| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 501.260, Occupations Code, is amended by |
|---|
| 11 | 11 | | adding Subsections (d), (e), (f), and (g) to read as follows: |
|---|
| 12 | 12 | | (d) A person licensed under this section may be employed by |
|---|
| 13 | 13 | | and practice in a private school. |
|---|
| 14 | 14 | | (e) A person may not use the title "licensed specialist in |
|---|
| 15 | 15 | | school psychology" or "school psychologist" unless the person holds |
|---|
| 16 | 16 | | a license issued under this section. |
|---|
| 17 | 17 | | (f) A person who holds a license under this section may not |
|---|
| 18 | 18 | | use the title "nationally certified school psychologist" unless the |
|---|
| 19 | 19 | | person holds the appropriate credentials as designated by the |
|---|
| 20 | 20 | | National Association of School Psychologists or a successor |
|---|
| 21 | 21 | | organization. |
|---|
| 22 | 22 | | (g) A person who holds a license under this section may not |
|---|
| 23 | 23 | | use a title that represents that the person is licensed under |
|---|
| 24 | 24 | | Section 501.252 unless the person holds a license under that |
|---|
| 25 | 25 | | section. A person who holds a license under this section may not |
|---|
| 26 | 26 | | use the title designated by the board under Section 501.259 unless |
|---|
| 27 | 27 | | the person holds a license under that section. |
|---|
| 28 | 28 | | SECTION 2. Sections 501.260(e), (f), and (g), Occupations |
|---|
| 29 | 29 | | Code, as added by this Act, apply only to conduct that occurs on or |
|---|
| 30 | 30 | | after the effective date of this Act. Conduct that occurs before the |
|---|
| 31 | 31 | | effective date of this Act is governed by the law in effect on the |
|---|
| 32 | 32 | | date the conduct occurred, and the former law is continued in effect |
|---|
| 33 | 33 | | for that purpose. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2017. |
