86 AN ACT
97 relating to certain costs associated with certain court proceedings
108 for cruelly treated animals; authorizing fees and costs.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Section 821.023(e), Health and Safety Code, is
1311 amended to read as follows:
1412 (e) After a court finds that an animal's owner has cruelly
1513 treated the animal, the court:
1614 (1) shall order the owner to pay all court costs,
1715 including:
1816 (A) [(1)] the administrative costs of:
1917 (i) [(A)] investigation;
2018 (ii) [(B)] expert witnesses; and
2119 (iii) [(C)] conducting any public sale
2220 ordered by the court; and
2321 (B) [(2)] the costs incurred by a municipal or
2422 county animal shelter or a nonprofit animal welfare organization
2523 in:
2624 (i) [(A)] housing and caring for the animal
2725 during its impoundment; and
2826 (ii) [(B)] humanely destroying the animal
2927 if destruction is ordered by the court; and
3028 (2) in a county or municipality with a population of at
3129 least 700,000, may order the owner to pay the county's or
3230 municipality's reasonable attorney's fees.
3331 SECTION 2. Section 821.025, Health and Safety Code, is
3432 amended by adding Subsection (i) to read as follows:
3533 (i) In a county or municipality with a population of at
3634 least 700,000, a county court or county court at law that issues a
3735 decision in an appeal under this section finding that an animal's
3836 owner has cruelly treated the animal may order the owner to pay the
3937 county's or municipality's reasonable attorney's fees and court
4038 costs, including the costs of investigation and expert witnesses.
4139 SECTION 3. Section 103.0214, Government Code, is amended to
4240 read as follows:
4341 Sec. 103.0214. ADDITIONAL FEES AND COSTS IN CRIMINAL OR
4442 CIVIL CASES: HEALTH AND SAFETY CODE. An accused or defendant, or a
4543 party to a civil suit, as applicable, shall pay the following fees
4644 and costs under the Health and Safety Code if ordered by the court
4745 or otherwise required:
4846 (1) a fee to defray the cost of notifying state
4947 agencies of orders of expungement (Sec. 161.255, Health and Safety
5048 Code) . . . $30 per application; and
5149 (2) on a finding that an animal's owner has cruelly
5250 treated the animal, court costs including:
5351 (A) investigation (Secs. [Sec.] 821.023 and
5452 821.025, Health and Safety Code) . . . actual costs;
5553 (B) expert witnesses (Secs. [Sec.] 821.023 and
5654 821.025, Health and Safety Code) . . . actual costs;
5755 (C) housing and caring for the animal during its
5856 impoundment (Sec. 821.023, Health and Safety Code) . . . actual
5957 costs;
6058 (D) conducting any public sale ordered by the
6159 court (Sec. 821.023, Health and Safety Code) . . . actual costs;
6260 [and]
6361 (E) humanely destroying the animal if
6462 destruction is ordered by the court (Sec. 821.023, Health and
6563 Safety Code) . . . actual costs; and
6664 (F) reasonable attorney's fees (Secs. 821.023
6765 and 821.025, Health and Safety Code) . . . actual costs.
6866 SECTION 4. The change in law made by this Act applies only
6967 to a proceeding commenced under Section 821.023 or 821.025, Health
7068 and Safety Code, on or after the effective date of this Act. A
7169 proceeding commenced before the effective date of this Act is
7270 governed by the law as it existed at the time the proceeding was
7371 commenced, and the former law is continued in effect for that
7472 purpose.
7573 SECTION 5. This Act takes effect September 1, 2017.
