55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of a municipality to remove directors of
88 certain conservation and reclamation districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 178, Local Government Code, is amended
1111 by adding Subchapter Z to read as follows:
1212 SUBCHAPTER Z. MISCELLANEOUS PROVISIONS
1313 Sec. 178.901. REMOVAL OF DIRECTORS APPOINTED BY
1414 MUNICIPALITY TO CERTAIN BOARDS. Notwithstanding any other law, a
1515 director of a conservation and reclamation district created under
1616 Section 59, Article XVI, Texas Constitution, who is appointed by
1717 the governing body of a municipality, serves at the pleasure of the
1818 governing body and may be removed by the governing body at any time
1919 without cause.
2020 SECTION 2. This Act takes effect immediately if it receives
2121 a vote of two-thirds of all the members elected to each house, as
2222 provided by Section 39, Article III, Texas Constitution. If this
2323 Act does not receive the vote necessary for immediate effect, this
2424 Act takes effect September 1, 2017.
