66 AN ACT
77 relating to a committee formed to adopt a plan to deal with mental
88 illness in the criminal justice system.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle C, Title 7, Health and Safety Code, is
1111 amended by adding Chapter 580 to read as follows:
1212 CHAPTER 580. LOCAL COMMITTEE ON MENTAL HEALTH
1313 Sec. 580.001. DEFINITIONS. In this chapter:
1414 (1) "Committee" means a local committee on mental
1515 health formed by a local mental health authority.
1616 (2) "Department" means the Department of State Health
1717 Services.
1818 (3) "Region" means the local service area for which a
1919 local mental health authority designated under Section 533.035 is
2020 responsible.
2121 Sec. 580.002. LOCAL COMMITTEE ON MENTAL HEALTH. (a) Each
2222 local mental health authority shall form a local committee on
2323 mental health encompassing the authority's region.
2424 (b) The committee shall develop and adopt a plan and submit
2525 the plan to the department not later than January 1, 2019.
2626 Sec. 580.003. COMPOSITION OF COMMITTEE. The local mental
2727 health authority shall appoint the following members to the
2828 committee, if present in the region:
2929 (1) a county judge or a county commissioner to serve as
3030 committee chair;
3131 (2) a representative from each sheriff's department;
3232 (3) a representative from each district attorney's
3333 office;
3434 (4) a representative from the Department of Family and
3535 Protective Services' child protection division;
3636 (5) a representative from the Department of Family and
3737 Protective Services' adult protection division;
3838 (6) a representative from each adult probation office;
3939 (7) a representative from the local mental health
4040 authority;
4141 (8) a criminal trial judge;
4242 (9) an arraignment magistrate;
4343 (10) a representative from a faith-based or nonprofit
4444 organization;
4545 (11) a county veteran coordinator;
4646 (12) a representative from a private hospital; and
4747 (13) a representative from a public hospital.
4848 Sec. 580.004. DEVELOPMENT OF PLAN. (a) The committee shall
4949 develop and adopt a plan identifying:
5050 (1) the population of county jail inmates with mental
5151 illness;
5252 (2) a measurable goal for reducing the population of
5353 county jail inmates with mental illness within two years;
5454 (3) a method for improving indigent defense for
5555 persons with a mental illness who have been accused of a crime;
5656 (4) a method for addressing mental illness among
5757 veterans;
5858 (5) a method for quickly identifying and diverting
5959 persons with mental illness from the criminal justice system; and
6060 (6) a method for providing community supervision to
6161 reduce recidivism among criminogenic superutilizers of mental
6262 health resources.
6363 (b) The committee must unanimously agree on the adopted
6464 plan.
6565 Sec. 580.005. DISSOLUTION OF COMMITTEE. The committee
6666 shall dissolve after the committee submits its plan to the
6767 department.
6868 Sec. 580.006. CONDITION TO RECEIVE CONTINUED STATE FUNDING
6969 FOR BEHAVIORAL HEALTH. The department may not distribute to a local
7070 mental health authority state funds for mental or behavioral health
7171 services for the fiscal biennium beginning September 1, 2019,
7272 unless the authority's committee has submitted to the department
7373 its plan on or before January 1, 2019.
7474 Sec. 580.007. EXPIRATION. This chapter expires August 31,
7575 2021.
7676 SECTION 2. This Act takes effect September 1, 2017.
