66 AN ACT
77 relating to the liability of a business that allows handguns to be
88 carried on the business's premises.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 4, Civil Practice and Remedies Code, is
1111 amended by adding Chapter 95A to read as follows:
1212 CHAPTER 95A. LIMITED LIABILITY FOR BUSINESS THAT ALLOWS HANDGUNS
1313 Sec. 95A.001. LIMITED LIABILITY FOR BUSINESS THAT ALLOWS
1414 HANDGUNS. The owner or operator of a business on the premises of
1515 which the carrying of a handgun is not otherwise unlawful is immune
1616 from civil liability with respect to any claim that is based on the
1717 owner's or operator's failure to exercise the option to forbid the
1818 carrying of handguns on the premises by customers or employees.
1919 SECTION 2. Chapter 95A, Civil Practice and Remedies Code,
2020 as added by this Act, does not apply to a cause of action that
2121 accrued before the effective date of this Act. A cause of action
2222 that accrued before the effective date of this Act is governed by
2323 the law applicable to the cause of action immediately before that
2424 date, and the former law is continued in effect for that purpose.
2525 SECTION 3. This Act takes effect September 1, 2017.
