9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter B, Chapter 40, Human Resources Code, | |
11 | 11 | is amended by adding Section 40.0328 to read as follows: | |
12 | 12 | Sec. 40.0328. CASEWORKER CASELOAD MANAGEMENT SYSTEM. The | |
13 | 13 | department shall manage the duties of caseworkers to maintain the | |
14 | 14 | safety of children in child protective services by establishing a | |
15 | 15 | caseload management system that: | |
16 | 16 | (1) assigns a risk score to each child in the | |
17 | 17 | department's care based on an assessment of the current and | |
18 | 18 | potential risk of harm to the child from abuse or neglect; | |
19 | 19 | (2) determines the appropriate number of cases to be | |
20 | 20 | assigned to a caseworker based on the risk scores of the children | |
21 | 21 | assigned to the caseworker; and | |
22 | 22 | (3) proportionally limits the number of children with | |
23 | 23 | higher risk scores that may be assigned to any one caseworker. | |
24 | 24 | SECTION 2. As soon as practicable after the effective date | |
25 | 25 | of this Act, the Department of Family and Protective Services shall | |
26 | 26 | establish and implement the caseload management system as required | |
27 | 27 | under Section 40.0328, Human Resources Code, as added by this Act. | |
28 | 28 | SECTION 3. This Act takes effect September 1, 2017. |
