55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a defense to prosecution for certain offenses involving
88 the operation or use of a commercial motor vehicle or other heavy
99 motor vehicle.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 502.473, Transportation Code, is amended
1212 by adding Subsections (e) and (f) to read as follows:
1313 (e) To the extent authorized by federal law, it is a defense
1414 to prosecution for an offense under this section involving the
1515 operation or use of a commercial motor vehicle that at the time of
1616 the offense the defendant:
1717 (1) was the operator of the commercial motor vehicle;
1818 and
1919 (2) was not the owner of the commercial motor vehicle.
2020 (f) In this section, "commercial motor vehicle" has the
2121 meaning assigned by Section 548.001.
2222 SECTION 2. Section 504.943, Transportation Code, is amended
2323 by adding Subsections (f) and (g) to read as follows:
2424 (f) It is a defense to prosecution for an offense under this
2525 section involving the operation or use of a commercial motor
2626 vehicle that at the time of the offense the defendant:
2727 (1) was the operator of the commercial motor vehicle;
2828 and
2929 (2) was not the owner of the commercial motor vehicle.
3030 (g) In this section, "commercial motor vehicle" has the
3131 meaning assigned by Section 548.001.
3232 SECTION 3. Section 621.501, Transportation Code, is amended
3333 by adding Subsection (c) to read as follows:
3434 (c) To the extent authorized by federal law, it is a defense
3535 to prosecution for an offense under this section that at the time of
3636 the offense the defendant:
3737 (1) was the operator of the vehicle; and
3838 (2) was not the owner of the vehicle.
3939 SECTION 4. Section 623.011, Transportation Code, is amended
4040 by adding Subsection (h) to read as follows:
4141 (h) To the extent authorized by federal law, it is a defense
4242 to prosecution for an offense under Subsection (f) that at the time
4343 of the offense the defendant:
4444 (1) was the operator of the vehicle; and
4545 (2) was not the owner of the vehicle.
4646 SECTION 5. Section 643.253, Transportation Code, is amended
4747 by adding Subsections (g) and (h) to read as follows:
4848 (g) To the extent authorized by federal law, it is a defense
4949 to prosecution for an offense under Subsection (a)(3) involving the
5050 operation or use of a commercial motor vehicle that at the time of
5151 the offense the defendant:
5252 (1) was the operator of the commercial motor vehicle;
5353 and
5454 (2) was not the owner of the commercial motor vehicle.
5555 (h) In this section, "commercial motor vehicle" has the
5656 meaning assigned by Section 548.001.
5757 SECTION 6. The change in law made by this Act applies only
5858 to an offense committed on or after the effective date of this Act.
5959 An offense committed before the effective date of this Act is
6060 governed by the law in effect on the date the offense was committed,
6161 and the former law is continued in effect for that purpose. For
6262 purposes of this section, an offense was committed before the
6363 effective date of this Act if any element of the offense occurred
6464 before that date.
6565 SECTION 7. This Act takes effect September 1, 2017.
