| 11 | 11 | | States and refugees or asylees lawfully admitted into the United |

| 12 | 12 | | States. |
|---|
| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 521.101, Transportation Code, is amended |
|---|
| 15 | 15 | | by adding Subsection (k-1) to read as follows: |
|---|
| 16 | 16 | | (k-1) The department shall include on a personal |
|---|
| 17 | 17 | | identification certificate issued to a person who is a legal |
|---|
| 18 | 18 | | permanent resident of the United States or refugee or asylee |
|---|
| 19 | 19 | | lawfully admitted into the United States an indication that the |
|---|
| 20 | 20 | | certificate is not valid proof of identity for voting purposes. |
|---|
| 21 | 21 | | SECTION 2. Section 521.121, Transportation Code, is amended |
|---|
| 22 | 22 | | by adding Subsection (f) to read as follows: |
|---|
| 23 | 23 | | (f) The department shall include on a driver's license |
|---|
| 24 | 24 | | issued to a person who is a legal permanent resident of the United |
|---|
| 25 | 25 | | States or refugee or asylee lawfully admitted into the United |
|---|
| 26 | 26 | | States an indication that the license is not valid proof of identity |
|---|
| 27 | 27 | | for voting purposes. |
|---|
| 28 | 28 | | SECTION 3. Section 521.142, Transportation Code, is amended |
|---|
| 29 | 29 | | by amending Subsection (b) and adding Subsection (j) to read as |
|---|
| 30 | 30 | | follows: |
|---|
| 31 | 31 | | (b) The application must include: |
|---|
| 32 | 32 | | (1) except as provided by Subsection (j), the |
|---|
| 33 | 33 | | thumbprints of the applicant or, if thumbprints cannot be taken, |
|---|
| 34 | 34 | | the index fingerprints of the applicant; |
|---|
| 35 | 35 | | (2) a photograph of the applicant; |
|---|
| 36 | 36 | | (3) the signature of the applicant; and |
|---|
| 37 | 37 | | (4) a brief description of the applicant. |
|---|
| 38 | 38 | | (j) An application of a person who is a legal permanent |
|---|
| 39 | 39 | | resident of the United States or refugee or asylee lawfully |
|---|
| 40 | 40 | | admitted into the United States must include a complete set of the |
|---|
| 41 | 41 | | applicant's fingerprints. |
|---|
| 42 | 42 | | SECTION 4. The changes in law made by this Act to Sections |
|---|
| 43 | 43 | | 521.101 and 521.121, Transportation Code, apply only to a driver's |
|---|
| 44 | 44 | | license or personal identification certificate issued or renewed on |
|---|
| 45 | 45 | | or after the effective date of this Act. A driver's license or |
|---|
| 46 | 46 | | personal identification certificate issued or renewed before the |
|---|
| 47 | 47 | | effective date of this Act is governed by the law in effect when the |
|---|
| 48 | 48 | | license or certificate was issued or renewed, and the former law is |
|---|
| 49 | 49 | | continued in effect for that purpose. |
|---|
| 50 | 50 | | SECTION 5. This Act takes effect September 1, 2017. |
