99 relating to a committee formed to adopt a plan to deal with mental
1010 illness in the juvenile justice system.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle C, Title 7, Health and Safety Code, is
1313 amended by adding Chapter 581 to read as follows:
1414 CHAPTER 581. LOCAL COMMITTEE ON CHILDREN'S MENTAL HEALTH
1515 Sec. 581.001. DEFINITIONS. In this chapter:
1616 (1) "Child" has the meaning assigned by Section 51.02,
1717 Family Code.
1818 (2) "Commission" means the Health and Human Services
1919 Commission.
2020 (3) "Committee" means a local committee on children's
2121 mental health formed by a local mental health authority.
2222 (4) "Region" means the local service area for which a
2323 local mental health authority designated under Section 533.035 is
2424 responsible.
2525 Sec. 581.002. LOCAL COMMITTEE ON CHILDREN'S MENTAL HEALTH.
2626 (a) Each local mental health authority shall form a local committee
2727 on children's mental health encompassing the authority's region.
2828 (b) The committee shall develop and adopt a plan and submit
2929 the plan to the commission not later than January 1, 2019.
3030 Sec. 581.003. COMPOSITION OF COMMITTEE. The local mental
3131 health authority shall appoint the following members to the
3232 committee, if present in the region:
3333 (1) a county judge or a county commissioner to serve as
3434 committee chair;
3535 (2) a representative from each sheriff's department;
3636 (3) a representative from other law enforcement
3737 agencies;
3838 (4) a representative from the office of each
3939 prosecuting attorney, as that term is defined by Section 51.02,
4040 Family Code;
4141 (5) a representative from the Department of Family and
4242 Protective Services' child protective services division;
4343 (6) a representative from each juvenile probation
4444 department;
4545 (7) a representative from the local mental health
4646 authority;
4747 (8) a juvenile court judge;
4848 (9) a juvenile arraignment magistrate;
4949 (10) a representative from a faith-based or nonprofit
5050 organization;
5151 (11) a representative from a private hospital; and
5252 (12) a representative from a public hospital.
5353 Sec. 581.004. DEVELOPMENT OF PLAN. (a) The committee shall
5454 develop and adopt a plan identifying:
5555 (1) the population of children with mental illness who
5656 are committed to the Texas Juvenile Justice Department;
5757 (2) a measurable goal for reducing the population of
5858 children with mental illness who are committed to the Texas
5959 Juvenile Justice Department;
6060 (3) a method for improving indigent defense for
6161 children with mental illness who are alleged to have engaged in
6262 delinquent conduct or conduct indicating a need for supervision
6363 under Section 51.03, Family Code;
6464 (4) a method for addressing mental illness among
6565 children who are the subject of an investigation under Chapter 261,
6666 Family Code;
6767 (5) a method for quickly identifying and diverting
6868 children with mental illness from the Texas Juvenile Justice
6969 Department in the interest of public safety, justice, and public
7070 health; and
7171 (6) a method for providing community supervision to:
7272 (A) reduce recidivism among children adjudicated
7373 as having engaged in delinquent conduct or conduct indicating a
7474 need for supervision under Section 51.03, Family Code; and
7575 (B) reduce the population of children aging out
7676 of the Texas Juvenile Justice Department and into the adult
7777 criminal justice system.
7878 (b) The committee must unanimously agree on the adopted
7979 plan.
8080 Sec. 581.005. DISSOLUTION OF COMMITTEE. The committee
8181 shall dissolve after the committee submits its plan to the
8282 commission.
8383 Sec. 581.006. CONDITION TO RECEIVE CONTINUED STATE FUNDING
8484 FOR MENTAL OR BEHAVIORAL HEALTH SERVICES. The commission may not
8585 distribute to a local mental health authority state funds for
8686 mental or behavioral health services for the fiscal biennium
8787 beginning September 1, 2019, unless the authority's committee has
8888 submitted to the commission its plan on or before January 1, 2019.
8989 Sec. 581.007. EXPIRATION. This chapter expires August 31,
9090 2021.
9191 SECTION 2. This Act takes effect September 1, 2017.
