| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Chapter 361, Health and Safety Code, is amended | |
| 11 | 11 | by adding Subchapter P to read as follows: | |
| 12 | 12 | SUBCHAPTER P. WASTE TIRE DUMPING ENFORCEMENT GRANT PROGRAM | |
| 13 | 13 | Sec. 361.471. DEFINITIONS. In this subchapter, "used tire" | |
| 14 | 14 | means a tire that: | |
| 15 | 15 | (1) has been used as a tire on a vehicle; and | |
| 16 | 16 | (2) can still be used for its original intended | |
| 17 | 17 | purpose. | |
| 18 | 18 | Sec. 361.472. COLLECTION OF FEE ON SALE OF TIRE. (a) A | |
| 19 | 19 | seller shall collect a fee in an amount to be determined by the | |
| 20 | 20 | commission on the sale of each new or used tire. | |
| 21 | 21 | (b) On a schedule determined by the commission, a seller | |
| 22 | 22 | shall remit fees collected under Subsection (a) to the comptroller | |
| 23 | 23 | for deposit into an account in the general revenue fund to be used | |
| 24 | 24 | to fund the grant program under Section 361.473. | |
| 25 | 25 | Sec. 361.473. GRANT PROGRAM. The commission shall develop | |
| 26 | 26 | and implement a program to provide grants to local law enforcement | |
| 27 | 27 | agencies to assist those agencies in the enforcement of laws | |
| 28 | 28 | related to the illegal dumping of tires. | |
| 29 | 29 | SECTION 2. This Act takes effect September 1, 2017. |
