66 AN ACT
77 relating to the prosecution of the offense of operation of unmanned
88 aircraft over correctional facility or critical infrastructure
99 facility.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The heading to Section 423.0045, Government
1212 Code, is amended to read as follows:
1313 Sec. 423.0045. OFFENSE: OPERATION OF UNMANNED AIRCRAFT OVER
1414 CORRECTIONAL FACILITY OR CRITICAL INFRASTRUCTURE FACILITY.
1515 SECTION 2. Section 423.0045(a), Government Code, is amended
1616 by amending Subdivision (1) and adding Subdivision (1-a) to read as
1717 follows:
1818 (1) "Correctional facility" means:
1919 (A) a confinement facility operated by or under
2020 contract with any division of the Texas Department of Criminal
2121 Justice;
2222 (B) a municipal or county jail; or
2323 (C) a secure correctional facility or secure
2424 detention facility, as defined by Section 51.02, Family Code.
2525 (1-a) "Critical infrastructure facility" means:
2626 (A) one of the following, if completely enclosed
2727 by a fence or other physical barrier that is obviously designed to
2828 exclude intruders, or if clearly marked with a sign or signs that
2929 are posted on the property, are reasonably likely to come to the
3030 attention of intruders, and indicate that entry is forbidden:
3131 (i) a petroleum or alumina refinery;
3232 (ii) an electrical power generating
3333 facility, substation, switching station, or electrical control
3434 center;
3535 (iii) a chemical, polymer, or rubber
3636 manufacturing facility;
3737 (iv) a water intake structure, water
3838 treatment facility, wastewater treatment plant, or pump station;
3939 (v) a natural gas compressor station;
4040 (vi) a liquid natural gas terminal or
4141 storage facility;
4242 (vii) a telecommunications central
4343 switching office;
4444 (viii) a port, railroad switching yard,
4545 trucking terminal, or other freight transportation facility;
4646 (ix) a gas processing plant, including a
4747 plant used in the processing, treatment, or fractionation of
4848 natural gas;
4949 (x) a transmission facility used by a
5050 federally licensed radio or television station;
5151 (xi) a steelmaking facility that uses an
5252 electric arc furnace to make steel; or
5353 (xii) a dam that is classified as a high
5454 hazard by the Texas Commission on Environmental Quality; or
5555 (B) any portion of an aboveground oil, gas, or
5656 chemical pipeline that is enclosed by a fence or other physical
5757 barrier that is obviously designed to exclude intruders.
5858 SECTION 3. Sections 423.0045(b) and (c), Government Code,
5959 are amended to read as follows:
6060 (b) A person commits an offense if the person intentionally
6161 or knowingly:
6262 (1) operates an unmanned aircraft over a correctional
6363 facility or critical infrastructure facility and the unmanned
6464 aircraft is not higher than 400 feet above ground level;
6565 (2) allows an unmanned aircraft to make contact with a
6666 correctional facility or critical infrastructure facility,
6767 including any person or object on the premises of or within the
6868 facility; or
6969 (3) allows an unmanned aircraft to come within a
7070 distance of a correctional facility or critical infrastructure
7171 facility that is close enough to interfere with the operations of or
7272 cause a disturbance to the facility.
7373 (c) This section does not apply to:
7474 (1) conduct described by Subsection (b) that involves
7575 a correctional facility or critical infrastructure facility and
7676 [that] is committed by:
7777 (A) [(1)] the federal government, the state, or a
7878 governmental entity;
7979 (B) [(2)] a person under contract with or
8080 otherwise acting under the direction or on behalf of the federal
8181 government, the state, or a governmental entity;
8282 (C) [(3)] a law enforcement agency;
8383 (D) [(4)] a person under contract with or
8484 otherwise acting under the direction or on behalf of a law
8585 enforcement agency; or
8686 (E) an operator of an unmanned aircraft that is
8787 being used for a commercial purpose, if the operator is authorized
8888 by the Federal Aviation Administration to conduct operations over
8989 that airspace; or
9090 (2) conduct described by Subsection (b) that involves
9191 a critical infrastructure facility and is committed by:
9292 (A) [(5)] an owner or operator of the critical
9393 infrastructure facility;
9494 (B) [(6)] a person under contract with or
9595 otherwise acting under the direction or on behalf of an owner or
9696 operator of the critical infrastructure facility;
9797 (C) [(7)] a person who has the prior written
9898 consent of the owner or operator of the critical infrastructure
9999 facility; or
100100 (D) [(8)] the owner or occupant of the property
101101 on which the critical infrastructure facility is located or a
102102 person who has the prior written consent of the owner or occupant of
103103 that property[; or
104104 [(9) an operator of an unmanned aircraft that is being
105105 used for a commercial purpose, if the operator is authorized by the
106106 Federal Aviation Administration to conduct operations over that
107107 airspace].
108108 SECTION 4. The change in law made by this Act applies only
109109 to an offense committed on or after the effective date of this Act.
110110 An offense committed before the effective date of this Act is
111111 governed by the law in effect on the date the offense was committed,
112112 and the former law is continued in effect for that purpose. For
113113 purposes of this section, an offense was committed before the
114114 effective date of this Act if any element of the offense occurred
115115 before that date.
116116 SECTION 5. This Act takes effect September 1, 2017.
