55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to notice of the deadline for an application for a place on
88 the ballot for the election of and eligibility of directors of the
99 Northwest Dallas County Flood Control District.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 7806.052, Special District Local Laws
1212 Code, is amended to read as follows:
1313 Sec. 7806.052. ELIGIBILITY. To serve as a director, a
1414 person must[:
1515 [(1) own taxable property in the district; or
1616 [(2)] be a resident of the district.
1717 SECTION 2. Section 7806.105, Special District Local Laws
1818 Code, is amended by adding Subsection (a-1) to read as follows:
1919 (a-1) The district shall provide to each resident by mail
2020 notice of the deadline for a candidate to file an application for a
2121 place on the ballot for the election of directors. The notice under
2222 this subsection must:
2323 (1) be sent not later than the third week before the
2424 deadline for a candidate to file an application;
2525 (2) state the deadline for a candidate to file an
2626 application; and
2727 (3) state the time and place of the election.
2828 SECTION 3. Section 7806.052, Special District Local Laws
2929 Code, as amended by this Act, does not affect the current term of a
3030 member serving on the board of directors of the Northwest Dallas
3131 County Flood Control District immediately before the effective date
3232 of this Act. The change in law applies only to a term of a member
3333 beginning on or after the effective date of this Act.
3434 SECTION 4. (a) The legal notice of the intention to
3535 introduce this Act, setting forth the general substance of this
3636 Act, has been published as provided by law, and the notice and a
3737 copy of this Act have been furnished to all persons, agencies,
3838 officials, or entities to which they are required to be furnished
3939 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4040 Government Code.
4141 (b) The governor, one of the required recipients, has
4242 submitted the notice and Act to the Texas Commission on
4343 Environmental Quality.
4444 (c) The Texas Commission on Environmental Quality has filed
4545 its recommendations relating to this Act with the governor, the
4646 lieutenant governor, and the speaker of the house of
4747 representatives within the required time.
4848 (d) All requirements of the constitution and laws of this
4949 state and the rules and procedures of the legislature with respect
5050 to the notice, introduction, and passage of this Act are fulfilled
5151 and accomplished.
5252 SECTION 5. This Act takes effect January 1, 2018.
