| 9 | 9 | | relating to a report on certain pending suits against the state, a |
|---|
| 10 | 10 | | state agency, or a state official. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter B, Chapter 403, Government Code, is |
|---|
| 13 | 13 | | amended by adding Section 403.0146 to read as follows: |
|---|
| 14 | 14 | | Sec. 403.0146. REPORT ON FISCAL IMPACT OF PENDING SUITS |
|---|
| 15 | 15 | | AGAINST THE STATE. (a) The comptroller shall produce a report that |
|---|
| 16 | 16 | | identifies each suit against the state, a state agency, or a state |
|---|
| 17 | 17 | | official: |
|---|
| 18 | 18 | | (1) in which the amount of the monetary claim in |
|---|
| 19 | 19 | | controversy is $10 million or more; and |
|---|
| 20 | 20 | | (2) that is pending as of August 31 of |
|---|
| 21 | 21 | | each even-numbered fiscal year. |
|---|
| 22 | 22 | | (b) In preparing the report required under this section, the |
|---|
| 23 | 23 | | comptroller shall use available information submitted to the |
|---|
| 24 | 24 | | comptroller by state agencies for the purpose of producing the most |
|---|
| 25 | 25 | | recent comprehensive annual financial report under Section |
|---|
| 26 | 26 | | 403.013(c). A state agency shall provide any information on |
|---|
| 27 | 27 | | pending suits requested by the comptroller for the purpose of |
|---|
| 28 | 28 | | producing the report. |
|---|
| 29 | 29 | | (c) Information relating to a suit described by Subsection |
|---|
| 30 | 30 | | (a) provided to the comptroller by a state agency, collected by the |
|---|
| 31 | 31 | | comptroller from a state agency, or that is used or created by the |
|---|
| 32 | 32 | | comptroller to produce the report described by this section is |
|---|
| 33 | 33 | | confidential and not subject to disclosure under Chapter 552. |
|---|
| 34 | 34 | | (d) Not later than December 31 of each even-numbered year, |
|---|
| 35 | 35 | | the comptroller shall deliver the report produced under this |
|---|
| 36 | 36 | | section to the governor, lieutenant governor, speaker of the house |
|---|
| 37 | 37 | | of representatives, House Appropriations Committee, Senate Finance |
|---|
| 38 | 38 | | Committee, and Legislative Budget Board. |
|---|
| 39 | 39 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2017. |
