99 relating to the liability of a person who allows handguns to be
1010 carried on property owned, leased, or managed by the person.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Title 4, Civil Practice and Remedies Code, is
1313 amended by adding Chapter 95A to read as follows:
1414 CHAPTER 95A. LIMITED LIABILITY FOR CERTAIN PERSONS WHO ALLOW
1515 HANDGUNS
1616 Sec. 95A.001. DEFINITION. In this chapter, "license
1717 holder" means a person licensed to carry a handgun under Subchapter
1818 H, Chapter 411, Government Code, or a person with a license to carry
1919 a handgun issued by another state and recognized in this state.
2020 Sec. 95A.002. LIMITED LIABILITY FOR CERTAIN PERSONS WHO
2121 ALLOW HANDGUNS. There is no cause of action against an owner,
2222 lessee, or manager of property based on the owner's, lessee's, or
2323 manager's decision not to exercise the option to forbid the
2424 carrying of handguns by a license holder on the property by
2525 providing notice under Sections 30.06 and 30.07, Penal Code.
2626 SECTION 2. Chapter 95A, Civil Practice and Remedies Code,
2727 as added by this Act, does not apply to a cause of action that
2828 accrued before the effective date of this Act. A cause of action
2929 that accrued before the effective date of this Act is governed by
3030 the law applicable to the cause of action immediately before that
3131 date, and the former law is continued in effect for that purpose.
3232 SECTION 3. This Act takes effect September 1, 2017.
