55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the notice to the parent or other person having lawful
88 control of a public school student concerning the student's class
99 performance.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 28.022(a), Education Code, is amended to
1212 read as follows:
1313 (a) The board of trustees of each school district shall
1414 adopt a policy that:
1515 (1) provides for a conference between parents and
1616 teachers;
1717 (2) requires the district, at least once every 12
1818 weeks, to give written notice to a parent of:
1919 (A) a student's performance in each class or
2020 subject; and
2121 (B) the number of students that, on the last day
2222 of the period for which the notice is given, were enrolled in each
2323 of the student's classes, including the class for a particular
2424 subject; and
2525 (3) requires the district, at least once every three
2626 weeks, or during the fourth week of each nine-week grading period,
2727 to give written notice to a parent [or legal guardian] of:
2828 (A) a student's performance in a subject included
2929 in the foundation curriculum under Section 28.002(a)(1) if the
3030 student's performance in the subject is consistently
3131 unsatisfactory, as determined by the district; and
3232 (B) the number of students that, on the last day
3333 of the period for which the notice is given, were enrolled in the
3434 student's class for the subject for which the notice is given.
3535 SECTION 2. This Act applies beginning with the 2017-2018
3636 school year.
3737 SECTION 3. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2017.
