| 7 | 7 | | relating to the notice to the parent or other person having lawful |

| 8 | 8 | | control of a public school student concerning the student's class |
|---|
| 9 | 9 | | performance. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 28.022(a), Education Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (a) The board of trustees of each school district shall |
|---|
| 14 | 14 | | adopt a policy that: |
|---|
| 15 | 15 | | (1) provides for a conference between parents and |
|---|
| 16 | 16 | | teachers; |
|---|
| 17 | 17 | | (2) requires the district, at least once every 12 |
|---|
| 18 | 18 | | weeks, to give written notice to a parent of: |
|---|
| 19 | 19 | | (A) a student's performance in each class or |
|---|
| 20 | 20 | | subject; and |
|---|
| 21 | 21 | | (B) the number of students that, on the last day |
|---|
| 22 | 22 | | of the period for which the notice is given, were enrolled in each |
|---|
| 23 | 23 | | of the student's classes, including the class for a particular |
|---|
| 24 | 24 | | subject; and |
|---|
| 25 | 25 | | (3) requires the district, at least once every three |
|---|
| 26 | 26 | | weeks, or during the fourth week of each nine-week grading period, |
|---|
| 27 | 27 | | to give written notice to a parent [or legal guardian] of: |
|---|
| 28 | 28 | | (A) a student's performance in a subject included |
|---|
| 29 | 29 | | in the foundation curriculum under Section 28.002(a)(1) if the |
|---|
| 30 | 30 | | student's performance in the subject is consistently |
|---|
| 31 | 31 | | unsatisfactory, as determined by the district; and |
|---|
| 32 | 32 | | (B) the number of students that, on the last day |
|---|
| 33 | 33 | | of the period for which the notice is given, were enrolled in the |
|---|
| 34 | 34 | | student's class for the subject for which the notice is given. |
|---|
| 35 | 35 | | SECTION 2. This Act applies beginning with the 2017-2018 |
|---|
| 36 | 36 | | school year. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2017. |
