77 relating to the creation of a waste tire dumping enforcement grant
88 program; authorizing a fee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 361, Health and Safety Code, is amended
1111 by adding Subchapter P to read as follows:
1212 SUBCHAPTER P. WASTE TIRE DUMPING ENFORCEMENT GRANT PROGRAM
1313 Sec. 361.471. DEFINITIONS. In this subchapter, "used tire"
1414 means a tire that:
1515 (1) has been used as a tire on a vehicle; and
1616 (2) can still be used for its original intended
1717 purpose.
1818 Sec. 361.472. COLLECTION OF FEE ON SALE OF TIRE. (a) A
1919 seller shall collect a fee in an amount to be determined by the
2020 commission on the sale of each new or used tire.
2121 (b) On a schedule determined by the commission, a seller
2222 shall remit fees collected under Subsection (a) to the comptroller
2323 for deposit into an account in the general revenue fund to be used
2424 to fund the grant program under Section 361.473.
2525 Sec. 361.473. GRANT PROGRAM. The commission shall develop
2626 and implement a program to provide grants to local law enforcement
2727 agencies to assist those agencies in the enforcement of laws
2828 related to the illegal dumping of tires.
2929 SECTION 2. This Act takes effect September 1, 2017.
