66 AN ACT
77 relating to the deposit and appropriation of revenue received or
88 collected by the Automobile Burglary and Theft Prevention
99 Authority.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 10(e), Article 4413(37), Revised
1212 Statutes, is amended to read as follows:
1313 (e) The [Fifty percent of each] fee collected under
1414 Subsection (b) of this section shall be deposited to the credit of
1515 the subaccount described by Section 13 of this article and may be
1616 appropriated only to the department [authority] for [the] purposes
1717 of the authority under this article.
1818 SECTION 2. Article 4413(37), Revised Statutes, is amended
1919 by adding Section 13 to read as follows:
2020 Sec. 13. DEPOSIT AND APPROPRIATION OF REVENUE. All gifts,
2121 grants, and other revenue collected or received by the authority
2222 shall be deposited to the credit of a subaccount in the Texas
2323 Department of Motor Vehicles fund and may be appropriated only to
2424 the department for purposes of the authority under this article.
2525 SECTION 3. Section 1001.152, Transportation Code, is
2626 amended to read as follows:
2727 Sec. 1001.152. USE OF MONEY IN FUND. Money that is required
2828 to be deposited in the state treasury to the credit of the Texas
2929 Department of Motor Vehicles fund may be used by the department
3030 only:
3131 (1) to support the department's operations and the
3232 administration and enforcement of the department's functions; [or]
3333 (2) to pay the accounting costs and related
3434 liabilities for the fund, including fringe benefits, workers'
3535 compensation, and unemployment compensation; or
3636 (3) for purposes of the Automobile Burglary and Theft
3737 Prevention Authority under Section 13, Article 4413(37), Revised
3838 Statutes.
3939 SECTION 4. Section 1001.151(c), Transportation Code, is
4040 repealed.
4141 SECTION 5. This Act takes effect September 1, 2017.
