| 7 | 7 | | relating to the appointment of bailiffs by the district court and |

| 8 | 8 | | county courts at law in Wise County. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 53.001, Government Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (l) to read as follows: |
|---|
| 12 | 12 | | (l) The judge of the 271st District Court and the judges of |
|---|
| 13 | 13 | | the county courts at law in Wise County shall each appoint a |
|---|
| 14 | 14 | | bailiff. |
|---|
| 15 | 15 | | SECTION 2. Section 53.004, Government Code, is amended by |
|---|
| 16 | 16 | | adding Subsection (i) to read as follows: |
|---|
| 17 | 17 | | (i) A bailiff in the 271st District Court or a county court |
|---|
| 18 | 18 | | at law in Wise County must be: |
|---|
| 19 | 19 | | (1) at least 21 years of age; and |
|---|
| 20 | 20 | | (2) a citizen of the United States. |
|---|
| 21 | 21 | | SECTION 3. Section 53.008, Government Code, is amended to |
|---|
| 22 | 22 | | read as follows: |
|---|
| 23 | 23 | | Sec. 53.008. OATH. The bailiffs of the 34th, 70th, 86th, |
|---|
| 24 | 24 | | 97th, 130th, 142nd, 161st, 238th, 271st, 318th, 341st, 355th, and |
|---|
| 25 | 25 | | 385th district courts, the bailiffs of the courts described in |
|---|
| 26 | 26 | | Section 53.002(c), (d), (e), or (f), the bailiffs and the grand jury |
|---|
| 27 | 27 | | bailiffs of the district courts in Tarrant County that give |
|---|
| 28 | 28 | | preference to criminal cases, the bailiffs and grand jury bailiffs |
|---|
| 29 | 29 | | of the criminal district courts in Tarrant County, the bailiffs of |
|---|
| 30 | 30 | | the district courts in Taylor County, [and] the bailiffs of the |
|---|
| 31 | 31 | | county courts at law of Taylor County, and the bailiffs of the |
|---|
| 32 | 32 | | county courts at law of Wise County shall each swear to the |
|---|
| 33 | 33 | | following oath, to be administered by the judge: "I solemnly swear |
|---|
| 34 | 34 | | that I will faithfully and impartially perform all duties as may be |
|---|
| 35 | 35 | | required of me by law, so help me God." |
|---|
| 36 | 36 | | SECTION 4. Section 53.009, Government Code, is amended by |
|---|
| 37 | 37 | | adding Subsection (o) to read as follows: |
|---|
| 38 | 38 | | (o) Each bailiff appointed by the judge of the 271st |
|---|
| 39 | 39 | | District Court or appointed by a county court at law judge in Wise |
|---|
| 40 | 40 | | County is entitled to receive a salary that does not exceed the |
|---|
| 41 | 41 | | salary of a lieutenant in the sheriff's department of the county. |
|---|
| 42 | 42 | | The salary is paid out of the general fund of the county. |
|---|
| 43 | 43 | | SECTION 5. This Act takes effect September 1, 2017. |
