55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to instruction in positive character traits in public
88 schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 29.906, Education Code, is amended to
1111 read as follows:
1212 Sec. 29.906. CHARACTER TRAITS INSTRUCTION [EDUCATION
1313 PROGRAM]. (a) The State Board of Education shall integrate
1414 positive character traits into the essential knowledge and skills
1515 adopted for kindergarten through grade 12, as appropriate [A school
1616 district may provide a character education program].
1717 (b) The State Board of Education must include the following
1818 [A character education program under this section must:
1919 [(1) stress] positive character traits [, such as]:
2020 (1) [(A)] courage;
2121 (2) [(B)] trustworthiness, including honesty,
2222 reliability, punctuality, and loyalty;
2323 (3) [(C)] integrity;
2424 (4) [(D)] respect and courtesy;
2525 (5) [(E)] responsibility, including accountability,
2626 diligence, perseverance, and self-control;
2727 (6) [(F)] fairness, including justice and freedom
2828 from prejudice;
2929 (7) [(G)] caring, including kindness, empathy,
3030 compassion, consideration, patience, generosity, and charity;
3131 (8) [(H)] good citizenship, including patriotism,
3232 concern for the common good and the community, and respect for
3333 authority and the law; [and]
3434 (9) [(I)] school pride; and
3535 (10) gratitude[;
3636 [(2) use integrated teaching strategies; and
3737 [(3) be age appropriate].
3838 (c) The State Board of Education shall create a report that
3939 identifies the manner in which the character traits listed under
4040 Subsection (b) have been integrated into the curriculum. The board
4141 shall make the report publicly available on the board's Internet
4242 website.
4343 (d) Each school district and open-enrollment charter school
4444 must adopt a character education program that includes the positive
4545 character traits listed in Subsection (b). The district or
4646 open-enrollment charter school shall submit the adopted program to
4747 the agency annually, in a manner determined by the commissioner.
4848 (e) In developing or selecting a character education
4949 program under this section, a school district shall consult with a
5050 committee selected by the district that consists of:
5151 (1) parents of district students;
5252 (2) educators; and
5353 (3) other members of the community, including
5454 community leaders.
5555 (f) [(d)] This section does not require or authorize
5656 proselytizing or indoctrinating concerning any specific religious
5757 or political belief.
5858 (g) [(e)] The agency shall:
5959 (1) maintain a list of character education programs
6060 that school districts have implemented that meet the criteria under
6161 Subsection (b); and
6262 (2) using the services of a center for education
6363 research established under Section 1.005, and based on data
6464 reported by districts, annually designate as a Character Plus
6565 School each school that provides a character education program
6666 that:
6767 (A) meets the criteria prescribed by Subsection
6868 (b); [and]
6969 (B) is approved by the committee selected under
7070 Subsection (e) [(c)]; and
7171 (C) demonstrates a correlation between the
7272 character education program adopted by the school, an increase in
7373 student attendance levels, and a decrease in student disciplinary
7474 problems [(3) include in the report required under Section 39.332:
7575 [(A) based on data reported by districts, the
7676 impact of character education programs on student discipline and
7777 academic achievement; and
7878 [(B) other reported data relating to character
7979 education programs the agency considers appropriate for
8080 inclusion].
8181 (h) [(f)] The agency may accept money from [federal
8282 government and] private sources to use in assisting school
8383 districts in implementing character education programs that meet
8484 the criteria prescribed by Subsection (b).
8585 (i) The State Board of Education may adopt rules as
8686 necessary to implement this section.
8787 SECTION 2. This Act applies beginning with the 2017-2018
8888 school year.
8989 SECTION 3. This Act takes effect immediately if it receives
9090 a vote of two-thirds of all the members elected to each house, as
9191 provided by Section 39, Article III, Texas Constitution. If this
9292 Act does not receive the vote necessary for immediate effect, this
9393 Act takes effect September 1, 2017.
