55 AN ACT
66 relating to the regular psychological examination of peace officers
77 by the Texas Commission on Law Enforcement.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. The heading to Subchapter H, Chapter 1701,
1010 Occupations Code, is amended to read as follows:
1111 SUBCHAPTER H. CONTINUING EDUCATION, REGULAR PSYCHOLOGICAL
1212 EXAMINATION, AND YEARLY WEAPONS PROFICIENCY
1313 SECTION 2. Subchapter H, Chapter 1701, Occupations Code, is
1414 amended by adding Section 1701.3556 to read as follows:
1515 Sec. 1701.3556. REGULAR PSYCHOLOGICAL EXAMINATION. (a)
1616 Each peace officer shall submit to the psychological examination
1717 described by Section 1701.306 once every 24 months.
1818 (b) The commission by rule shall:
1919 (1) provide grounds for which a law enforcement agency
2020 may exempt a peace officer from the requirements of this section;
2121 and
2222 (2) adopt procedures to ensure timely and accurate
2323 reporting by law enforcement agencies and persons licensed under
2424 this chapter of the results of a psychological examination required
2525 under this section.
2626 (c) The commission shall suspend the license of a peace
2727 officer who fails to comply with this section.
2828 SECTION 3. (a) Not later than December 1, 2017, the Texas
2929 Commission on Law Enforcement shall adopt rules necessary to
3030 implement the changes in law made by this Act.
3131 (b) A person who holds a license as a peace officer issued
3232 before the effective date of this Act may continue to renew that
3333 license without complying with Section 1701.3556, Occupations
3434 Code, as added by this Act.
3535 SECTION 4. This Act takes effect September 1, 2017.
