| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Title 4, Civil Practice and Remedies Code, is |

| 13 | 13 | | amended by adding Chapter 95A to read as follows: |

| 14 | 14 | | CHAPTER 95A. LIMITED LIABILITY FOR CERTAIN PERSONS WHO ALLOW |

| 15 | 15 | | HANDGUNS |
|---|
| 16 | 16 | | Sec. 95A.001. DEFINITION. In this chapter, "license |
|---|
| 17 | 17 | | holder" means a person licensed to carry a handgun under Subchapter |
|---|
| 18 | 18 | | H, Chapter 411, Government Code, or a person with a license to carry |
|---|
| 19 | 19 | | a handgun issued by another state and recognized in this state. |
|---|
| 20 | 20 | | Sec. 95A.002. LIMITED LIABILITY FOR CERTAIN PERSONS WHO |
|---|
| 21 | 21 | | ALLOW HANDGUNS. There is no cause of action against an owner, |
|---|
| 22 | 22 | | lessee, or manager of property based on the owner's, lessee's, or |
|---|
| 23 | 23 | | manager's decision not to exercise the option to forbid the |
|---|
| 24 | 24 | | carrying of handguns by a license holder on the property by |
|---|
| 25 | 25 | | providing notice under Sections 30.06 and 30.07, Penal Code. |
|---|
| 26 | 26 | | SECTION 2. Chapter 95A, Civil Practice and Remedies Code, |
|---|
| 27 | 27 | | as added by this Act, does not apply to a cause of action that |
|---|
| 28 | 28 | | accrued before the effective date of this Act. A cause of action |
|---|
| 29 | 29 | | that accrued before the effective date of this Act is governed by |
|---|
| 30 | 30 | | the law applicable to the cause of action immediately before that |
|---|
| 31 | 31 | | date, and the former law is continued in effect for that purpose. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2017. |
