55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a defense to prosecution for certain offenses involving
88 possession of small amounts of controlled substances and other
99 prohibited drugs, substances, or paraphernalia for defendants
1010 seeking assistance for a suspected overdose.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 481.115, Health and Safety Code, is
1313 amended by adding Subsections (g), (h), and (i) to read as follows:
1414 (g) It is a defense to prosecution for an offense punishable
1515 under Subsection (b) that the actor:
1616 (1) was the first person to request emergency medical
1717 assistance in response to the possible overdose of another person
1818 and:
1919 (A) made the request for medical assistance
2020 during an ongoing medical emergency;
2121 (B) remained on the scene until the medical
2222 assistance arrived; and
2323 (C) cooperated with medical assistance and law
2424 enforcement personnel; or
2525 (2) was the victim of a possible overdose for which
2626 emergency medical assistance was requested, by the actor or by
2727 another person, during an ongoing medical emergency.
2828 (h) The defense to prosecution provided by Subsection (g) is
2929 not available if, at the time the request for emergency medical
3030 assistance was made, a peace officer was in the process of arresting
3131 the actor or executing a search warrant describing the actor or the
3232 place from which the request for medical assistance was made.
3333 (i) The defense to prosecution provided by Subsection (g)
3434 does not preclude the admission of evidence obtained by law
3535 enforcement resulting from the request for emergency medical
3636 assistance if that evidence pertains to an offense for which the
3737 defense described by Subsection (g) is not available.
3838 SECTION 2. Section 481.1151, Health and Safety Code, is
3939 amended by adding Subsections (c), (d), and (e) to read as follows:
4040 (c) It is a defense to prosecution for an offense punishable
4141 under Subsection (b)(1) that the actor:
4242 (1) was the first person to request emergency medical
4343 assistance in response to the possible overdose of another person
4444 and:
4545 (A) made the request for medical assistance
4646 during an ongoing medical emergency;
4747 (B) remained on the scene until the medical
4848 assistance arrived; and
4949 (C) cooperated with medical assistance and law
5050 enforcement personnel; or
5151 (2) was the victim of a possible overdose for which
5252 emergency medical assistance was requested, by the actor or by
5353 another person, during an ongoing medical emergency.
5454 (d) The defense to prosecution provided by Subsection (c) is
5555 not available if, at the time the request for emergency medical
5656 assistance was made, a peace officer was in the process of arresting
5757 the actor or executing a search warrant describing the actor or the
5858 place from which the request for medical assistance was made.
5959 (e) The defense to prosecution provided by Subsection (c)
6060 does not preclude the admission of evidence obtained by law
6161 enforcement resulting from the request for emergency medical
6262 assistance if that evidence pertains to an offense for which the
6363 defense described by Subsection (c) is not available.
6464 SECTION 3. Section 481.116, Health and Safety Code, is
6565 amended by adding Subsections (f), (g), and (h) to read as follows:
6666 (f) It is a defense to prosecution for an offense punishable
6767 under Subsection (b) that the actor:
6868 (1) was the first person to request emergency medical
6969 assistance in response to the possible overdose of another person
7070 and:
7171 (A) made the request for medical assistance
7272 during an ongoing medical emergency;
7373 (B) remained on the scene until the medical
7474 assistance arrived; and
7575 (C) cooperated with medical assistance and law
7676 enforcement personnel; or
7777 (2) was the victim of a possible overdose for which
7878 emergency medical assistance was requested, by the actor or by
7979 another person, during an ongoing medical emergency.
8080 (g) The defense to prosecution provided by Subsection (f) is
8181 not available if, at the time the request for emergency medical
8282 assistance was made, a peace officer was in the process of arresting
8383 the actor or executing a search warrant describing the actor or the
8484 place from which the request for medical assistance was made.
8585 (h) The defense to prosecution provided by Subsection (f)
8686 does not preclude the admission of evidence obtained by law
8787 enforcement resulting from the request for emergency medical
8888 assistance if that evidence pertains to an offense for which the
8989 defense described by Subsection (f) is not available.
9090 SECTION 4. Section 481.1161, Health and Safety Code, is
9191 amended by adding Subsections (c), (d), and (e) to read as follows:
9292 (c) It is a defense to prosecution for an offense punishable
9393 under Subsection (b)(1) or (2) that the actor:
9494 (1) was the first person to request emergency medical
9595 assistance in response to the possible overdose of another person
9696 and:
9797 (A) made the request for medical assistance
9898 during an ongoing medical emergency;
9999 (B) remained on the scene until the medical
100100 assistance arrived; and
101101 (C) cooperated with medical assistance and law
102102 enforcement personnel; or
103103 (2) was the victim of a possible overdose for which
104104 emergency medical assistance was requested, by the actor or by
105105 another person, during an ongoing medical emergency.
