| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 10(e), Article 4413(37), Revised |
|---|
| 12 | 12 | | Statutes, is amended to read as follows: |
|---|
| 13 | 13 | | (e) The [Fifty percent of each] fee collected under |
|---|
| 14 | 14 | | Subsection (b) of this section shall be deposited to the credit of |
|---|
| 15 | 15 | | the subaccount described by Section 13 of this article and may be |
|---|
| 16 | 16 | | appropriated only to the department [authority] for [the] purposes |
|---|
| 17 | 17 | | of the authority under this article. |
|---|
| 18 | 18 | | SECTION 2. Article 4413(37), Revised Statutes, is amended |
|---|
| 19 | 19 | | by adding Section 13 to read as follows: |
|---|
| 20 | 20 | | Sec. 13. DEPOSIT AND APPROPRIATION OF REVENUE. All gifts, |
|---|
| 21 | 21 | | grants, and other revenue collected or received by the authority |
|---|
| 22 | 22 | | shall be deposited to the credit of a subaccount in the Texas |
|---|
| 23 | 23 | | Department of Motor Vehicles fund and may be appropriated only to |
|---|
| 24 | 24 | | the department for purposes of the authority under this article. |
|---|
| 25 | 25 | | SECTION 3. Section 1001.152, Transportation Code, is |
|---|
| 26 | 26 | | amended to read as follows: |
|---|
| 27 | 27 | | Sec. 1001.152. USE OF MONEY IN FUND. Money that is required |
|---|
| 28 | 28 | | to be deposited in the state treasury to the credit of the Texas |
|---|
| 29 | 29 | | Department of Motor Vehicles fund may be used by the department |
|---|
| 30 | 30 | | only: |
|---|
| 31 | 31 | | (1) to support the department's operations and the |
|---|
| 32 | 32 | | administration and enforcement of the department's functions; [or] |
|---|
| 33 | 33 | | (2) to pay the accounting costs and related |
|---|
| 34 | 34 | | liabilities for the fund, including fringe benefits, workers' |
|---|
| 35 | 35 | | compensation, and unemployment compensation; or |
|---|
| 36 | 36 | | (3) for purposes of the Automobile Burglary and Theft |
|---|
| 37 | 37 | | Prevention Authority under Section 13, Article 4413(37), Revised |
|---|
| 38 | 38 | | Statutes. |
|---|
| 39 | 39 | | SECTION 4. Section 1001.151(c), Transportation Code, is |
|---|
| 40 | 40 | | repealed. |
|---|
| 41 | 41 | | SECTION 5. This Act takes effect September 1, 2017. |
