1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 61.014, Election Code, is amended by
1313 amending Subsections (a) and (b) and adding Subsection (e) to read
1414 as follows:
1515 (a) Except as otherwise provided by this section, a [A]
1616 person may not use a wireless communication device within 100 feet
1717 of a voting station.
1818 (b) A person may not use any mechanical or electronic means
1919 to take photographs, take video, or record [of recording images or]
2020 sound within 100 feet of a voting station.
2121 (e) A person may use the person's mobile phone to access
2222 information.
2323 SECTION 2. The heading to Section 62.0111, Election Code,
2424 is amended to read as follows:
2525 Sec. 62.0111. NOTICE OF PROHIBITION OF RECORDING [CERTAIN
2626 DEVICES].
2727 SECTION 3. Section 62.0111(a), Election Code, is amended to
2828 read as follows:
2929 (a) At the discretion of the presiding judge, notice of the
3030 prohibition of taking photographs, taking video, or recording sound
3131 [the use of certain devices] under Section 61.014 may be posted at
3232 one or more locations in the polling place where it can be read by
3333 persons waiting to vote.
3434 SECTION 4. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2017.
