7 | 7 | | relating to a committee formed to adopt a plan to deal with mental |

8 | 8 | | illness in the criminal justice system. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subtitle C, Title 7, Health and Safety Code, is |
---|
11 | 11 | | amended by adding Chapter 580 to read as follows: |
---|
12 | 12 | | CHAPTER 580. LOCAL COMMITTEE ON MENTAL HEALTH |
---|
13 | 13 | | Sec. 580.001. DEFINITIONS. In this chapter: |
---|
14 | 14 | | (1) "Committee" means a local committee on mental |
---|
15 | 15 | | health formed by a local mental health authority. |
---|
16 | 16 | | (2) "Department" means the Department of State Health |
---|
17 | 17 | | Services. |
---|
18 | 18 | | (3) "Region" means the local service area for which a |
---|
19 | 19 | | local mental health authority designated under Section 533.035 is |
---|
20 | 20 | | responsible. |
---|
21 | 21 | | Sec. 580.002. LOCAL COMMITTEE ON MENTAL HEALTH. (a) Each |
---|
22 | 22 | | local mental health authority shall form a local committee on |
---|
23 | 23 | | mental health encompassing the authority's region. |
---|
24 | 24 | | (b) The committee shall develop and adopt a plan and submit |
---|
25 | 25 | | the plan to the department not later than January 1, 2019. |
---|
26 | 26 | | Sec. 580.003. COMPOSITION OF COMMITTEE. The local mental |
---|
27 | 27 | | health authority shall appoint the following members to the |
---|
28 | 28 | | committee, if present in the region: |
---|
29 | 29 | | (1) a county judge or a county commissioner to serve as |
---|
30 | 30 | | committee chair; |
---|
31 | 31 | | (2) a representative from each sheriff's department; |
---|
32 | 32 | | (3) a representative from each district attorney's |
---|
33 | 33 | | office; |
---|
34 | 34 | | (4) a representative from the Department of Family and |
---|
35 | 35 | | Protective Services' child protection division; |
---|
36 | 36 | | (5) a representative from the Department of Family and |
---|
37 | 37 | | Protective Services' adult protection division; |
---|
38 | 38 | | (6) a representative from each adult probation office; |
---|
39 | 39 | | (7) a representative from the local mental health |
---|
40 | 40 | | authority; |
---|
41 | 41 | | (8) a criminal trial judge; |
---|
42 | 42 | | (9) an arraignment magistrate; |
---|
43 | 43 | | (10) a representative from a faith-based or nonprofit |
---|
44 | 44 | | organization; |
---|
45 | 45 | | (11) a county veteran coordinator; |
---|
46 | 46 | | (12) a representative from a private hospital; and |
---|
47 | 47 | | (13) a representative from a public hospital. |
---|
48 | 48 | | Sec. 580.004. DEVELOPMENT OF PLAN. (a) The committee shall |
---|
49 | 49 | | develop and adopt a plan identifying: |
---|
50 | 50 | | (1) the population of county jail inmates with mental |
---|
51 | 51 | | illness; |
---|
52 | 52 | | (2) a measurable goal for reducing the population of |
---|
53 | 53 | | county jail inmates with mental illness within two years; |
---|
54 | 54 | | (3) a method for improving indigent defense for |
---|
55 | 55 | | persons with a mental illness who have been accused of a crime; |
---|
56 | 56 | | (4) a method for addressing mental illness among |
---|
57 | 57 | | veterans; |
---|
58 | 58 | | (5) a method for quickly identifying and diverting |
---|
59 | 59 | | persons with mental illness from the criminal justice system; and |
---|
60 | 60 | | (6) a method for providing community supervision to |
---|
61 | 61 | | reduce recidivism among criminogenic superutilizers of mental |
---|
62 | 62 | | health resources. |
---|
63 | 63 | | (b) The committee must unanimously agree on the adopted |
---|
64 | 64 | | plan. |
---|
65 | 65 | | Sec. 580.005. DISSOLUTION OF COMMITTEE. The committee |
---|
66 | 66 | | shall dissolve after the committee submits its plan to the |
---|
67 | 67 | | department. |
---|
68 | 68 | | Sec. 580.006. CONDITION TO RECEIVE CONTINUED STATE FUNDING |
---|
69 | 69 | | FOR BEHAVIORAL HEALTH. The department may not distribute to a local |
---|
70 | 70 | | mental health authority state funds for mental or behavioral health |
---|
71 | 71 | | services for the fiscal biennium beginning September 1, 2019, |
---|
72 | 72 | | unless the authority's committee has submitted to the department |
---|
73 | 73 | | its plan on or before January 1, 2019. |
---|
74 | 74 | | Sec. 580.007. EXPIRATION. This chapter expires August 31, |
---|
75 | 75 | | 2021. |
---|
76 | 76 | | SECTION 2. This Act takes effect September 1, 2017. |
