| 7 | 7 | | relating to notice of the deadline for an application for a place on |

| 8 | 8 | | the ballot for the election of and eligibility of directors of the |
|---|
| 9 | 9 | | Northwest Dallas County Flood Control District. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 7806.052, Special District Local Laws |
|---|
| 12 | 12 | | Code, is amended to read as follows: |
|---|
| 13 | 13 | | Sec. 7806.052. ELIGIBILITY. To serve as a director, a |
|---|
| 14 | 14 | | person must[: |
|---|
| 15 | 15 | | [(1) own taxable property in the district; or |
|---|
| 16 | 16 | | [(2)] be a resident of the district. |
|---|
| 17 | 17 | | SECTION 2. Section 7806.105, Special District Local Laws |
|---|
| 18 | 18 | | Code, is amended by adding Subsection (a-1) to read as follows: |
|---|
| 19 | 19 | | (a-1) The district shall provide to each resident by mail |
|---|
| 20 | 20 | | notice of the deadline for a candidate to file an application for a |
|---|
| 21 | 21 | | place on the ballot for the election of directors. The notice under |
|---|
| 22 | 22 | | this subsection must: |
|---|
| 23 | 23 | | (1) be sent not later than the third week before the |
|---|
| 24 | 24 | | deadline for a candidate to file an application; |
|---|
| 25 | 25 | | (2) state the deadline for a candidate to file an |
|---|
| 26 | 26 | | application; and |
|---|
| 27 | 27 | | (3) state the time and place of the election. |
|---|
| 28 | 28 | | SECTION 3. Section 7806.052, Special District Local Laws |
|---|
| 29 | 29 | | Code, as amended by this Act, does not affect the current term of a |
|---|
| 30 | 30 | | member serving on the board of directors of the Northwest Dallas |
|---|
| 31 | 31 | | County Flood Control District immediately before the effective date |
|---|
| 32 | 32 | | of this Act. The change in law applies only to a term of a member |
|---|
| 33 | 33 | | beginning on or after the effective date of this Act. |
|---|
| 34 | 34 | | SECTION 4. (a) The legal notice of the intention to |
|---|
| 35 | 35 | | introduce this Act, setting forth the general substance of this |
|---|
| 36 | 36 | | Act, has been published as provided by law, and the notice and a |
|---|
| 37 | 37 | | copy of this Act have been furnished to all persons, agencies, |
|---|
| 38 | 38 | | officials, or entities to which they are required to be furnished |
|---|
| 39 | 39 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
|---|
| 40 | 40 | | Government Code. |
|---|
| 41 | 41 | | (b) The governor, one of the required recipients, has |
|---|
| 42 | 42 | | submitted the notice and Act to the Texas Commission on |
|---|
| 43 | 43 | | Environmental Quality. |
|---|
| 44 | 44 | | (c) The Texas Commission on Environmental Quality has filed |
|---|
| 45 | 45 | | its recommendations relating to this Act with the governor, the |
|---|
| 46 | 46 | | lieutenant governor, and the speaker of the house of |
|---|
| 47 | 47 | | representatives within the required time. |
|---|
| 48 | 48 | | (d) All requirements of the constitution and laws of this |
|---|
| 49 | 49 | | state and the rules and procedures of the legislature with respect |
|---|
| 50 | 50 | | to the notice, introduction, and passage of this Act are fulfilled |
|---|
| 51 | 51 | | and accomplished. |
|---|
| 52 | 52 | | SECTION 5. This Act takes effect January 1, 2018. |
