55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution of the offense of improper relationship
88 between educator and student.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 21.12(a), Penal Code, is amended to read
1111 as follows:
1212 (a) An employee of a public or private primary or secondary
1313 school commits an offense if the employee:
1414 (1) engages in sexual contact, sexual intercourse, or
1515 deviate sexual intercourse with a person who is enrolled in a public
1616 or private primary or secondary school at which the employee works;
1717 (2) holds a certificate or permit issued as provided
1818 by Subchapter B, Chapter 21, Education Code, or is a person who is
1919 required to be licensed by a state agency as provided by Section
2020 21.003(b), Education Code, and engages in sexual contact, sexual
2121 intercourse, or deviate sexual intercourse with a person the
2222 employee knows is:
2323 (A) enrolled in a public or private primary or
2424 secondary school in this state, other than a school described by
2525 Subdivision (1) [the same school district as the school at which the
2626 employee works]; or
2727 (B) a student participant in an educational
2828 activity that is sponsored by a school district or a public or
2929 private primary or secondary school, if[:
3030 [(i)] students enrolled in a public or
3131 private primary or secondary school are the primary participants in
3232 the activity; [and
3333 [(ii) the employee provides education
3434 services to those participants;] or
3535 (3) engages in conduct described by Section 33.021,
3636 with a person described by Subdivision (1), or a person the employee
3737 knows is a person described by Subdivision (2)(A) or (B),
3838 regardless of the age of that person.
3939 SECTION 2. The change in law made by this Act applies only
4040 to an offense committed on or after the effective date of this Act.
4141 An offense committed before the effective date of this Act is
4242 governed by the law in effect on the date the offense was committed,
4343 and the former law is continued in effect for that purpose. For
4444 purposes of this section, an offense was committed before the
4545 effective date of this Act if any element of the offense was
4646 committed before that date.
4747 SECTION 3. This Act takes effect September 1, 2017.
