410 AN ACT
511 relating to the creation of the Wise County Municipal Utility
612 District No. 4; granting a limited power of eminent domain;
713 providing authority to issue bonds; providing authority to impose
814 assessments, fees, and taxes.
915 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1016 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1117 Code, is amended by adding Chapter 8007 to read as follows:
1218 CHAPTER 8007. WISE COUNTY MUNICIPAL UTILITY DISTRICT NO. 4
1319 SUBCHAPTER A. GENERAL PROVISIONS
1420 Sec. 8007.001. DEFINITIONS. In this chapter:
1521 (1) "Board" means the district's board of directors.
1622 (2) "Commission" means the Texas Commission on
1723 Environmental Quality.
1824 (3) "Director" means a board member.
1925 (4) "District" means the Wise County Municipal Utility
2026 District No. 4.
2127 Sec. 8007.002. NATURE OF DISTRICT. The district is a
2228 municipal utility district created under Section 59, Article XVI,
2329 Texas Constitution.
2430 Sec. 8007.003. CONFIRMATION AND DIRECTORS' ELECTION
2531 REQUIRED. The temporary directors shall hold an election to
2632 confirm the creation of the district and to elect five permanent
2733 directors as provided by Section 49.102, Water Code.
2834 Sec. 8007.004. CONSENT OF MUNICIPALITY REQUIRED. The
2935 temporary directors may not hold an election under Section 8007.003
3036 until each municipality in whose corporate limits or
3137 extraterritorial jurisdiction the district is located has
3238 consented by ordinance or resolution to the creation of the
3339 district and to the inclusion of land in the district.
3440 Sec. 8007.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
3541 The district is created to serve a public purpose and benefit.
3642 (b) The district is created to accomplish the purposes of:
3743 (1) a municipal utility district as provided by
3844 general law and Section 59, Article XVI, Texas Constitution; and
3945 (2) Section 52, Article III, Texas Constitution, that
4046 relate to the construction, acquisition, improvement, operation,
4147 or maintenance of macadamized, graveled, or paved roads, or
4248 improvements, including storm drainage, in aid of those roads.
4349 Sec. 8007.006. INITIAL DISTRICT TERRITORY. (a) The
4450 district is initially composed of the territory described by
4551 Section 2 of the Act enacting this chapter.
4652 (b) The boundaries and field notes contained in Section 2 of
4753 the Act enacting this chapter form a closure. A mistake made in the
4854 field notes or in copying the field notes in the legislative process
4955 does not affect the district's:
5056 (1) organization, existence, or validity;
5157 (2) right to issue any type of bond for the purposes
5258 for which the district is created or to pay the principal of and
5359 interest on a bond;
5460 (3) right to impose a tax; or
5561 (4) legality or operation.
5662 SUBCHAPTER B. BOARD OF DIRECTORS
5763 Sec. 8007.051. GOVERNING BODY; TERMS. (a) The district is
5864 governed by a board of five elected directors.
5965 (b) Except as provided by Section 8007.052, directors serve
6066 staggered four-year terms.
6167 Sec. 8007.052. TEMPORARY DIRECTORS. (a) On or after
6268 September 1, 2017, the owner or owners of a majority of the assessed
6369 value of the real property in the district may submit a petition to
6470 the commission requesting that the commission appoint as temporary
6571 directors the five persons named in the petition. The commission
6672 shall appoint as temporary directors the five persons named in the
6773 petition.
6874 (b) Temporary directors serve until the earlier of:
6975 (1) the date permanent directors are elected under
7076 Section 8007.003; or
7177 (2) September 1, 2021.
7278 (c) If permanent directors have not been elected under
7379 Section 8007.003 and the terms of the temporary directors have
7480 expired, successor temporary directors shall be appointed or
7581 reappointed as provided by Subsection (d) to serve terms that
7682 expire on the earlier of:
7783 (1) the date permanent directors are elected under
7884 Section 8007.003; or
7985 (2) the fourth anniversary of the date of the
8086 appointment or reappointment.
8187 (d) If Subsection (c) applies, the owner or owners of a
8288 majority of the assessed value of the real property in the district
8389 may submit a petition to the commission requesting that the
8490 commission appoint as successor temporary directors the five
8591 persons named in the petition. The commission shall appoint as
8692 successor temporary directors the five persons named in the
8793 petition.
