55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the effect of certain agreements with a collective
88 bargaining organization on certain state-funded public work
99 contracts.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter T, Chapter 51, Education Code, is
1212 amended by adding Section 51.7761 to read as follows:
1313 Sec. 51.7761. AGREEMENT WITH COLLECTIVE BARGAINING
1414 ORGANIZATION. (a) In this section, "public work contract" means a
1515 contract for constructing, altering, or repairing a public building
1616 or carrying out or completing any public work.
1717 (b) An institution awarding a public work contract funded
1818 with state money, including the issuance of debt guaranteed by this
1919 state, may not:
2020 (1) prohibit, require, discourage, or encourage a
2121 person bidding on the public work contract, including a contractor
2222 or subcontractor, from entering into or adhering to an agreement
2323 with a collective bargaining organization relating to the project;
2424 or
2525 (2) discriminate against a person described by
2626 Subdivision (1) based on the person's involvement in the agreement,
2727 including the person's:
2828 (A) status or lack of status as a party to the
2929 agreement; or
3030 (B) willingness or refusal to enter into the
3131 agreement.
3232 (c) This section may not be construed to:
3333 (1) prohibit activity protected by the National Labor
3434 Relations Act (29 U.S.C. Section 151 et seq.), including entering
3535 into an agreement with a collective bargaining organization
3636 relating to the project; or
3737 (2) permit conduct prohibited under the National Labor
3838 Relations Act (29 U.S.C. Section 151 et seq.).
3939 SECTION 2. Subchapter B, Chapter 2269, Government Code, is
4040 amended by adding Section 2269.0541 to read as follows:
4141 Sec. 2269.0541. AGREEMENT WITH COLLECTIVE BARGAINING
4242 ORGANIZATION. (a) A governmental entity awarding a public work
4343 contract funded with state money, including the issuance of debt
4444 guaranteed by this state, may not:
4545 (1) prohibit, require, discourage, or encourage a
4646 person bidding on the public work contract, including a contractor
4747 or subcontractor, from entering into or adhering to an agreement
4848 with a collective bargaining organization relating to the project;
4949 or
5050 (2) discriminate against a person described by
5151 Subdivision (1) based on the person's involvement in the agreement,
5252 including the person's:
5353 (A) status or lack of status as a party to the
5454 agreement; or
5555 (B) willingness or refusal to enter into the
5656 agreement.
5757 (b) This section may not be construed to:
5858 (1) prohibit activity protected by the National Labor
5959 Relations Act (29 U.S.C. Section 151 et seq.), including entering
6060 into an agreement with a collective bargaining organization
6161 relating to the project; or
6262 (2) permit conduct prohibited under the National Labor
6363 Relations Act (29 U.S.C. Section 151 et seq.).
6464 SECTION 3. Section 51.7761, Education Code, and Section
6565 2269.0541, Government Code, as added by this Act, apply only to a
6666 public work contract for which an invitation for offers, request
6767 for proposals, request for qualifications, or other similar
6868 solicitation is first published or distributed on or after the
6969 effective date of this Act. A public work contract for which an
7070 invitation for offers, request for proposals, request for
7171 qualifications, or other similar solicitation is first published or
7272 distributed before the effective date of this Act is governed by the
7373 law in effect at the time the invitation, request, or other
7474 solicitation is published or distributed, and the former law is
7575 continued in effect for that purpose.
7676 SECTION 4. This Act takes effect immediately if it receives
7777 a vote of two-thirds of all the members elected to each house, as
7878 provided by Section 39, Article III, Texas Constitution. If this
7979 Act does not receive the vote necessary for immediate effect, this
8080 Act takes effect September 1, 2017.
