| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 85, Election Code, is |
|---|
| 11 | 11 | | amended by adding Section 85.0631 to read as follows: |
|---|
| 12 | 12 | | Sec. 85.0631. DAYS AND HOURS FOR VOTING: TEMPORARY BRANCH. |
|---|
| 13 | 13 | | (a) Except as provided by Subsection (b), early voting by personal |
|---|
| 14 | 14 | | appearance at a temporary branch polling place may be conducted on |
|---|
| 15 | 15 | | any one or more days and during any hours of the period for early |
|---|
| 16 | 16 | | voting by personal appearance, as determined by the authority |
|---|
| 17 | 17 | | establishing the branch. |
|---|
| 18 | 18 | | (b) In an election in which the authority ordering the |
|---|
| 19 | 19 | | election has established at least five temporary branch polling |
|---|
| 20 | 20 | | places in the territory served by the early voting clerk, early |
|---|
| 21 | 21 | | voting by personal appearance at no less than 80 percent of the |
|---|
| 22 | 22 | | temporary branch polling places shall be conducted on the same days |
|---|
| 23 | 23 | | and during the same hours as voting is conducted at the main early |
|---|
| 24 | 24 | | voting polling place. For purposes of this subsection, a temporary |
|---|
| 25 | 25 | | branch polling place does not include a temporary branch polling |
|---|
| 26 | 26 | | place established at a church. |
|---|
| 27 | 27 | | (c) The authority authorized under Section 85.006 to order |
|---|
| 28 | 28 | | early voting on a Saturday or Sunday may order such voting at any |
|---|
| 29 | 29 | | temporary branch polling place that is not required to conduct |
|---|
| 30 | 30 | | voting on the same days and during the same hours as voting is |
|---|
| 31 | 31 | | conducted at the main early voting polling place under Subsection |
|---|
| 32 | 32 | | (b). |
|---|
| 33 | 33 | | SECTION 2. Section 85.068(a), Election Code, is amended to |
|---|
| 34 | 34 | | read as follows: |
|---|
| 35 | 35 | | (a) The early voting clerk shall post notice for each |
|---|
| 36 | 36 | | election stating any dates and the hours that voting on Saturday or |
|---|
| 37 | 37 | | Sunday will be conducted at a temporary branch polling place [under |
|---|
| 38 | 38 | | Section 85.064(d) or 85.065(b)], if the early voting clerk is a |
|---|
| 39 | 39 | | county clerk or city secretary under Section 83.002 or 83.005. |
|---|
| 40 | 40 | | SECTION 3. Sections 85.064 and 85.065, Election Code, are |
|---|
| 41 | 41 | | repealed. |
|---|
| 42 | 42 | | SECTION 4. This Act takes effect September 1, 2017. |
