal ad valorem
250256 taxes; and
251257 (3) are the personal liability of and a charge against
252258 the owners of the property even if the owners are not named in the
253259 assessment proceedings.
254260 (c) The lien is effective from the date of the board's
255261 resolution imposing the assessment until the date the assessment is
256262 paid. The board may enforce the lien in the same manner that the
257263 board may enforce an ad valorem tax lien against real property.
258264 (d) The board may make a correction to or deletion from the
259265 assessment roll that does not increase the amount of assessment of
260266 any parcel of land without providing notice and holding a hearing in
261267 the manner required for additional assessments.
262268 Sec. 3958.155. TAX AND ASSESSMENT ABATEMENTS. The district
263269 may designate reinvestment zones and may grant abatements of a tax
264270 or assessment on property in the zones.
265271 SUBCHAPTER E. TAXES AND BONDS
266272 Sec. 3958.201. ELECTIONS REGARDING TAXES AND BONDS. (a)
267273 The district may issue, without an election, bonds, notes, and
268274 other obligations secured by:
269275 (1) revenue other than ad valorem taxes; or
270276 (2) contract payments described by Section 3958.203.
271277 (b) The district must hold an election in the manner
272278 provided by Subchapter L, Chapter 375, Local Government Code, to
273279 obtain voter approval before the district may impose an ad valorem
274280 tax or issue bonds payable from ad valorem taxes.
275281 (c) Section 375.243, Local Government Code, does not apply
276282 to the district.
277283 (d) All or any part of any facilities or improvements that
278284 may be acquired by a district by the issuance of its bonds may be
279285 submitted as a single proposition or as several propositions to be
280286 voted on at the election.
281287 Sec. 3958.202. OPERATION AND MAINTENANCE TAX. (a) If
282288 authorized by a majority of the district voters voting at an
283289 election held in accordance with Section 3958.201, the district may
284290 impose an operation and maintenance tax on taxable property in the
285291 district in accordance with Section 49.107, Water Code, for any
286292 district purpose, including to:
287293 (1) maintain and operate the district;
288294 (2) construct or acquire improvements; or
289295 (3) provide a service.
290296 (b) The board shall determine the tax rate. The rate may not
291297 exceed the rate approved at the election.
292298 (c) Section 49.107(h), Water Code, does not apply to the
293299 district.
294300 Sec. 3958.203. CONTRACT TAXES. (a) In accordance with
295301 Section 49.108, Water Code, the district may impose a tax other than
296302 an operation and maintenance tax and use the revenue derived from
297303 the tax to make payments under a contract after the provisions of
298304 the contract have been approved by a majority of the district voters
299305 voting at an election held for that purpose.
300306 (b) A contract approved by the district voters may contain a
301307 provision stating that the contract may be modified or amended by
302308 the board without further voter approval.
303309 Sec. 3958.204. AUTHORITY TO BORROW MONEY AND TO ISSUE BONDS
304310 AND OTHER OBLIGATIONS. (a) The district may borrow money on terms
305311 determined by the board. Section 375.205, Local Government Code,
306312 does not apply to a loan, line of credit, or other borrowing from a
307313 bank or financial institution secured by revenue other than ad
308314 valorem taxes.
309315 (b) The district may issue bonds, notes, or other
310316 obligations payable wholly or partly from ad valorem taxes,
311317 assessments, impact fees, revenue, contract payments, grants, or
312318 other district money, or any combination of those sources of money,
313319 to pay for any authorized district purpose.
314320 (c) The limitation on the outstanding principal amount of
315321 bonds, notes, and other obligations provided by Section 49.4645,
316322 Water Code, does not apply to the district.
317323 Sec. 3958.205. TAXES FOR BONDS. At the time the district
318324 issues bonds payable wholly or partly from ad valorem taxes, the
319325 board shall provide for the annual imposition of a continuing
320326 direct annual ad valorem tax, without limit as to rate or amount,
321327 for each year that all or part of the bonds are outstanding as
322328 required and in the manner provided by Sections 54.601 and 54.602,
323329 Water Code.
324330 SUBCHAPTER F. MUNICIPAL ANNEXATION AND DISSOLUTION
325331 Sec. 3958.251. MUNICIPAL ANNEXATION; DISSOLUTION. (a) The
326332 district is a "water or sewer district" under Section 43.071, Local
327333 Government Code.
328334 (b) Section 43.075, Local Government Code, applies to the
329335 district.
330336 (c) Section 375.264, Local Government Code, does not apply
331337 to the dissolution of the district by a municipality.
332338 SECTION 2. Harris County Improvement District No. 25
333339 initially includes all territory contained in the following area:
334340 TRACT 1 - 88.03 ACRES
335341 FIELD NOTES of a 88.03 of an acre tract of land situated in
336342 the H.T. & B. R.R. Survey, Block 3, Sec. 9, Abstract No. 421, the
337343 H.T. & B. R.R. Survey, Block 3, Sec. 7, Abstract No. 903 the C.
338344 Collis Survey, Abstract No. 1330, and the G. Lolley Survey,
339345 Abstract No. 1410 Harris County, Texas; said 88.03 of an acre tract
340346 of land being out of and a part of Restricted Reserve "A" of the
341347 Westside Mall, Sec. 2 and recorded at Film Code No. (F.C. No.)
342348 602144 of the Harris County Map Records (H.C.M.R.); said 88.03 of an
343349 acre tract of land being more particularly described by metes and
344350 bounds as follows:
345351 NOTE: All bearings are Lambert Grid bearings and all
346352 coordinates refer to the Texas State Plane Coordinate System, South
347353 Central Zone (#4204), as defined by article 21.071 of the Natural
348354 Resources Code of the State of Texas, 1983 Datum (2001 adjustment).

360366 THENCE N 59°07'57" E with the common North right-of-way line
361367 of said Grand Circle Boulevard and the North line of this tract of
362368 land a distance of 22.95 feet to a set 5/8" iron rod with cap stamped

364370 THENCE in a Northeasterly direction with the common North
365371 right-of-way line of said Grand Circle Boulevard, the North line of

401407 Northeast corner of this tract of land and the end of said reverse

433439 the beginning of a compound curve to the right.
434440 THENCE in a Southeasterly direction with the Westerly
435441 right-of-way line of said Grand Circle Boulevard, the Easterly line
