99 relating to notice to policyholders and agents of certain changes
1010 to property and casualty insurance policies.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 551.103, Insurance Code, is amended to
1313 read as follows:
1414 Sec. 551.103. CANCELLATION. For the purposes of this
1515 subchapter, an insurer has canceled an insurance policy if the
1616 insurer, without the consent of the insured:
1717 (1) terminates coverage provided under the policy;
1818 (2) refuses to provide additional coverage to which
1919 the insured is entitled under the policy; or
2020 (3) except as provided by Section 551.1055, reduces or
2121 restricts coverage under the policy by endorsement or other means.
2222 SECTION 2. Subchapter C, Chapter 551, Insurance Code, is
2323 amended by adding Section 551.1055 to read as follows:
2424 Sec. 551.1055. CHANGES TO POLICY ON RENEWAL. (a) In this
2525 section, "material change" means a change to a policy that, with
2626 respect to a prior or existing policy:
2727 (1) reduces coverage;
2828 (2) changes conditions of coverage; or
2929 (3) changes the duties of the insured.
3030 (b) Notwithstanding Section 551.103, a change to a policy
3131 provision on renewal is not a nonrenewal or cancellation under this
3232 subchapter if the insurer provides the insured with written notice
3333 in accordance with this section of any material change in each form
3434 of the policy offered to the insured on renewal from the form of the
3535 policy held immediately before renewal.
3636 (c) Notice provided under Subsection (b) must:
3737 (1) appear in a conspicuous place in the notice of
3838 renewal;
3939 (2) clearly indicate each material change to the
4040 policy being made on renewal;
4141 (3) be written in plain language; and
4242 (4) be provided to the insured not later than the 30th
4343 day before the renewal date.
4444 (d) In addition to the notice to the insured provided under
4545 Subsection (b), if an insurer elects to make a material change to a
4646 policy form on renewal, not later than the 30th day before the
4747 earliest renewal date on which the new policy form is used, the
4848 insurer shall provide written notice to each agent of the insurer
4949 that clearly indicates each material change being made to the
5050 policy form. An insurer may provide the notice to the agents in a
5151 single notice given to each agent of the insurer that summarizes
5252 substantially similar material changes to more than one policy
5353 form.
5454 (e) Notwithstanding this section, for a personal automobile
5555 insurance policy, an insurer must comply with Sections 551.105 and
5656 551.106(b).
5757 SECTION 3. Section 551.110, Insurance Code, is amended to
5858 read as follows:
5959 Sec. 551.110. LIABILITY FOR DISCLOSURE. An insurer or
6060 agent or an employee of an insurer or agent is not liable for a
6161 notice, statement, or disclosure made in good faith under this
6262 subchapter unless the notice, statement, or disclosure was:
6363 (1) known to be false; or
6464 (2) made with malice or wilful intent to injure any
6565 person.
6666 SECTION 4. Section 2002.001, Insurance Code, is amended to
6767 read as follows:
6868 Sec. 2002.001. POLICY FORM OR ENDORSEMENT MAKING MATERIAL
6969 CHANGE TO POLICY [ENDORSEMENTS REDUCING AMOUNT OF COVERAGE]. (a)
7070 In this section, "material change" means a change to a policy that,
7171 with respect to a prior or existing policy:
7272 (1) reduces coverage;
7373 (2) changes conditions of coverage; or
7474 (3) changes the duties of the insured.
7575 (b) An insurer may not use a policy form or [an] endorsement
7676 to a policy form to which Article 5.35, Subchapter B of this
7777 chapter, or Subchapter B, Chapter 2301, applies that makes a
7878 material change to [reduces coverage that would otherwise be
7979 provided under] the policy unless:
8080 (1) the insured requests the material change
8181 [endorsement]; or
8282 (2) the insurer provides the policyholder in a written
8383 notice an [with a written] explanation of [the change made by] the
8484 material change that:
8585 (A) appears in a conspicuous place on the notice
8686 of the material change;
8787 (B) clearly indicates each material change to the
8888 policy;
8989 (C) is written in plain language; and
9090 (D) is provided to the policyholder
9191 [endorsement] not later than the 30th day before the date on which
9292 the policy expires.
9393 (c) Notice required by Subsection (b) may be provided to the
9494 policyholder in a notice of renewal.
9595 (d) In addition to the notice to the policyholder provided
9696 under Subsection (b), if an insurer elects to make a material change
9797 to a policy form or use an endorsement to make a material change to a
9898 policy form, not later than the 30th day before the earliest date on
9999 which the new policy form or endorsement is used, the insurer shall
100100 provide written notice to each agent of the insurer that clearly
101101 indicates each material change being made to the policy form. An
102102 insurer may provide the notice to the agents in a single notice
103103 given to each agent of the insurer that summarizes substantially
104104 similar material changes to more than one policy form.
105105 SECTION 5. The heading to Subchapter C, Chapter 2002,
106106 Insurance Code, is amended to read as follows:
107107 SUBCHAPTER C. ITEMS PROVIDED [TO POLICYHOLDER] IN CONNECTION WITH
108108 INSURANCE POLICY
109109 SECTION 6. Section 2002.102, Insurance Code, is amended to
110110 read as follows:
111111 Sec. 2002.102. NOTICE OF RENEWAL. (a) In this section,
112112 "material change" means a change to a policy that, with respect to a
113113 prior or existing policy:
114114 (1) reduces coverage;
115115 (2) changes conditions of coverage; or
116116 (3) changes the duties of the policyholder.
117117 (b) An insurer, including a farm mutual insurance company,
118118 county mutual insurance company, Lloyd's plan, or reciprocal or
119119 interinsurance exchange, that renews a homeowners insurance
120120 policy, fire and residential allied lines insurance policy, farm
121121 and ranch owners insurance policy, or farm and ranch insurance
122122 policy must provide the policyholder with written notice in
123123 accordance with this section of any material change in [difference
124124 between] each form of the policy offered to the policyholder on
125125 renewal from [and] the form of the policy held immediately before
126126 renewal.
127127 (c) [(b)] A notice provided under this section must:
128128 (1) appear in a conspicuous place in the notice of
129129 renewal;
130130 (2) clearly indicate each material change to the
131131 policy being made on renewal;
132132 (3) be written in plain language; and
133133 (4) be provided to the policyholder not later than the
134134 30th day before the renewal date.
135135 (d) In addition to the notice to the policyholder provided
136136 under this section, if an insurer elects to make a material change
137137 to a policy form on renewal, not later than the 30th day before the
138138 earliest renewal date on which the new policy form is used, the
139139 insurer shall provide written notice to each agent of the insurer
140140 that clearly indicates each material change being made to the
141141 policy form. An insurer may provide the notice to the agents in a
142142 single notice given to each agent of the insurer that summarizes
143143 substantially similar material changes to more than one policy
144144 form.
145145 (e) [(c)] The commissioner may adopt rules as necessary to
146146 implement this section.
147147 SECTION 7. The change in law made by this Act applies only
148148 to an insurance policy delivered, issued for delivery, or renewed
149149 on or after January 1, 2018. A policy delivered, issued for
150150 delivery, or renewed before that date is governed by the law as it
151151 existed immediately before the effective date of this Act, and that
152152 law is continued in effect for that purpose.
153153 SECTION 8. This Act takes effect September 1, 2017.
