88 AN ACT
99 relating to criminal liability for certain federal motor carrier
1010 safety regulation violations; creating a criminal offense.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 644.151, Transportation Code, is amended
1313 by amending Subsections (a) and (b) and adding Subsection (b-1) to
1414 read as follows:
1515 (a) A person commits an offense if the person:
1616 (1) violates a rule adopted under this chapter; [or]
1717 (2) does not permit an inspection authorized under
1818 Section 644.104; or
1919 (3) knowingly operates a commercial motor vehicle in
2020 violation of an out-of-service order issued under 49 C.F.R. Section
2121 385.13(d)(1) or owns, leases, or assigns a person to drive a
2222 commercial motor vehicle that is knowingly operated in violation of
2323 an out-of-service order issued under 49 C.F.R. Section
2424 385.13(d)(1).
2525 (b) An offense under Subsection (a)(1) or (2) [this section]
2626 is a Class C misdemeanor.
2727 (b-1) An offense under Subsection (a)(3) is a Class A
2828 misdemeanor, except that the offense is:
2929 (1) a state jail felony if it is shown on the trial of
3030 the offense that at the time of the offense the commercial motor
3131 vehicle was involved in a motor vehicle accident that resulted in
3232 bodily injury; or
3333 (2) a felony of the second degree if it is shown on the
3434 trial of the offense that at the time of the offense the commercial
3535 motor vehicle was involved in a motor vehicle accident that
3636 resulted in the death of a person.
3737 SECTION 2. This Act takes effect September 1, 2017.
