9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Title 4, Civil Practice and Remedies Code, is | |
11 | 11 | amended by adding Chapter 95A to read as follows: | |
12 | 12 | CHAPTER 95A. LIMITED LIABILITY FOR BUSINESS THAT ALLOWS HANDGUNS | |
13 | 13 | Sec. 95A.001. LIMITED LIABILITY FOR BUSINESS THAT ALLOWS | |
14 | 14 | HANDGUNS. The owner or operator of a business on the premises of | |
15 | 15 | which the carrying of a handgun is not otherwise unlawful is immune | |
16 | 16 | from civil liability with respect to any claim that is based on the | |
17 | 17 | owner's or operator's failure to exercise the option to forbid the | |
18 | 18 | carrying of handguns on the premises by customers or employees. | |
19 | 19 | SECTION 2. Chapter 95A, Civil Practice and Remedies Code, | |
20 | 20 | as added by this Act, does not apply to a cause of action that | |
21 | 21 | accrued before the effective date of this Act. A cause of action | |
22 | 22 | that accrued before the effective date of this Act is governed by | |
23 | 23 | the law applicable to the cause of action immediately before that | |
24 | 24 | date, and the former law is continued in effect for that purpose. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2017. |
