8 | 8 | | children in the managing conservatorship of the Department of |

9 | 9 | | Family and Protective Services. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Chapter 266, Family Code, is amended by adding |
---|
12 | 12 | | Section 266.0031 to read as follows: |
---|
13 | 13 | | Sec. 266.0031. INITIAL MEDICAL AND PSYCHOLOGICAL |
---|
14 | 14 | | ASSESSMENT; SCHEDULING OF SERVICES. (a) The department shall |
---|
15 | 15 | | conduct an initial medical and psychological assessment of a child |
---|
16 | 16 | | not later than the seventh day after the date the child enters the |
---|
17 | 17 | | managing conservatorship of the department, or not later than the |
---|
18 | 18 | | third day after the date the child enters the managing |
---|
19 | 19 | | conservatorship of the department if the child was removed from the |
---|
20 | 20 | | child's home because of an immediate risk of abuse or neglect that |
---|
21 | 21 | | could have resulted in the death of or serious harm to the child. |
---|
22 | 22 | | (b) Following the initial assessments of a child under |
---|
23 | 23 | | Subsection (a), the department may, without court approval, |
---|
24 | 24 | | schedule for the child any preventive treatments, acute medical |
---|
25 | 25 | | services, or therapeutic and rehabilitative care to meet the |
---|
26 | 26 | | child's mental and physical needs. In scheduling treatments, |
---|
27 | 27 | | services, or care under this subsection, the department shall |
---|
28 | 28 | | adhere to the medical services delivery model developed under |
---|
29 | 29 | | Section 266.003. |
---|
30 | 30 | | SECTION 2. Section 266.0031, Family Code, as added by this |
---|
31 | 31 | | Act, applies only to a child who enters the conservatorship of the |
---|
32 | 32 | | Department of Family and Protective Services on or after the |
---|
33 | 33 | | effective date of this Act. A child who enters the conservatorship |
---|
34 | 34 | | of the Department of Family and Protective Services before the |
---|
35 | 35 | | effective date of this Act is governed by the law in effect on the |
---|
36 | 36 | | date the child entered foster care, and the former law is continued |
---|
37 | 37 | | in effect for that purpose. |
---|
38 | 38 | | SECTION 3. This Act takes effect September 1, 2017. |
