99 relating to a report on certain pending suits against the state, a
1010 state agency, or a state official.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 403, Government Code, is
1313 amended by adding Section 403.0146 to read as follows:
1414 Sec. 403.0146. REPORT ON FISCAL IMPACT OF PENDING SUITS
1515 AGAINST THE STATE. (a) The comptroller shall produce a report that
1616 identifies each suit against the state, a state agency, or a state
1717 official:
1818 (1) in which the amount of the monetary claim in
1919 controversy is $10 million or more; and
2020 (2) that is pending as of August 31 of
2121 each even-numbered fiscal year.
2222 (b) In preparing the report required under this section, the
2323 comptroller shall use available information submitted to the
2424 comptroller by state agencies for the purpose of producing the most
2525 recent comprehensive annual financial report under Section
2626 403.013(c). A state agency shall provide any information on
2727 pending suits requested by the comptroller for the purpose of
2828 producing the report.
2929 (c) Information relating to a suit described by Subsection
3030 (a) provided to the comptroller by a state agency, collected by the
3131 comptroller from a state agency, or that is used or created by the
3232 comptroller to produce the report described by this section is
3333 confidential and not subject to disclosure under Chapter 552.
3434 (d) Not later than December 31 of each even-numbered year,
3535 the comptroller shall deliver the report produced under this
3636 section to the governor, lieutenant governor, speaker of the house
3737 of representatives, House Appropriations Committee, Senate Finance
3838 Committee, and Legislative Budget Board.
3939 SECTION 2. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2017.
