| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. The heading to Subchapter H, Chapter 1701, |
|---|
| 10 | 10 | | Occupations Code, is amended to read as follows: |
|---|
| 11 | 11 | | SUBCHAPTER H. CONTINUING EDUCATION, REGULAR PSYCHOLOGICAL |
|---|
| 12 | 12 | | EXAMINATION, AND YEARLY WEAPONS PROFICIENCY |
|---|
| 13 | 13 | | SECTION 2. Subchapter H, Chapter 1701, Occupations Code, is |
|---|
| 14 | 14 | | amended by adding Section 1701.3556 to read as follows: |
|---|
| 15 | 15 | | Sec. 1701.3556. REGULAR PSYCHOLOGICAL EXAMINATION. (a) |
|---|
| 16 | 16 | | Each peace officer shall submit to the psychological examination |
|---|
| 17 | 17 | | described by Section 1701.306 once every 24 months. |
|---|
| 18 | 18 | | (b) The commission by rule shall: |
|---|
| 19 | 19 | | (1) provide grounds for which a law enforcement agency |
|---|
| 20 | 20 | | may exempt a peace officer from the requirements of this section; |
|---|
| 21 | 21 | | and |
|---|
| 22 | 22 | | (2) adopt procedures to ensure timely and accurate |
|---|
| 23 | 23 | | reporting by law enforcement agencies and persons licensed under |
|---|
| 24 | 24 | | this chapter of the results of a psychological examination required |
|---|
| 25 | 25 | | under this section. |
|---|
| 26 | 26 | | (c) The commission shall suspend the license of a peace |
|---|
| 27 | 27 | | officer who fails to comply with this section. |
|---|
| 28 | 28 | | SECTION 3. (a) Not later than December 1, 2017, the Texas |
|---|
| 29 | 29 | | Commission on Law Enforcement shall adopt rules necessary to |
|---|
| 30 | 30 | | implement the changes in law made by this Act. |
|---|
| 31 | 31 | | (b) A person who holds a license as a peace officer issued |
|---|
| 32 | 32 | | before the effective date of this Act may continue to renew that |
|---|
| 33 | 33 | | license without complying with Section 1701.3556, Occupations |
|---|
| 34 | 34 | | Code, as added by this Act. |
|---|
| 35 | 35 | | SECTION 4. This Act takes effect September 1, 2017. |
