66 AN ACT
77 relating to a limitation on the number of certain nontenured or
88 nontenure track faculty employed at public universities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1111 amended by adding Section 51.9085 to read as follows:
1212 Sec. 51.9085. LIMITATION ON EMPLOYMENT OF CERTAIN
1313 NONTENURED OR NONTENURE TRACK FACULTY. (a) In this section:
1414 (1) "Faculty member" means a person employed full-time
1515 or part-time by a general academic teaching institution whose
1616 primary duties include teaching students enrolled at the
1717 institution or research. The term does not include:
1818 (A) a person who holds faculty rank but who
1919 spends a majority of the person's time for the institution engaged
2020 in managerial or supervisory activities, including a chancellor,
2121 vice chancellor, president, vice president, provost, associate or
2222 assistant provost, dean, or associate or assistant dean; or
2323 (B) a person who is employed part-time to teach
2424 while enrolled as a student of the institution.
2525 (2) "General academic teaching institution" has the
2626 meaning assigned by Section 61.003.
2727 (b) During any academic year, not more than 25 percent of
2828 the total number of faculty members employed by a general academic
2929 teaching institution may be employed by the institution on a
3030 nontenured or nontenure track basis under which the faculty members
3131 are:
3232 (1) compensated hourly or on another nonsalary basis;
3333 and
3434 (2) ineligible for the same employment benefits as a
3535 tenured or tenure track faculty member.
3636 (c) The Texas Higher Education Coordinating Board may adopt
3737 rules to administer this section.
3838 SECTION 2. Section 51.9085, Education Code, as added by
3939 this Act, applies beginning with the 2018-2019 academic year.
4040 SECTION 3. This Act takes effect January 1, 2018.
