99 relating to refunds of certain bingo licensing and registration
1010 fees.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2001.103, Occupations Code, is amended
1313 by adding Subsection (a-1) to read as follows:
1414 (a-1) On request, the commission shall refund to an
1515 authorized organization the $25 temporary license fee submitted
1616 under Subsection (a) not later than the 30th day after the date the
1717 commission receives the request for the refund, if:
1818 (1) the authorized organization does not use the
1919 temporary license to conduct bingo before the first anniversary of
2020 the date of the license's issuance; or
2121 (2) the authorized organization requests withdrawal
2222 of the application before the temporary license is issued, except
2323 the commission may retain an amount not to exceed 50 percent of the
2424 license fee to defray any administrative cost incurred by the
2525 commission in processing the application.
2626 SECTION 2. Section 2001.104, Occupations Code, is amended
2727 by adding Subsection (f) to read as follows:
2828 (f) The commission shall refund the fee for an initial or
2929 renewal license to conduct bingo if the applicant requests
3030 withdrawal of the application before the license is issued or if the
3131 commission denies the application, except the commission may retain
3232 an amount not to exceed the lesser of 50 percent of the license fee
3333 or $150 to defray any administrative cost incurred by the
3434 commission in processing the application. The commission shall
3535 issue the refund not later than the 30th day after the date the
3636 commission receives the withdrawal request or denies the
3737 application.
3838 SECTION 3. Section 2001.158, Occupations Code, is amended
3939 by adding Subsection (e) to read as follows:
4040 (e) The commission shall refund the fee for an initial or
4141 renewal commercial lessor license if the applicant requests
4242 withdrawal of the application before the license is issued or if the
4343 commission denies the application, except the commission may retain
4444 an amount not to exceed the lesser of 50 percent of the license fee
4545 or $150 to defray any administrative cost incurred by the
4646 commission in processing the application. The commission shall
4747 issue the refund not later than the 30th day after the date the
4848 commission receives the withdrawal request or denies the
4949 application.
5050 SECTION 4. Section 2001.205, Occupations Code, is amended
5151 by adding Subsection (c) to read as follows:
5252 (c) The commission shall refund the fee for an initial or
5353 renewal manufacturer's license if the applicant requests
5454 withdrawal of the application before the license is issued or if the
5555 commission denies the application, except the commission may retain
5656 an amount not to exceed the lesser of 50 percent of the license fee
5757 or $150 to defray any administrative cost incurred by the
5858 commission in processing the application. The commission shall
5959 issue the refund not later than the 30th day after the date the
6060 commission receives the withdrawal request or denies the
6161 application.
6262 SECTION 5. Section 2001.209, Occupations Code, is amended
6363 by adding Subsection (c) to read as follows:
6464 (c) The commission shall refund the fee for an initial or
6565 renewal distributor's license if the applicant requests withdrawal
6666 of the application before the license is issued or if the commission
6767 denies the application, except the commission may retain an amount
6868 not to exceed the lesser of 50 percent of the license fee or $150 to
6969 defray any administrative cost incurred by the commission in
7070 processing the application. The commission shall issue the refund
7171 not later than the 30th day after the date the commission receives
7272 the withdrawal request or denies the application.
7373 SECTION 6. Section 2001.306, Occupations Code, is amended
7474 by adding Subsection (f) to read as follows:
7575 (f) The commission shall refund the fee for amending a
7676 license issued under this chapter if the applicant requests
7777 withdrawal of the amendment application before the amended license
7878 is issued or if the commission denies the amendment application,
7979 except the commission may retain an amount not to exceed 50 percent
8080 of the amendment fee to defray any administrative cost incurred by
8181 the commission in processing the amendment application. The
8282 commission shall issue the refund not later than the 30th day after
8383 the date the commission receives the withdrawal request or denies
8484 the application.
8585 SECTION 7. Section 2001.313, Occupations Code, is amended
8686 by adding Subsection (b-3) to read as follows:
8787 (b-3) The commission shall refund the fee submitted under
8888 Subsection (b-2) for an initial or renewal registration application
8989 if the applicant requests withdrawal of the application before the
9090 applicant is listed on the registry or if the commission denies the
9191 registration and listing, except the commission may retain an
9292 amount not to exceed 50 percent of the registration fee to defray
9393 any administrative cost incurred by the commission in processing
9494 the application. The commission shall issue the refund not later
9595 than the 30th day after the date the commission receives the
9696 withdrawal request or denies the application.
9797 SECTION 8. Section 2001.437, Occupations Code, is amended
9898 by adding Subsection (i) to read as follows:
9999 (i) The commission shall refund the fee for an initial or
100100 renewal unit manager license if the applicant requests withdrawal
101101 of the application before the license is issued or if the commission
102102 denies the application, except the commission may retain an amount
103103 not to exceed the lesser of 50 percent of the license fee or $150 to
104104 defray any administrative cost incurred by the commission in
105105 processing the application. The commission shall issue the refund
106106 not later than the 30th day after the date the commission receives
107107 the withdrawal request or denies the application.
108108 SECTION 9. Chapter 2001, Occupations Code, as amended by
109109 this Act, applies only to an application and fee submitted under
110110 that chapter on or after the effective date of this Act. An
111111 application and fee submitted before the effective date of this Act
112112 is governed by the law in effect on the date the application and fee
113113 are submitted, and the former law is continued in effect for that
114114 purpose.
115115 SECTION 10. This Act takes effect January 1, 2018.
