| 12 | 6 | | boards make audio and video recordings of certain work sessions and |
|---|
| 13 | 7 | | special called meetings available on the Internet. |

| 14 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 9 | | SECTION 1. Section 551.128(b-1), Government Code, is |
|---|
| 16 | 10 | | amended to read as follows: |
|---|
| 17 | 11 | | (b-1) A transit authority or department subject to Chapter |
|---|
| 18 | 12 | | 451, 452, 453, or 460, Transportation Code, an elected school |
|---|
| 19 | 13 | | district board of trustees for a school district that has a student |
|---|
| 20 | 14 | | enrollment of 10,000 or more, an elected governing body of a |
|---|
| 21 | 15 | | home-rule municipality that has a population of 50,000 or more, or a |
|---|
| 22 | 16 | | county commissioners court for a county that has a population of |
|---|
| 23 | 17 | | 125,000 or more shall: |
|---|
| 24 | 18 | | (1) make a video and audio recording of reasonable |
|---|
| 25 | 19 | | quality of each: |
|---|
| 26 | 20 | | (A) regularly scheduled open meeting that is not |
|---|
| 27 | 21 | | a work session or a special called meeting; and |
|---|
| 28 | 22 | | (B) open meeting that is a work session or |
|---|
| 29 | 23 | | special called meeting if: |
|---|
| 30 | 24 | | (i) the governmental body is an elected |
|---|
| 31 | 25 | | school district board of trustees for a school district that has a |
|---|
| 32 | 26 | | student enrollment of 10,000 or more; and |
|---|
| 33 | 27 | | (ii) at the work session or special called |
|---|
| 34 | 28 | | meeting, the board of trustees votes on any matter or allows public |
|---|
| 35 | 29 | | comment or testimony; and |
|---|
| 36 | 30 | | (2) make available an archived copy of the video and |
|---|
| 37 | 31 | | audio recording of each meeting described by Subdivision (1) on the |
|---|
| 38 | 32 | | Internet. |
|---|
| 39 | 33 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 40 | 34 | | an open meeting held on or after the effective date of this Act. An |
|---|
| 41 | 35 | | open meeting that is held before the effective date of this Act is |
|---|
| 42 | 36 | | governed by the law in effect on the date of the open meeting, and |
|---|
| 43 | 37 | | the former law is continued in effect for that purpose. |

| 44 | 38 | | SECTION 3. This Act takes effect September 1, 2017. |
