55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to medical and psychological assessments and services for
88 children in the managing conservatorship of the Department of
99 Family and Protective Services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 266, Family Code, is amended by adding
1212 Section 266.0031 to read as follows:
1313 Sec. 266.0031. INITIAL MEDICAL AND PSYCHOLOGICAL
1414 ASSESSMENT; SCHEDULING OF SERVICES. (a) The department shall
1515 conduct an initial medical and psychological assessment of a child
1616 not later than the seventh day after the date the child enters the
1717 managing conservatorship of the department, or not later than the
1818 third day after the date the child enters the managing
1919 conservatorship of the department if the child was removed from the
2020 child's home because of an immediate risk of abuse or neglect that
2121 could have resulted in the death of or serious harm to the child.
2222 (b) Following the initial assessments of a child under
2323 Subsection (a), the department may, without court approval,
2424 schedule for the child any preventive treatments, acute medical
2525 services, or therapeutic and rehabilitative care to meet the
2626 child's mental and physical needs. In scheduling treatments,
2727 services, or care under this subsection, the department shall
2828 adhere to the medical services delivery model developed under
2929 Section 266.003.
3030 SECTION 2. Section 266.0031, Family Code, as added by this
3131 Act, applies only to a child who enters the conservatorship of the
3232 Department of Family and Protective Services on or after the
3333 effective date of this Act. A child who enters the conservatorship
3434 of the Department of Family and Protective Services before the
3535 effective date of this Act is governed by the law in effect on the
3636 date the child entered foster care, and the former law is continued
3737 in effect for that purpose.
3838 SECTION 3. This Act takes effect September 1, 2017.