106106 (d) The defense to prosecution provided by Subsection (c) is
107107 not available if, at the time the request for emergency medical
108108 assistance was made, a peace officer was in the process of arresting
109109 the actor or executing a search warrant describing the actor or the
110110 place from which the request for medical assistance was made.
111111 (e) The defense to prosecution provided by Subsection (c)
112112 does not preclude the admission of evidence obtained by law
113113 enforcement resulting from the request for emergency medical
114114 assistance if that evidence pertains to an offense for which the
115115 defense described by Subsection (c) is not available.
116116 SECTION 5. Section 481.117, Health and Safety Code, is
117117 amended by adding Subsections (f), (g), and (h) to read as follows:
118118 (f) It is a defense to prosecution for an offense punishable
119119 under Subsection (b) that the actor:
120120 (1) was the first person to request emergency medical
121121 assistance in response to the possible overdose of another person
122122 and:
123123 (A) made the request for medical assistance
124124 during an ongoing medical emergency;
125125 (B) remained on the scene until the medical
126126 assistance arrived; and
127127 (C) cooperated with medical assistance and law
128128 enforcement personnel; or
129129 (2) was the victim of a possible overdose for which
130130 emergency medical assistance was requested, by the actor or by
131131 another person, during an ongoing medical emergency.
132132 (g) The defense to prosecution provided by Subsection (f) is
133133 not available if, at the time the request for emergency medical
134134 assistance was made, a peace officer was in the process of arresting
135135 the actor or executing a search warrant describing the actor or the
136136 place from which the request for medical assistance was made.
137137 (h) The defense to prosecution provided by Subsection (f)
138138 does not preclude the admission of evidence obtained by law
139139 enforcement resulting from the request for emergency medical
140140 assistance if that evidence pertains to an offense for which the
141141 defense described by Subsection (f) is not available.
142142 SECTION 6. Section 481.118, Health and Safety Code, is
143143 amended by adding Subsections (f), (g), and (h) to read as follows:
144144 (f) It is a defense to prosecution for an offense punishable
145145 under Subsection (b) that the actor:
146146 (1) was the first person to request emergency medical
147147 assistance in response to the possible overdose of another person
148148 and:
149149 (A) made the request for medical assistance
150150 during an ongoing medical emergency;
151151 (B) remained on the scene until the medical
152152 assistance arrived; and
153153 (C) cooperated with medical assistance and law
154154 enforcement personnel; or
155155 (2) was the victim of a possible overdose for which
156156 emergency medical assistance was requested, by the actor or by
157157 another person, during an ongoing medical emergency.
158158 (g) The defense to prosecution provided by Subsection (f) is
159159 not available if, at the time the request for emergency medical
160160 assistance was made, a peace officer was in the process of arresting
161161 the actor or executing a search warrant describing the actor or the
162162 place from which the request for medical assistance was made.
163163 (h) The defense to prosecution provided by Subsection (f)
164164 does not preclude the admission of evidence obtained by law
165165 enforcement resulting from the request for emergency medical
166166 assistance if that evidence pertains to an offense for which the
167167 defense described by Subsection (f) is not available.
168168 SECTION 7. Section 481.119, Health and Safety Code, is
169169 amended by adding Subsections (c), (d), and (e) to read as follows:
170170 (c) It is a defense to prosecution for an offense under
171171 Subsection (b) that the actor:
172172 (1) was the first person to request emergency medical
173173 assistance in response to the possible overdose of another person
174174 and:
175175 (A) made the request for medical assistance
176176 during an ongoing medical emergency;
177177 (B) remained on the scene until the medical
178178 assistance arrived; and
179179 (C) cooperated with medical assistance and law
180180 enforcement personnel; or
181181 (2) was the victim of a possible overdose for which
182182 emergency medical assistance was requested, by the actor or by
183183 another person, during an ongoing medical emergency.
184184 (d) The defense to prosecution provided by Subsection (c) is
185185 not available if, at the time the request for emergency medical
186186 assistance was made, a peace officer was in the process of arresting
187187 the actor or executing a search warrant describing the actor or the
188188 place from which the request for medical assistance was made.
189189 (e) The defense to prosecution provided by Subsection (c)
190190 does not preclude the admission of evidence obtained by law
191191 enforcement resulting from the request for emergency medical
192192 assistance if that evidence pertains to an offense for which the
193193 defense described by Subsection (c) is not available.
194194 SECTION 8. Section 481.121, Health and Safety Code, is
195195 amended by adding Subsections (c), (d), and (e) to read as follows:
196196 (c) It is a defense to prosecution for an offense punishable
197197 under Subsection (b)(1) or (2) that the actor:
198198 (1) was the first person to request emergency medical
199199 assistance in response to the possible overdose of another person
200200 and:
201201 (A) made the request for medical assistance
202202 during an ongoing medical emergency;
203203 (B) remained on the scene until the medical
204204 assistance arrived; and
205205 (C) cooperated with medical assistance and law
206206 enforcement personnel; or
207207 (2) was the victim of a possible overdose for which
208208 emergency medical assistance was requested, by the actor or by
209209 another person, during an ongoing medical emergency.
