55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the appointment of bailiffs by the district court and
88 county courts at law in Wise County.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 53.001, Government Code, is amended by
1111 adding Subsection (l) to read as follows:
1212 (l) The judge of the 271st District Court and the judges of
1313 the county courts at law in Wise County shall each appoint a
1414 bailiff.
1515 SECTION 2. Section 53.004, Government Code, is amended by
1616 adding Subsection (i) to read as follows:
1717 (i) A bailiff in the 271st District Court or a county court
1818 at law in Wise County must be:
1919 (1) at least 21 years of age; and
2020 (2) a citizen of the United States.
2121 SECTION 3. Section 53.008, Government Code, is amended to
2222 read as follows:
2323 Sec. 53.008. OATH. The bailiffs of the 34th, 70th, 86th,
2424 97th, 130th, 142nd, 161st, 238th, 271st, 318th, 341st, 355th, and
2525 385th district courts, the bailiffs of the courts described in
2626 Section 53.002(c), (d), (e), or (f), the bailiffs and the grand jury
2727 bailiffs of the district courts in Tarrant County that give
2828 preference to criminal cases, the bailiffs and grand jury bailiffs
2929 of the criminal district courts in Tarrant County, the bailiffs of
3030 the district courts in Taylor County, [and] the bailiffs of the
3131 county courts at law of Taylor County, and the bailiffs of the
3232 county courts at law of Wise County shall each swear to the
3333 following oath, to be administered by the judge: "I solemnly swear
3434 that I will faithfully and impartially perform all duties as may be
3535 required of me by law, so help me God."
3636 SECTION 4. Section 53.009, Government Code, is amended by
3737 adding Subsection (o) to read as follows:
3838 (o) Each bailiff appointed by the judge of the 271st
3939 District Court or appointed by a county court at law judge in Wise
4040 County is entitled to receive a salary that does not exceed the
4141 salary of a lieutenant in the sheriff's department of the county.
4242 The salary is paid out of the general fund of the county.
4343 SECTION 5. This Act takes effect September 1, 2017.