8894 SUBCHAPTER C. POWERS AND DUTIES
8995 Sec. 8007.101. GENERAL POWERS AND DUTIES. The district has
9096 the powers and duties necessary to accomplish the purposes for
9197 which the district is created.
9298 Sec. 8007.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9399 DUTIES. The district has the powers and duties provided by the
94100 general law of this state, including Chapters 49 and 54, Water Code,
95101 applicable to municipal utility districts created under Section 59,
96102 Article XVI, Texas Constitution.
97103 Sec. 8007.103. AUTHORITY FOR ROAD PROJECTS. Under Section
98104 52, Article III, Texas Constitution, the district may design,
99105 acquire, construct, finance, issue bonds for, improve, operate,
100106 maintain, and convey to this state, a county, or a municipality for
101107 operation and maintenance macadamized, graveled, or paved roads, or
102108 improvements, including storm drainage, in aid of those roads.
103109 Sec. 8007.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
104110 project must meet all applicable construction standards, zoning and
105111 subdivision requirements, and regulations of each municipality in
106112 whose corporate limits or extraterritorial jurisdiction the road
107113 project is located.
108114 (b) If a road project is not located in the corporate limits
109115 or extraterritorial jurisdiction of a municipality, the road
110116 project must meet all applicable construction standards,
111117 subdivision requirements, and regulations of each county in which
112118 the road project is located.
113119 (c) If the state will maintain and operate the road, the
114120 Texas Transportation Commission must approve the plans and
115121 specifications of the road project.
116122 Sec. 8007.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
117123 OR RESOLUTION. The district shall comply with all applicable
118124 requirements of any ordinance or resolution that is adopted under
119125 Section 54.016 or 54.0165, Water Code, and that consents to the
120126 creation of the district or to the inclusion of land in the
121127 district.
122128 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
123129 Sec. 8007.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
124130 district may issue, without an election, bonds and other
125131 obligations secured by:
126132 (1) revenue other than ad valorem taxes; or
127133 (2) contract payments described by Section 8007.153.
128134 (b) The district must hold an election in the manner
129135 provided by Chapters 49 and 54, Water Code, to obtain voter approval
130136 before the district may impose an ad valorem tax or issue bonds
131137 payable from ad valorem taxes.
132138 (c) The district may not issue bonds payable from ad valorem
133139 taxes to finance a road project unless the issuance is approved by a
134140 vote of a two-thirds majority of the district voters voting at an
135141 election held for that purpose.
136142 Sec. 8007.152. OPERATION AND MAINTENANCE TAX. (a) If
137143 authorized at an election held under Section 8007.151, the district
138144 may impose an operation and maintenance tax on taxable property in
139145 the district in accordance with Section 49.107, Water Code.
140146 (b) The board shall determine the tax rate. The rate may not
141147 exceed the rate approved at the election.
142148 Sec. 8007.153. CONTRACT TAXES. (a) In accordance with
143149 Section 49.108, Water Code, the district may impose a tax other than
144150 an operation and maintenance tax and use the revenue derived from
145151 the tax to make payments under a contract after the provisions of
146152 the contract have been approved by a majority of the district voters
147153 voting at an election held for that purpose.
148154 (b) A contract approved by the district voters may contain a
149155 provision stating that the contract may be modified or amended by
150156 the board without further voter approval.
151157 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
152158 Sec. 8007.201. AUTHORITY TO ISSUE BONDS AND OTHER
153159 OBLIGATIONS. The district may issue bonds or other obligations
154160 payable wholly or partly from ad valorem taxes, impact fees,
155161 revenue, contract payments, grants, or other district money, or any
156162 combination of those sources, to pay for any authorized district
157163 purpose.
158164 Sec. 8007.202. TAXES FOR BONDS. At the time the district
159165 issues bonds payable wholly or partly from ad valorem taxes, the
160166 board shall provide for the annual imposition of a continuing
161167 direct ad valorem tax, without limit as to rate or amount, while all
162168 or part of the bonds are outstanding as required and in the manner
163169 provided by Sections 54.601 and 54.602, Water Code.
164170 Sec. 8007.203. BONDS FOR ROAD PROJECTS. At the time of
165171 issuance, the total principal amount of bonds or other obligations
166172 issued or incurred to finance road projects and payable from ad
167173 valorem taxes may not exceed one-fourth of the assessed value of the
168174 real property in the district.
