| 8 | 8 | | Retirement System. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 845.001, Government Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 845.001. COMPOSITION OF BOARD OF TRUSTEES. (a) The |
|---|
| 13 | 13 | | board of trustees is composed of nine members as follows: |
|---|
| 14 | 14 | | (1) four members who serve on a county commissioners |
|---|
| 15 | 15 | | court of a participating subdivision; |
|---|
| 16 | 16 | | (2) one member who serves on the governing body of a |
|---|
| 17 | 17 | | participating special district; |
|---|
| 18 | 18 | | (3) one member who is an employee or retiree of a |
|---|
| 19 | 19 | | participating county; and |
|---|
| 20 | 20 | | (4) three persons who are representatives of the |
|---|
| 21 | 21 | | public. |
|---|
| 22 | 22 | | (b) A member of the board of trustees described by |
|---|
| 23 | 23 | | Subsection (a)(1), (2), or (3) may not reside in the same county as |
|---|
| 24 | 24 | | another member. |
|---|
| 25 | 25 | | SECTION 2. Section 845.003, Government Code, is amended by |
|---|
| 26 | 26 | | amending Subsections (a) and (b) and adding Subsections (a-1) and |
|---|
| 27 | 27 | | (a-2) to read as follows: |
|---|
| 28 | 28 | | (a) Except as provided by Subsection (a-1), to [To] be |
|---|
| 29 | 29 | | eligible to serve as a trustee a person must be[: |
|---|
| 30 | 30 | | [(1)] a member or retiree of the retirement system |
|---|
| 31 | 31 | | [and an employee of a participating subdivision; or |
|---|
| 32 | 32 | | [(2) a retiree of the retirement system]. |
|---|
| 33 | 33 | | (a-1) To be eligible to serve as a trustee who is a |
|---|
| 34 | 34 | | representative of the public, a person may not: |
|---|
| 35 | 35 | | (1) be a member or retiree of the retirement system; |
|---|
| 36 | 36 | | (2) hold or have held an elected office; or |
|---|
| 37 | 37 | | (3) be or have been an employee of a governmental |
|---|
| 38 | 38 | | entity. |
|---|
| 39 | 39 | | (a-2) A trustee who is a representative of the public may |
|---|
| 40 | 40 | | not vote on any matter in which the trustee has a pecuniary |
|---|
| 41 | 41 | | interest. Failure to comply with this subsection is a ground for |
|---|
| 42 | 42 | | removal from the board of trustees. |
|---|
| 43 | 43 | | (b) If a person serving as a trustee ceases to meet an |
|---|
| 44 | 44 | | eligibility requirement under Section 845.001 or this section |
|---|
| 45 | 45 | | [Subsection (a)], the person shall vacate the office of trustee. |
|---|
| 46 | 46 | | SECTION 3. The change in law made by this Act to Sections |
|---|
| 47 | 47 | | 845.001 and 845.003, Government Code, regarding the composition of |
|---|
| 48 | 48 | | and eligibility requirements for the board of trustees of the Texas |
|---|
| 49 | 49 | | County and District Retirement System, does not affect the |
|---|
| 50 | 50 | | entitlement of a member serving on the board immediately before the |
|---|
| 51 | 51 | | effective date of this Act to continue to serve as a member of the |
|---|
| 52 | 52 | | board for the remainder of the member's term. As the terms of board |
|---|
| 53 | 53 | | members expire or as a vacancy occurs on the board, the governor |
|---|
| 54 | 54 | | shall appoint a member to the board as necessary to comply with |
|---|
| 55 | 55 | | Sections 845.001 and 845.003, Government Code, as amended by this |
|---|
| 56 | 56 | | Act. |
|---|
| 57 | 57 | | SECTION 4. This Act takes effect September 1, 2017. |
