55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a requirement that school districts and open-enrollment
88 charter schools report certain information regarding children with
99 disabilities who reside in residential facilities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 29.012, Education Code, is amended by
1212 adding Subsection (c-1) to read as follows:
1313 (c-1) The commissioner by rule shall require each school
1414 district and open-enrollment charter school to include in the
1515 district's or school's Public Education Information Management
1616 System (PEIMS) report the number of children with disabilities
1717 residing in a residential facility who:
1818 (1) are required to be tracked by the Residential
1919 Facility Monitoring (RFM) System; and
2020 (2) receive educational services from the district or
2121 school.
2222 SECTION 2. This Act applies beginning with the 2017-2018
2323 school year.
2424 SECTION 3. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2017.