169175 SECTION 2. The Wise County Municipal Utility District No. 4
170176 initially includes all the territory contained in the following
171177 area:
172178 Description for a 97.93 acre tract of land situated in the T&P
173179 R.R. CO. SURVEY, Section 39, Abstract No. 847, and the
174180 R. ROUNDTREE SURVEY, Abstract No. 734, Wise County, Texas, said
175181 tract being the same tracts of land described as First Tract and
176182 Second Tract, described in deed to Mary Elizabeth Harrington Klein,
177183 Merle Floyd Harrington, Jr. and Robert Ernest Harrington, recorded
178184 in Document No. 201400003, Official Public Records, Wise County,
179185 Texas and being more particularly described as follows:
180186 COMMENCING from a 1" pipe found at the Northeast corner of
181187 that certain tract of land described in deed to Rickey Morrison and
182188 wife Sarah P. Morrison, recorded in Volume 105, Page 786, Real
183189 Records, Wise County, Texas, said pipe being by deed call for the
184190 Northwest corner of the James B. Smith Survey, Abstract No. 1202,
185191 said pipe also being in the West line of McVoid Road;
186192 THENCE N 89°36'30" E, 573.15 feet to a p.k. nail set at the
187193 intersection of said McVoid Road and County Road No. 4797 for the
188194 POINT OF BEGINNING;
189195 THENCE S 89°36'30" W, at 573.15 feet passing said 1" iron
190196 found at the Northeast corner of said Volume 105, Page 786 and
191197 continuing with the North line of said Volume 105, Page 786, passing
192198 the Northwest corner of said Volume 105, Page 786 and the most
193199 Northerly Northeast corner of that certain tract of land described
194200 in deed to Mack Brandon Hill and Rae Lynn Hill, recorded in Volume
195201 586, Page 458, Real Records, Wise County, Texas, continuing with
196202 the North line of said Volume 586, Page 458, in all, 1683.33 feet to
197203 a wood fence post, said post being for the Southeast corner of that
198204 certain tract of land described in deed to Gervais W. Trichel, III
199205 and Vicky Lynn Trichel, recorded in Volume 2433, Page 1111,
200206 Official Public Records, WIse County, Texas;
201207 THENCE N 00°36'06" W, with the East line of said Volume 2433,
202208 Page 1111, 2269.10 feet to a 1/2" iron found in County Road
203209 No. 4898, said iron being for the Northeast corner of said Volume
204210 2433, Page 1111;
205211 THENCE S 89°45'16" E, with said County Road No. 4898, 466.67
206212 feet to a capped iron set in the East line of said County Road
207213 No. 4898;
208214 THENCE N 00°23'30" W, with said County Road No. 4898, 367.34
209215 feet to a p.k. nail set at the intersection of said County Road
210216 No. 4898 and said County Road No. 4797;
211217 THENCE S 89°57'20" E, with said County Road No. 4797, 1225.04
212218 feet to a capped iron set in the Northeasterly line of said County
213219 Road No. 4797;
214220 THENCE S 00°23'30" E, with said County Road No. 4797, 2621.90
215221 feet to the POINT OF BEGINNING and containing 97.93 acres of land.
216222 SECTION 3. (a) The legal notice of the intention to
217223 introduce this Act, setting forth the general substance of this
218224 Act, has been published as provided by law, and the notice and a
219225 copy of this Act have been furnished to all persons, agencies,
220226 officials, or entities to which they are required to be furnished
221227 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
222228 Government Code.
223229 (b) The governor, one of the required recipients, has
224230 submitted the notice and Act to the Texas Commission on
225231 Environmental Quality.
226232 (c) The Texas Commission on Environmental Quality has filed
227233 its recommendations relating to this Act with the governor, the
228234 lieutenant governor, and the speaker of the house of
229235 representatives within the required time.
230236 (d) All requirements of the constitution and laws of this
231237 state and the rules and procedures of the legislature with respect
232238 to the notice, introduction, and passage of this Act are fulfilled
233239 and accomplished.
234240 SECTION 4. (a) If this Act does not receive a two-thirds
235241 vote of all the members elected to each house, Subchapter C, Chapter
236242 8007, Special District Local Laws Code, as added by Section 1 of
237243 this Act, is amended by adding Section 8007.106 to read as follows:
238244 Sec. 8007.106. NO EMINENT DOMAIN POWER. The district may
239245 not exercise the power of eminent domain.
240246 (b) This section is not intended to be an expression of a
241247 legislative interpretation of the requirements of Section 17(c),
242248 Article I, Texas Constitution.
243249 SECTION 5. This Act takes effect September 1, 2017.
