66 AN ACT
77 relating to the board of trustees of the Texas County and District
88 Retirement System.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 845.001, Government Code, is amended to
1111 read as follows:
1212 Sec. 845.001. COMPOSITION OF BOARD OF TRUSTEES. (a) The
1313 board of trustees is composed of nine members as follows:
1414 (1) four members who serve on a county commissioners
1515 court of a participating subdivision;
1616 (2) one member who serves on the governing body of a
1717 participating special district;
1818 (3) one member who is an employee or retiree of a
1919 participating county; and
2020 (4) three persons who are representatives of the
2121 public.
2222 (b) A member of the board of trustees described by
2323 Subsection (a)(1), (2), or (3) may not reside in the same county as
2424 another member.
2525 SECTION 2. Section 845.003, Government Code, is amended by
2626 amending Subsections (a) and (b) and adding Subsections (a-1) and
2727 (a-2) to read as follows:
2828 (a) Except as provided by Subsection (a-1), to [To] be
2929 eligible to serve as a trustee a person must be[:
3030 [(1)] a member or retiree of the retirement system
3131 [and an employee of a participating subdivision; or
3232 [(2) a retiree of the retirement system].
3333 (a-1) To be eligible to serve as a trustee who is a
3434 representative of the public, a person may not:
3535 (1) be a member or retiree of the retirement system;
3636 (2) hold or have held an elected office; or
3737 (3) be or have been an employee of a governmental
3838 entity.
3939 (a-2) A trustee who is a representative of the public may
4040 not vote on any matter in which the trustee has a pecuniary
4141 interest. Failure to comply with this subsection is a ground for
4242 removal from the board of trustees.
4343 (b) If a person serving as a trustee ceases to meet an
4444 eligibility requirement under Section 845.001 or this section
4545 [Subsection (a)], the person shall vacate the office of trustee.
4646 SECTION 3. The change in law made by this Act to Sections
4747 845.001 and 845.003, Government Code, regarding the composition of
4848 and eligibility requirements for the board of trustees of the Texas
4949 County and District Retirement System, does not affect the
5050 entitlement of a member serving on the board immediately before the
5151 effective date of this Act to continue to serve as a member of the
5252 board for the remainder of the member's term. As the terms of board
5353 members expire or as a vacancy occurs on the board, the governor
5454 shall appoint a member to the board as necessary to comply with
5555 Sections 845.001 and 845.003, Government Code, as amended by this
5656 Act.
5757 SECTION 4. This Act takes effect September 1, 2017.
