| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Subchapter L, Chapter 11, Parks and Wildlife | |
| 12 | 12 | Code, is amended by adding Section 11.302 to read as follows: | |
| 13 | 13 | Sec. 11.302. LEASES FOR RADIO TOWERS AND RELATED LAND. The | |
| 14 | 14 | competitive bidding requirements of Subtitle D, Title 10, | |
| 15 | 15 | Government Code, do not apply to a procurement by the department of | |
| 16 | 16 | a lease for: | |
| 17 | 17 | (1) a radio tower; or | |
| 18 | 18 | (2) land underlying a radio tower. | |
| 19 | 19 | SECTION 2. Section 11.302, Parks and Wildlife Code, as | |
| 20 | 20 | added by this Act, applies to a lease procured by the Parks and | |
| 21 | 21 | Wildlife Department on or after the effective date of this Act. A | |
| 22 | 22 | lease procured by the department before the effective date of this | |
| 23 | 23 | Act is governed by the law in effect at the time the lease was | |
| 24 | 24 | procured, and the former law is continued in effect for that | |
| 25 | 25 | purpose. | |
| 26 | 26 | SECTION 3. This Act takes effect September 1, 2017. |
