6	6	AN ACT
7	7	relating to the salary paid to certain professional employees of
8	8	public schools.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Sections 21.402(a), (b), (c-1), and (e-1),
11	11	Education Code, are amended to read as follows:
12	12	(a) Except as provided by Subsection (e-1) or (f), a school
13	13	district must pay each classroom teacher, full-time librarian,
14	14	full-time school counselor certified under Subchapter B, or
15	15	full-time school nurse not less than the minimum monthly salary[,
16	16	based on the employee's level of experience in addition to other
17	17	factors, as determined by commissioner rule,] determined as
18	18	provided by Subsection (b) [the following formula:
19	19	[MS = SF x FS
20	20	[where:
21	21	["MS" is the minimum monthly salary;
22	22	["SF" is the applicable salary factor specified by Subsection
23	23	(c); and
24	24	["FS" is the amount, as determined by the commissioner under
25	25	Subsection (b), of the basic allotment as provided by Section
26	26	42.101(a) or (b) for a school district with a maintenance and
27	27	operations tax rate at least equal to the state maximum compressed
28	28	tax rate, as defined by Section 42.101(a)].
29	29	(b) The commissioner shall adopt rules to establish a method
30	30	for annually setting a salary schedule for classroom teachers,
31	31	full-time librarians, full-time school counselors certified under
32	32	Subchapter B, and full-time school nurses based on the employee's
33	33	level of experience. The commissioner's method must provide a
34	34	salary level for each year of experience from 0 years through 20
35	35	years. The commissioner shall ensure that the salary schedule is
36	36	consistent with the national average salary, based on experience,
37	37	for those employees as determined by statistics gathered by the
38	38	National Center for Education Statistics or a similar independent
39	39	education-oriented institution. Not later than June 1 of each
40	40	year, the commissioner shall determine, based on the salary
41	41	schedule, the minimum monthly salary for each classroom teacher,
42	42	full-time librarian, full-time school counselor certified under
43	43	Subchapter B, and full-time school nurse for the following school
44	44	year [the basic allotment and resulting monthly salaries to be paid
45	45	by school districts as provided by Subsection (a)].
46	46	(c-1) Notwithstanding Subsections (a) and (b), each school
47	47	district shall pay a monthly salary to each classroom teacher,
48	48	full-time speech pathologist, full-time librarian, full-time
49	49	school counselor certified under Subchapter B, and full-time school
50	50	nurse that is at least equal to the following monthly salary or the
51	51	monthly salary determined by the commissioner under Subsection
52	52	[Subsections (a) and] (b), whichever is greater:

99	99	(e-1) If the minimum monthly salary determined under
100	100	Subsection (b) [(a)] for a particular level of experience is less
101	101	than the minimum monthly salary for that level of experience in the
102	102	preceding year, the minimum monthly salary is the minimum monthly
103	103	salary for the preceding year.
104	104	SECTION 2. Subchapter E, Chapter 42, Education Code, is
105	105	amended by adding Section 42.2520 to read as follows:
106	106	Sec. 42.2520. ADDITIONAL STATE AID OR CREDIT AGAINST COST
107	107	OF ATTENDANCE CREDITS FOR PROFESSIONAL STAFF SALARIES. (a) For
108	108	each school year, a school district, including a school district
109	109	that is otherwise ineligible for state aid under this chapter, is
110	110	entitled to state aid in an amount, as determined by the
111	111	commissioner, equal to the difference between the district's salary
112	112	cost under Section 21.402, as amended by __.B. ___, Acts of the 85th
113	113	Legislature, Regular Session, 2017, for all classroom teachers,
114	114	full-time librarians, full-time school counselors certified under
115	115	Subchapter B, Chapter 21, and full-time school nurses employed by
116	116	the district and an amount equal to what the district's salary costs
117	117	would have been for that school year under Section 21.402, as it
118	118	existed before amendment by __.B. ___, Acts of the 85th
119	119	Legislature, Regular Session, 2017.
120	120	(b) A school district that is required to take action under
121	121	Chapter 41 to reduce its wealth per student to the equalized wealth
122	122	level is entitled to a credit, in the amount of state aid to which
123	123	the district is entitled under this section, against the total
124	124	amount required under Section 41.093 for the district to purchase
125	125	attendance credits.
126	126	(c) A determination by the commissioner under this section
127	127	is final and may not be appealed.
128	128	(d) The commissioner may adopt rules to implement this
129	129	section.
130	130	SECTION 3. Section 21.402(c), Education Code, is repealed.
131	131	SECTION 4. Not later than January 1, 2018, the commissioner
132	132	of education shall adopt rules to establish a method for annually
133	133	setting a salary schedule as provided by Section 21.402(b),
134	134	Education Code, as amended by this Act.
135	135	SECTION 5. This Act applies beginning with the 2018-2019
136	136	school year.
137	137	SECTION 6. This Act takes effect September 1, 2017.
