66 AN ACT
77 relating to food and beverages available from a vending machine
88 located on property used by a state agency.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 2203, Government Code, is amended by
1111 adding Section 2203.006 to read as follows:
1212 Sec. 2203.006. STANDARDS FOR VENDING MACHINE FOOD AND
1313 BEVERAGES. (a) In this section, "department" means the Department
1414 of State Health Services.
1515 (b) This section applies to food and beverages offered in a
1616 vending machine that is located on property that is:
1717 (1) owned by the state and under the charge and control
1818 of a state agency; or
1919 (2) leased by the state for the use of a state agency.
2020 (c) Food and beverages to which this section applies must
2121 meet minimum nutrition standards adopted by rule by the department.
2222 (d) The minimum nutrition standards must ensure that:
2323 (1) food offered in a vending machine:
2424 (A) contains zero grams of trans fatty acids per
2525 serving, as defined by the United States Food and Drug
2626 Administration; and
2727 (B) contains not more than:
2828 (i) 230 milligrams of sodium per serving if
2929 the food is not a refrigerated meal or other individual meal item;
3030 or
3131 (ii) 480 milligrams of sodium per serving
3232 if the food is a refrigerated meal or other individual meal item;
3333 (2) at least half of the beverage choices offered in a
3434 vending machine, excluding unsweetened milk and 100 percent juice,
3535 contain less than 40 calories per serving;
3636 (3) any milk offered is two percent, one percent, or
3737 nonfat;
3838 (4) if juice is offered, at least one offering is 100
3939 percent juice with no added sweetener; and
4040 (5) any vegetable juice offered contains not more than
4141 230 milligrams of sodium per serving.
4242 (e) In addition to the minimum nutrition standards required
4343 under Subsection (d)(1), at least 25 percent of packaged foods that
4444 are offered in a vending machine, other than nuts and seeds that do
4545 not have added fats, oils, or sweeteners, must:
4646 (1) have a calorie content made up of:
4747 (A) not more than 10 percent saturated fat; and
4848 (B) not more than 35 percent sugars, excluding
4949 fruits and vegetables without added sweeteners; and
5050 (2) have less than 200 calories.
5151 (f) A vending machine to which this section applies must
5252 display the total calorie content for each item offered.
5353 (g) The department shall, at least every five years, review
5454 and, if necessary, update the minimum nutrition standards adopted
5555 under this section. In reviewing the standards, the department
5656 shall consider advancements in nutrition science, dietary data, new
5757 product availability, and updates to the Dietary Guidelines for
5858 Americans, as published by the United States Department of
5959 Agriculture and the United States Department of Health and Human
6060 Services.
6161 (h) A contract with a vendor for operation of a vending
6262 machine to which this section applies must include a provision
6363 requiring the vendor to offer food and beverages that meet the
6464 minimum nutrition standards adopted by the department under this
6565 section.
6666 (i) The statewide wellness coordinator designated under
6767 Section 664.053 shall provide information and resources to state
6868 agencies to promote state employee wellness through implementing
6969 the requirements of this section.
7070 SECTION 2. (a) Not later than September 1, 2018, the
7171 Department of State Health Services shall adopt rules to establish
7272 minimum nutrition standards under Section 2203.006, Government
7373 Code, as added by this Act.
7474 (b) Except as provided by Subsection (c) of this section, a
7575 state agency is not required to comply with Section 2203.006,
7676 Government Code, as added by this Act, until September 1, 2019.
7777 (c) Section 2203.006(h), Government Code, as added by this
7878 Act, applies only to a contract for vending machine services for
7979 which a state agency first advertises or otherwise solicits bids,
8080 proposals, offers, or qualifications on or after September 1, 2018.
8181 SECTION 3. This Act takes effect immediately if it receives
8282 a vote of two-thirds of all the members elected to each house, as
8383 provided by Section 39, Article III, Texas Constitution. If this
8484 Act does not receive the vote necessary for immediate effect, this
8585 Act takes effect September 1, 2017.
