| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 544.012, Transportation Code, is amended |
|---|
| 11 | 11 | | by amending Subsection (c) and adding Subsection (c-1) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (c) The municipality shall install signs along each roadway |
|---|
| 14 | 14 | | that leads to an intersection at which a photographic traffic |
|---|
| 15 | 15 | | monitoring system is in active use. The signs must be at least 100 |
|---|
| 16 | 16 | | feet from the intersection or located according to standards |
|---|
| 17 | 17 | | established in the manual adopted by the Texas Transportation |
|---|
| 18 | 18 | | Commission under Section 544.001, be easily readable to any |
|---|
| 19 | 19 | | operator approaching the intersection, and clearly indicate: |
|---|
| 20 | 20 | | (1) the presence of a photographic traffic monitoring |
|---|
| 21 | 21 | | system that records violations that may result in the issuance of a |
|---|
| 22 | 22 | | notice of violation and the imposition of a monetary penalty; and |
|---|
| 23 | 23 | | (2) the range of the dollar amounts of the monetary |
|---|
| 24 | 24 | | penalties that may be imposed for a violation recorded by a |
|---|
| 25 | 25 | | photographic traffic monitoring system. |
|---|
| 26 | 26 | | (c-1) A municipality is exempt from the requirements of |
|---|
| 27 | 27 | | Subsection (c)(2) if before September 1, 2017, the municipality has |
|---|
| 28 | 28 | | installed a sign: |
|---|
| 29 | 29 | | (1) along each roadway leading to an intersection at |
|---|
| 30 | 30 | | which a photographic traffic monitoring system is in active use; |
|---|
| 31 | 31 | | and |
|---|
| 32 | 32 | | (2) indicating the amount of a monetary penalty that |
|---|
| 33 | 33 | | may be imposed for a violation recorded by the system. |
|---|
| 34 | 34 | | SECTION 2. This Act takes effect September 1, 2017. |
