| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 36.116(c), Water Code, is amended to | |
| 11 | 11 | read as follows: | |
| 12 | 12 | (c) In regulating the production of groundwater based on | |
| 13 | 13 | tract size or acreage, a district shall [may] consider the service | |
| 14 | 14 | needs or service area of the [a] retail public utility that serves | |
| 15 | 15 | the territory where production is regulated by the district. For | |
| 16 | 16 | the purposes of this subsection, "retail public utility" has [shall | |
| 17 | 17 | have] the meaning assigned [provided] by Section 13.002. A | |
| 18 | 18 | district may determine whether it is appropriate to base the | |
| 19 | 19 | production amount on a retail public utility's service needs or | |
| 20 | 20 | service area under this subsection. | |
| 21 | 21 | SECTION 2. This Act takes effect September 1, 2017. |
