55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the applicability of student disciplinary requirements
88 to school districts of innovation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 12A.004(a), Education Code, is amended
1111 to read as follows:
1212 (a) A local innovation plan may not provide for the
1313 exemption of a district designated as a district of innovation from
1414 the following provisions of this title:
1515 (1) a state or federal requirement applicable to an
1616 open-enrollment charter school operating under Subchapter D,
1717 Chapter 12;
1818 (2) Subchapters A, C, D, and E, Chapter 11, except that
1919 a district may be exempt from Sections 11.1511(b)(5) and (14) and
2020 Section 11.162;
2121 (3) state curriculum and graduation requirements
2222 adopted under Chapter 28; [and]
2323 (4) Subchapter A, Chapter 37; and
2424 (5) academic and financial accountability and
2525 sanctions under Chapter 39.
2626 SECTION 2. Section 12A.004(a), Education Code, as amended
2727 by this Act, applies only to a local innovation plan adopted or
2828 renewed on or after the effective date of this Act. A local
2929 innovation plan adopted or renewed before the effective date of
3030 this Act is governed by the law in effect on the date the plan was
3131 adopted or renewed, and the former law is continued in effect for
3232 that purpose.
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2017.