210210 (d) The defense to prosecution provided by Subsection (c) is
211211 not available if, at the time the request for emergency medical
212212 assistance was made, a peace officer was in the process of arresting
213213 the actor or executing a search warrant describing the actor or the
214214 place from which the request for medical assistance was made.
215215 (e) The defense to prosecution provided by Subsection (c)
216216 does not preclude the admission of evidence obtained by law
217217 enforcement resulting from the request for emergency medical
218218 assistance if that evidence pertains to an offense for which the
219219 defense described by Subsection (c) is not available.
220220 SECTION 9. Section 481.125, Health and Safety Code, is
221221 amended by adding Subsections (g), (h), and (i) to read as follows:
222222 (g) It is a defense to prosecution for an offense under
223223 Subsection (a) that the actor:
224224 (1) was the first person to request emergency medical
225225 assistance in response to the possible overdose of another person
226226 and:
227227 (A) made the request for medical assistance
228228 during an ongoing medical emergency;
229229 (B) remained on the scene until the medical
230230 assistance arrived; and
231231 (C) cooperated with medical assistance and law
232232 enforcement personnel; or
233233 (2) was the victim of a possible overdose for which
234234 emergency medical assistance was requested, by the actor or by
235235 another person, during an ongoing medical emergency.
236236 (h) The defense to prosecution provided by Subsection (g) is
237237 not available if, at the time the request for emergency medical
238238 assistance was made, a peace officer was in the process of arresting
239239 the actor or executing a search warrant describing the actor or the
240240 place from which the request for medical assistance was made.
241241 (i) The defense to prosecution provided by Subsection (g)
242242 does not preclude the admission of evidence obtained by law
243243 enforcement resulting from the request for emergency medical
244244 assistance if that evidence pertains to an offense for which the
245245 defense described by Subsection (g) is not available.
246246 SECTION 10. Section 483.041, Health and Safety Code, is
247247 amended by adding Subsections (e), (f), and (g) to read as follows:
248248 (e) It is a defense to prosecution for an offense under
249249 Subsection (a) that the actor:
250250 (1) was the first person to request emergency medical
251251 assistance in response to the possible overdose of another person
252252 and:
253253 (A) made the request for medical assistance
254254 during an ongoing medical emergency;
255255 (B) remained on the scene until the medical
256256 assistance arrived; and
257257 (C) cooperated with medical assistance and law
258258 enforcement personnel; or
259259 (2) was the victim of a possible overdose for which
260260 emergency medical assistance was requested, by the actor or by
261261 another person, during an ongoing medical emergency.
262262 (f) The defense to prosecution provided by Subsection (e) is
263263 not available if, at the time the request for emergency medical
264264 assistance was made, a peace officer was in the process of arresting
265265 the actor or executing a search warrant describing the actor or the
266266 place from which the request for medical assistance was made.
267267 (g) The defense to prosecution provided by Subsection (e)
268268 does not preclude the admission of evidence obtained by law
269269 enforcement resulting from the request for emergency medical
270270 assistance if that evidence pertains to an offense for which the
271271 defense described by Subsection (e) is not available.
272272 SECTION 11. Section 485.031, Health and Safety Code, is
273273 amended by adding Subsections (c), (d), and (e) to read as follows:
274274 (c) It is a defense to prosecution for an offense under
275275 Subsection (a) that the actor:
276276 (1) was the first person to request emergency medical
277277 assistance in response to the possible overdose of another person
278278 and:
279279 (A) made the request for medical assistance
280280 during an ongoing medical emergency;
281281 (B) remained on the scene until the medical
282282 assistance arrived; and
283283 (C) cooperated with medical assistance and law
284284 enforcement personnel; or
285285 (2) was the victim of a possible overdose for which
286286 emergency medical assistance was requested, by the actor or by
287287 another person, during an ongoing medical emergency.
288288 (d) The defense to prosecution provided by Subsection (c) is
289289 not available if, at the time the request for emergency medical
290290 assistance was made, a peace officer was in the process of arresting
291291 the actor or executing a search warrant describing the actor or the
292292 place from which the request for medical assistance was made.
293293 (e) The defense to prosecution provided by Subsection (c)
294294 does not preclude the admission of evidence obtained by law
295295 enforcement resulting from the request for emergency medical
296296 assistance if that evidence pertains to an offense for which the
297297 defense described by Subsection (c) is not available.
298298 SECTION 12. The change in law made by this Act applies only
299299 to an offense committed on or after the effective date of this Act.
300300 An offense committed before the effective date of this Act is
301301 governed by the law in effect on the date the offense was committed,
302302 and the former law is continued in effect for that purpose. For
303303 purposes of this section, an offense was committed before the
304304 effective date of this Act if any element of the offense occurred
305305 before that date.
306306 SECTION 13. This Act takes effect September 1, 2017.
