77 relating to the regulation of raw milk and raw milk products.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 435, Health and Safety
1010 Code, is amended by adding Sections 435.0061, 435.0062, and
1111 435.0063 to read as follows:
1212 Sec. 435.0061. RAW MILK AND RAW MILK PRODUCTS FOR RETAIL
1313 SALE. (a) This section does not authorize the sale of:
1414 (1) raw milk or raw milk products to or on the premises
1515 of a grocery store, supermarket, or similar retail market;
1616 (2) raw milk or raw milk products that are a blend of
1717 raw milk purchased from more than one holder of a permit issued
1818 under this chapter; or
1919 (3) raw milk or raw milk products by a person other
2020 than the permit holder or an employee or agent of the permit holder.
2121 (b) A permit holder authorized to sell raw milk or raw milk
2222 products at retail or an employee or agent of the permit holder may
2323 make retail sales of raw milk or raw milk products directly to a
2424 consumer in this state at:
2525 (1) the permit holder's place of business;
2626 (2) the consumer's residence; or
2727 (3) a farmers' market as defined by Section 437.020.
2828 (c) Raw milk and raw milk products must be maintained in
2929 compliance with Section 435.0063.
3030 (d) A person who sells raw milk or raw milk products under
3131 this section shall affix to individual raw milk or raw milk product
3232 containers a label that includes:
3333 (1) the name of the permit holder;
3434 (2) the permit holder's permit number;
3535 (3) the calendar date the raw milk or raw milk product
3636 was placed in the container; and
3737 (4) the following statement: "This product contains
3838 unpasteurized milk. Consuming raw foods, including raw dairy
3939 products, may increase your risk of food-borne illness. Persons at
4040 higher risk for food-borne illness include pregnant and nursing
4141 women, children, the elderly, and people with weakened immune
4242 systems."
4343 Sec. 435.0062. AVAILABILITY OF RECORDS ON RAW MILK TESTING.
4444 On request, the department shall provide the requestor with a
4545 record of test results from an inspection of raw milk or raw milk
4646 products conducted under Section 435.004 or 435.005.
4747 Sec. 435.0063. HANDLING AND TRANSPORTING RAW MILK AND RAW
4848 MILK PRODUCTS FOR RETAIL SALE. (a) Raw milk and raw milk products
4949 produced for retail sale under this chapter must be:
5050 (1) placed in an aseptic or single-use container; and
5151 (2) sold not later than the fifth day after the date
5252 the container was filled, unless the raw milk or raw milk product is
5353 frozen and remains frozen until sold.
5454 (b) Raw milk and raw milk products being transported for
5555 delivery must be:
5656 (1) maintained at or below 41 degrees Fahrenheit; and
5757 (2) protected from exposure to direct sunlight.
5858 (c) The department or a local health authority may not
5959 mandate the specific method for complying with a temperature
6060 requirement.
6161 (d) A producer may contract with another person to transport
6262 and deliver raw milk and raw milk products in accordance with this
6363 section. The producer is jointly and severally liable for
6464 transport and delivery of raw milk and raw milk products not
6565 conducted in accordance with this chapter and department rules.
6666 SECTION 2. Section 435.013, Health and Safety Code, is
6767 repealed.
6868 SECTION 3. This Act takes effect September 1, 2017.
