| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 11.46, Alcoholic Beverage Code, is | |
| 11 | 11 | amended by adding Subsection (e) to read as follows: | |
| 12 | 12 | (e) The commission or administrator shall refuse to issue an | |
| 13 | 13 | original permit authorizing the retail sale of alcoholic beverages | |
| 14 | 14 | to an applicant who has been refused the same type of permit for the | |
| 15 | 15 | same premises three or more times. | |
| 16 | 16 | SECTION 2. Section 61.42, Alcoholic Beverage Code, is | |
| 17 | 17 | amended by adding Subsection (e) to read as follows: | |
| 18 | 18 | (e) The county judge, commission, or administrator shall | |
| 19 | 19 | refuse to approve or issue an original license authorizing the | |
| 20 | 20 | retail sale of alcoholic beverages to an applicant who has been | |
| 21 | 21 | refused the same type of license for the same premises three or more | |
| 22 | 22 | times. | |
| 23 | 23 | SECTION 3. The changes in law made by this Act apply only | |
| 24 | 24 | with respect to an original alcoholic beverage permit or license | |
| 25 | 25 | application made on or after the effective date of this Act. | |
| 26 | 26 | SECTION 4. This Act takes effect September 1, 2017. |
