66 AN ACT
77 relating to the content of photographic traffic monitoring system
88 signs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 544.012, Transportation Code, is amended
1111 by amending Subsection (c) and adding Subsection (c-1) to read as
1212 follows:
1313 (c) The municipality shall install signs along each roadway
1414 that leads to an intersection at which a photographic traffic
1515 monitoring system is in active use. The signs must be at least 100
1616 feet from the intersection or located according to standards
1717 established in the manual adopted by the Texas Transportation
1818 Commission under Section 544.001, be easily readable to any
1919 operator approaching the intersection, and clearly indicate:
2020 (1) the presence of a photographic traffic monitoring
2121 system that records violations that may result in the issuance of a
2222 notice of violation and the imposition of a monetary penalty; and
2323 (2) the range of the dollar amounts of the monetary
2424 penalties that may be imposed for a violation recorded by a
2525 photographic traffic monitoring system.
2626 (c-1) A municipality is exempt from the requirements of
2727 Subsection (c)(2) if before September 1, 2017, the municipality has
2828 installed a sign:
2929 (1) along each roadway leading to an intersection at
3030 which a photographic traffic monitoring system is in active use;
3131 and
3232 (2) indicating the amount of a monetary penalty that
3333 may be imposed for a violation recorded by the system.
3434 SECTION 2. This Act takes effect September 1, 2017.
