9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Article 102.006, Code of Criminal Procedure, is | |
11 | 11 | amended by adding Subsection (c) to read as follows: | |
12 | 12 | (c) A court that grants a petition for expunction of a | |
13 | 13 | criminal record may order that any fee, or portion of a fee, | |
14 | 14 | required to be paid under this article or other law in relation to | |
15 | 15 | the petition be returned to the petitioner. | |
16 | 16 | SECTION 2. The change in law made by this Act applies only | |
17 | 17 | to a petition for expunction filed on or after the effective date of | |
18 | 18 | this Act. A petition for expunction filed before the effective date | |
19 | 19 | of this Act is governed by the law in effect on the date the petition | |
20 | 20 | was filed, and the former law is continued in effect for that | |
21 | 21 | purpose. | |
22 | 22 | SECTION 3. This Act takes effect September 1, 2017. |
