| 8 | 8 | | nontenure track faculty employed at public universities. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 51.9085 to read as follows: |
|---|
| 12 | 12 | | Sec. 51.9085. LIMITATION ON EMPLOYMENT OF CERTAIN |
|---|
| 13 | 13 | | NONTENURED OR NONTENURE TRACK FACULTY. (a) In this section: |
|---|
| 14 | 14 | | (1) "Faculty member" means a person employed full-time |
|---|
| 15 | 15 | | or part-time by a general academic teaching institution whose |
|---|
| 16 | 16 | | primary duties include teaching students enrolled at the |
|---|
| 17 | 17 | | institution or research. The term does not include: |
|---|
| 18 | 18 | | (A) a person who holds faculty rank but who |
|---|
| 19 | 19 | | spends a majority of the person's time for the institution engaged |
|---|
| 20 | 20 | | in managerial or supervisory activities, including a chancellor, |
|---|
| 21 | 21 | | vice chancellor, president, vice president, provost, associate or |
|---|
| 22 | 22 | | assistant provost, dean, or associate or assistant dean; or |
|---|
| 23 | 23 | | (B) a person who is employed part-time to teach |
|---|
| 24 | 24 | | while enrolled as a student of the institution. |
|---|
| 25 | 25 | | (2) "General academic teaching institution" has the |
|---|
| 26 | 26 | | meaning assigned by Section 61.003. |
|---|
| 27 | 27 | | (b) During any academic year, not more than 25 percent of |
|---|
| 28 | 28 | | the total number of faculty members employed by a general academic |
|---|
| 29 | 29 | | teaching institution may be employed by the institution on a |
|---|
| 30 | 30 | | nontenured or nontenure track basis under which the faculty members |
|---|
| 31 | 31 | | are: |
|---|
| 32 | 32 | | (1) compensated hourly or on another nonsalary basis; |
|---|
| 33 | 33 | | and |
|---|
| 34 | 34 | | (2) ineligible for the same employment benefits as a |
|---|
| 35 | 35 | | tenured or tenure track faculty member. |
|---|
| 36 | 36 | | (c) The Texas Higher Education Coordinating Board may adopt |
|---|
| 37 | 37 | | rules to administer this section. |
|---|
| 38 | 38 | | SECTION 2. Section 51.9085, Education Code, as added by |
|---|
| 39 | 39 | | this Act, applies beginning with the 2018-2019 academic year. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect January 1, 2018. |
