55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the suspension of a driver's license for the failure to
88 pay a surcharge.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 708.151(c), Transportation Code, is
1111 amended to read as follows:
1212 (c) If on or before the 45th day after the date the first
1313 notice was sent the person fails to pay the amount of the surcharge
1414 or fails to enter into an installment payment agreement with the
1515 department, the department shall send a second notice. If on or
1616 before the 60th day after the date the second notice was sent the
1717 person fails to pay the amount of the surcharge or fails to enter
1818 into an installment payment agreement with the department, the
1919 department shall send a third notice that advises the person that
2020 the person's driving privileges may be [are] suspended by a justice
2121 of the peace.
2222 SECTION 2. Section 708.152(a), Transportation Code, is
2323 amended to read as follows:
2424 (a) If on the 60th day after the date the department sends a
2525 second notice under Section 708.151 the person fails to pay the
2626 amount of a surcharge on the person's license or fails to enter into
2727 an installment payment agreement with the department, the
2828 department shall notify the justice of the peace of the precinct in
2929 which the person resides [license of the person is automatically
3030 suspended]. The department may not notify the justice of the peace
3131 [A person's license may not be suspended] under this section before
3232 the 105th day after the date the surcharge was assessed by the
3333 department. The justice of the peace may order the department to
3434 suspend the person's license for nonpayment of the surcharge.
3535 SECTION 3. Section 708.154(b), Transportation Code, is
3636 amended to read as follows:
3737 (b) If a surcharge or a related cost is paid by credit card
3838 and the amount is subsequently reversed by the issuer of the credit
3939 card, the department shall notify the justice of the peace of the
4040 precinct in which the person resides [license of the person is
4141 automatically suspended]. The justice of the peace may order the
4242 department to suspend the person's license for nonpayment of the
4343 surcharge.
4444 SECTION 4. This Act takes effect September 1, 2017.
