55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to authorizing the East Downtown Management District to
88 impose a tax, fee, or assessment on certain property.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 3808.157, Special District Local Laws
1111 Code, is amended to read as follows:
1212 Sec. 3808.157. PROPERTY EXEMPT FROM TAXES, IMPACT FEES, AND
1313 ASSESSMENTS. The district may not impose:
1414 (1) a tax, impact fee, or assessment on a kind of
1515 property that Chapter 375, Local Government Code, provides is
1616 exempt from the imposition of a tax, impact fee, or assessment by a
1717 district governed by that chapter [a residential property or
1818 condominium]; or
1919 (2) an impact fee or assessment on the property,
2020 equipment, or facilities of a person that provides to the public
2121 cable television, gas, light, power, telephone, sewage, or water
2222 service.
2323 SECTION 2. (a) The legal notice of the intention to
2424 introduce this Act, setting forth the general substance of this
2525 Act, has been published as provided by law, and the notice and a
2626 copy of this Act have been furnished to all persons, agencies,
2727 officials, or entities to which they are required to be furnished
2828 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
2929 Government Code.
3030 (b) The governor, one of the required recipients, has
3131 submitted the notice and Act to the Texas Commission on
3232 Environmental Quality.
3333 (c) The Texas Commission on Environmental Quality has filed
3434 its recommendations relating to this Act with the governor, the
3535 lieutenant governor, and the speaker of the house of
3636 representatives within the required time.
3737 (d) All requirements of the constitution and laws of this
3838 state and the rules and procedures of the legislature with respect
3939 to the notice, introduction, and passage of this Act are fulfilled
4040 and accomplished.
4141 SECTION 3. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2017.
